With All These Defections, How Can Intelligence Agencies Make Claims about Chain of Command?

The French, who have a long history with Syria, offered a somewhat more developed explanation for why they’re so sure that Bashar al-Assad should be held responsible for the August 21 attack even while someone in his Ministry of Defense appears to have been panicked and confused about the attack. (Note: Alan Grayson asked for this intercept to be declassified in today’s hearing, but Chuck Hagel seemed unenthused about that idea.)

Last Wednesday, in the hours after a horrific chemical attack east of Damascus, an official at the Syrian Ministry of Defense exchanged panicked phone calls with a leader of a chemical weapons unit, demanding answers for a nerve agent strike that killed more than 1,000 people.

In their case for war they talked about how tightly controlled Assad’s Chemical Weapons are.

The Syrian chemical programme is centred around the Center of Scientific Studies and Research (CSSR), in charge among others of producing chemical warfare agents. Its Branch 450 is in charge of the filling of chemical ammunitions, as well as the security of chemical sites and stockpiles. Formed exclusively with Alawi officers, this unit is known for its high loyalty to the regime.

Bachar al Assad and some of the most influential members of his clan are the only ones empowered to order the use of chemical weapons. The order is then forwarded to the commanding officers within the competent branches of the CSSR. In parallel, the armed forces HQs receive the order, decide of targeting and of the choice of weapons and toxic agents to use.

While not definitive, it is a slightly more developed version of the argument that the US made.

Syrian President Bashar al-Asad is the ultimate decision maker for the chemical weapons program and members of the program are carefully vetted to ensure security and loyalty. The Syrian Scientific Studies and Research Center (SSRC) – which is subordinate to the Syrian Ministry of Defense – manages Syria’s chemical weapons program.

Nevertheless, in the face of some questions about what the men in the CW unit were doing, both governments have offered simply an argument about how reliable the CW staffers are in this unit.

But that comes amidst what John Kerry claims is a big wave of defections. The most notable is that of General Habib Ali, Assad’s former Minister of Defense and like him an Alawite.

“Ali Habib has managed to escape from the grip of the regime and he is now in Turkey, but this does not mean that he has joined the opposition. I was told this by a Western diplomatic official,” Kamal al-Labwani said from Paris.

The Syrian Not-War: Money Issues

Screen shot 2013-09-04 at 1.05.30 PMThe most interesting details in today’s House Foreign Relations Committee hearing on Syria pertained to money.

First, when asked how much this not-war (for a second day, Kerry insisted this isn’t a real war) would cost, Chuck Hagel said it would cost tens of millions of dollars.

But when Alan Grayson asked whether Hagel would commit that he would not need supplemental funding for it (tens of millions are, after all, a rounding error for DOD), Hagel first said it depended on what options the President chose, then said um no, he couldn’t commit to that.

Finally, very early in the hearing, John Kerry intimated that someone (presumably the Saudis, but we’ve got a lot of rich autocrats in the region who want to oust Bashar al-Assad) had offered to pay the entire price of the operation if we would simply do it. But we weren’t going to take that friend up on the offer.

At this point, I’m not even sure the AUMF can pass the Senate (it passed out of the Senate Foreign Relations Committee with just a 55% yes vote: 10-7-1, which doesn’t bode will for the Senate’s filibuster customs–though that may not matter). But even if it does, the Administration would be well-served to remember they’ve got a debt limit fight coming up.

Why is Obama Changing the Date and Size of First CIA Death Squads to Enter Syria?

There is a very interesting point thrown in as a small tidbit in Monday’s New York Times story on Barack Obama securing the support of John McCain for a military strike on Syria:

Officials said that in the same conversation, which included Senator Lindsey Graham, the South Carolina Republican, Mr. Obama indicated that a covert effort by the United States to arm and train Syrian rebels was beginning to yield results: the first 50-man cell of fighters, who have been trained by the C.I.A., was beginning to sneak into Syria.

Taken at face value, this version of the story would have us believe that the first group of 50 trained by the CIA was presumably still in the process of “sneaking” into Syria on Monday. But the timeline of US training for these fighters is much more complex than that. Some foul-mouthed blogger noted back in May that this training program had already been underway for some time and the LA Times caught up with her in June, disclosing that the program began at least as far back as November 2012 on US bases in Jordan and Turkey.

The LA Times article details that the training is carried out by both special operations troops and CIA personnel. That would put this program squarely within the US tradition of training and releasing death squads that seem to be as adept at killing innocent civilians as they are at killing military targets. We have seen details of their operation in Iraq and Afghanistan under David Petraeus’ vaunted COIN program. There is no information in the LA Times article regarding the death squads entering Syria at that time. Reading between the lines of the article suggests that the squads were in a holding pattern at that point, awaiting better weapons from the US.

In direct contradiction to Obama’s Monday statement to McCain and Graham on the timing of the entry of the first US-trained death squads into Syria, we have this report from the Jerusalem Post that quotes a story first reported in Le Figaro:

The first group of 300 handpicked Free Syrian Army soldiers crossed the border on August 17 into the Deraa region, and a second group was deployed on August 19, the paper reported.

The paper quoted a researcher at the French Institute for Strategic Analysis as saying the trained rebels group was passing through Ghouta, on their way to Damascus.

Okay, now this gets interesting. Obama claimed only the first group of 50 were entering, while Le Figaro claimed there were two groups, with the first one being 300 and the second one not specified by size. Further, note the dates and location: they entered on August 17 and 19 and they passed through Ghouta. The large number of deaths from a suspected chemical warfare agent occurred on August 21 in Ghouta. In fact, the second paragraph of the Jerusalem Post article notes:

Le Figaro reported that this is the reason behind the Assad regime’s alleged chemical weapons attack in Damascus on Wednesday morning, as UN inspectors were allowed into the country to investigate allegations of WMD use.

Were these first groups of CIA-trained death squad members the target of the attack? Or could it be even worse than that? Vladimir Putin had some very interesting things to say in a wide-ranging interview today, but this bit stands out in relation to the death squad story:

“If it is determined that these rebels used weapons of mass destruction, what will the United States do with the rebels?” Mr. Putin asked. “What will the sponsors of the rebels do? Stop the supply of arms? Will they start fighting against the rebels?”

Whether they were the targets of an attack by Assad’s forces or whether they were the agents carrying out a false flag attack, US-trained death squads could well be at the center of the disputed use of chemical weapons. That would seem to be both a strong incentive and a huge tell for Obama to change both the date and the size of the entry of the first of these agents trained by the US. After all, even while reporting Obama’s leak to McCain and Graham on Monday, the New York Times noted that the training program is covert.

Except that it’s not just the US training them. Going back to the Jerusalem Post article:

The rebels were trained for several months in a training camp on the Jordanian-Syrian border by CIA operatives, as well as Jordanian and Israeli commandos, the paper said.

Oh my. That’s quite the international faculty for this training program. What new wonders await us as more graduates of the program pour into Syria?

The Case for War: Since When is Médecins Sans Frontières a Secret Intelligence Source?

There are a couple of new developments in the case for war. Most notably, a Syrian — whose former position has been described variously as head of forensic evidence in Aleppo and some medical role in Bashar al-Assad’s CW group — defected, carrying documents proving that a March attack in Aleppo was CW. Of course, that’s the March attack, not the August 21 one. And it’s not yet clear that it answers the attribution question behind all reports of CW in Syria. (I’d also repeat that every defection — particularly one that happens at such a convenient time 6 months after the atrocity that might explain it — ought to raise questions about the loyalty of the insiders in positions of authority in Assad’s government.)

Meanwhile, Walter Pincus — who wrote some of the best pieces questioning the Iraq intelligence but has been rather credulous on the NSA of late — argues that the US won’t get away with hiding its case behind a sources and methods case.

The Obama administration has to declassify more detailed intelligence on Syria’s chemical weapons usage to bolster support in Congress for using U.S. armed forces to deter any future Syrian government use of those weapons.

More evidence is also needed to maintain the administration’s integrity at home and abroad.

President Obama’s critics question the legitimacy of the administration’s intelligence assessment of “high confidence” that the Syrian regime carried out the Aug. 21 attacks. Some point to the George W. Bush administration’s cherry-picked intelligence during its four-month campaign in late 2002 to promote the invasion of Iraq.

There is a key difference. U.S. intelligence in 2002 was used to show by inference that Saddam Hussein had weapons of mass destruction and might use them. Bashar al-Assad has chemical weapons, and U.S. intelligence apparently proves that his forces used them.

Today is a time of great mistrust of government at home and abroad, and that has to be recognized. The old claim about holding back evidence to protect U.S. intelligence’s “sources and methods” no longer works.

And McClatchy (which purchased Knight Ridder along with a bunch of journalists who had also debunked the Iraq intelligence before the war) has a piece pointing out public information that challenges some of this same information.

I’ve mentioned this previously, but I’m especially curious about the Administration’s potentially inflated claims about the number of dead. Here’s how McClatchy lays that out.

Another point of dispute is the death toll from the alleged attacks on Aug. 21. Neither Kerry’s remarks nor the unclassified version of the U.S. intelligence he referenced explained how the U.S. reached a tally of 1,429, including 426 children. The only attribution was “a preliminary government assessment.”

Anthony Cordesman, a former senior defense official who’s now with the Washington-based Center for Strategic and International Studies, took aim at the death toll discrepancies in an essay published Sunday.

He criticized Kerry as being “sandbagged into using an absurdly over-precise number” of 1,429, and noted that the number didn’t agree with either the British assessment of “at least 350 fatalities” or other Syrian opposition sources, namely the Syrian Observatory for Human Rights, which has confirmed 502 dead, including about 100 children and “tens” of rebel fighters, and has demanded that Kerry provide the names of the victims included in the U.S. tally.

“President Obama was then forced to round off the number at ‘well over 1,000 people’ – creating a mix of contradictions over the most basic facts,” Cordesman wrote. He added that the blunder was reminiscent of “the mistakes the U.S. made in preparing Secretary (Colin) Powell’s speech to the U.N. on Iraq in 2003.”

An unclassified version of a French intelligence report on Syria that was released Monday hardly cleared things up; France confirmed only 281 fatalities, though it more broadly agreed with the United States that the regime had used chemical weapons in the Aug. 21 attack.

Another eyebrow-raising administration claim was that U.S. intelligence had “collected streams of human, signals and geospatial intelligence” that showed the regime preparing for an attack three days before the event. The U.S. assessment says regime personnel were in an area known to be used to “mix chemical weapons, including sarin,” and that regime forces prepared for the Aug. 21 attack by putting on gas masks. [my emphasis]

I’m especially interested by the potentially inflated number given the way the White House case introduced it.

In addition to U.S. intelligence information, there are accounts from international and Syrian medical personnel; videos; witness accounts; thousands of social media reports from at least 12 different locations in the Damascus area; journalist accounts; and reports from highly credible nongovernmental organizations.

A preliminary U.S. government assessment determined that 1,429 people were killed in the chemical weapons attack, including at least 426 children, though this assessment will certainly evolve as we obtain more information.

I confess, when I first read this and followed its presentation on Twitter, I believed the casualty numbers were attributed to the “highly credible nongovernmental organizations” referenced in the previous sentence, not “a preliminary US government assessment.” Read more

Rush to Syrian War: What About US Relations With Iran and Russia?

Today’s New York Times opens its article on the effects a US attack on Syria would have on the efforts by the US to halt Iran’s development of nuclear technology by framing the question from the militaristic point of view that we must be “strong”:

As the Obama administration makes a case for punitive airstrikes on the Syrian government, its strongest card in the view of some supporters of a military response may be the need to send a message to another country: Iran. If the United States does not enforce its self-imposed “red line” on Syria’s use of chemical weapons, this thinking goes, Iran will smell weakness and press ahead more boldly in its quest for nuclear weapons.

And it is this need for the US to be tough (and for Obama to prove that he has a big d) that seems to be dominating virtually all of the media coverage of the push to get Congressional authorization for a strike. At least the Times does realize there is a very important flip side to that position, though, and that we may now be on the brink of more substantial talks with Iran than we have had in a long time. Here are the next few paragraphs:

But that message may be clashing with a simultaneous effort by American officials to explore dialogue with Iran’s moderate new president, Hassan Rouhani, in the latest expression of Washington’s long struggle to balance toughness with diplomacy in its relations with a longtime adversary.

Two recent diplomatic ventures have raised speculation about a possible back channel between Washington and Tehran. Last week, Jeffrey Feltman, a high State Department official in President Obama’s first term who is now a senior envoy at the United Nations, visited Iran to meet with the new foreign minister, Mohammad Javad Zarif, and discussed possible reactions to an American airstrike in Syria.

At the same time, the sultan of Oman, who has often served as an intermediary between the United States and Iran, was in Tehran meeting with Iran’s supreme leader, Ayatollah Ali Khamenei.

It is not lost on Iran that the AUMF for action in Syria is written broadly enough that US military action could spill over into Iran. A Fars News article dated yesterday cites the Jack Goldsmith analysis of the draft AUMF that foresees US action in Iran:

Goldsmith asked whether the proposed AUMF authorizes the President to use force against Iran or Lebanon’s Hezbollah, in Iran or Lebanon? Again, yes, if the President accuses Iran or Hezbollah of having a (mere) connection to the use of WMD in the Syrian civil war, and the use of force against Iran or Hezbollah would prevent or deter the use or proliferation of WMD within, or to and from, Syria, or protect the US or its allies (e.g. Israel) against the (mere) threat posed by those weapons. Again, it is very easy to imagine.

The Short-Comings of Pre-Crime Intelligence

The Sunday Express has a report that I consider one of the strongest pieces of evidence to date that Assad’s military was definitely behind the CW strike last week. (John Kerry is on TV citing forensic evidence, but he also said the evidence comes from someone besides the UN, which gives me pause, particularly given the way the Administration has clearly played with casualty numbers.)

According to intercepts collected at Troodos, UK’s listening post on Cyprus, the commander of the artillery unit that launched the attack balked at an order to release the CW at first, but then complied under threat of death.

Last night the senior RAF officer said: “The commander of the artillery battery told the regional commander that he would not comply and there was a heated exchange. He was told in direct language that unless the order was carried out, he would be shot. A total of 27 chemical artillery shells were then fired at the suburb in a 14-minute period.”

The conversation was monitored and recorded by British officers based at the remote mountain-top RAF Troodos Signals Intelligence listening post in Cyprus and within minutes details of the conversation had been relayed to GCHQ, Whitehall and the Pentagon.

But I’m interested in the timing of this leak.

Details of this intelligence don’t show up explicitly in the British case for war, though there are claims in it that might reflect it.

There is some intelligence to suggest regime culpability in this attack.

There is no obvious political or military trigger for regime use of CW on an apparently larger scale now, particularly given the current presence in Syria of the UN investigation team. Permission to authorise CW has probably been delegated by President Asad to senior regime commanders, such as [*], but any deliberate change in the scale and nature of use would require his authorisation.

However, the uncertainty as to whom Assad had delegated CW launch authority seems wholly incompatible with Whitehall having this intelligence. If they had this intercept, they would seemingly know fairly precisely the chain-of-command in question.

Nor does the intercept appear explicitly in the US case. Though again, there are claims that might reflect the intelligence.

We have intelligence that leads us to assess that Syrian chemical weapons personnel – including personnel assessed to be associated with the SSRC – were preparing chemical munitions prior to the attack. In the three days prior to the attack, we collected streams of human, signals and geospatial intelligence that reveal regime activities that we assess were associated with preparations for a chemical weapons attack.

Syrian chemical weapons personnel were operating in the Damascus suburb of ‘Adra from Sunday, August 18 until early in the morning on Wednesday, August 21 near an area that the regime uses to mix chemical weapons, including sarin. Read more

The AUMF Crescent

The President is authorized to use the Armed Forces of the United States as he determines to be necessary and appropriate in connection with the use of chemical weapons and other weapons of mass destruction in the conflict in Syria in order to –

  1. prevent or deter the use or proliferation (including the transfer to terrorist groups or other state or non-state actors), within, to or from Syria, of any weapon of mass destruction, including chemical or biological weapons or components of or materials used in such weapons; or
  2. protect the United States or its allies and partners against the threats posed by such weapons.

Moon of Alabama focuses on how the use of “as he determines to be necessary and appropriate” turns the AUMF into a very broad authorization.

It is clear from this wording that such a resolution would allow nearly everything far beyond the “punitive” few cruise missile strikes against Syrian forces the administration marketed so far. It could easily be used for an outright blockade of Iran or even a “preemptive” strike against Iran’s industries in the name of “deterrence” and “protecting” Israel.

Goldsmith focuses even more closely on the several other places where this AUMF could be used.

(1) Does the proposed AUMF authorize the President to take sides in the Syrian Civil War, or to attack Syrian rebels associated with al Qaeda, or to remove Assad from power?  Yes, as long as the President determines that any of these entities has a (mere) connection to the use of WMD in the Syrian civil war, and that the use of force against one of them would prevent or deter the use or proliferation of WMD within, or to and from, Syria, or protect the U.S. or its allies (e.g. Israel) against the (mere) threat posed by those weapons.  It is very easy to imagine the President making such determinations with regard to Assad or one or more of the rebel groups.

(2) Does the proposed AUMF authorize the President to use force against Iran or Hezbollah, in Iran or Lebanon?  Again, yes, as long as the President determines that Iran or Hezbollah has a (mere) a connection to the use of WMD in the Syrian civil war, and the use of force against Iran or Hezbollah would prevent or deter the use or proliferation of WMD within, or to and from, Syria, or protect the U.S. or its allies (e.g. Israel) against the (mere) threat posed by those weapons.  Again, very easy to imagine.

Given my continuing obsession with the still extant Iraq War AUMF, let’s consider the geography of this proposed AUMF together with the other active AUMFs, the Iraq and Afghanistan ones.

Put all three of them together, and the government would have authorization to use military force in Syria, Lebanon, Shia-governed and increasingly violent Iraq, Iran, Afghanistan, and parts of Pakistan (plus Yemen, with its Houthi insurgency on Saudi Arabia’s southern border). The President would have authorization to use military force in an unbroken band of land from Israel’s border east to nuclear-armed Pakistan, with both the counter-Saudi Shia block and Sunni al Qaeda related terrorists included within the AUMFs. This, to fight a war that Israel and the Gulf states have allied (if you can call it that) to fight.

President Obama claims he only wants to engage in limited strikes. He has promised there would be no boots (aside from JSOC and CIA ones, presumably) on the ground.

But he has proposed something that could be potentially far broader.

The Case to Congress

As you’ve no doubt heard, President Obama gave a statement today in which he said he had decided to strike Syria. But then said he plans to have Congress approve the strike.

Here’s how the Administration plans to sell this to Congress:

And they detailed the coming campaign to get Congress on board:

  • Hammer home the potential threat to staunch ally Israel’s security
  • Provide detailed intelligence about the alleged attack
  • Underline that the United States ratified the Chemical Weapons Convention, and make a case that American legitimacy — not just his own — is at stake.
  • Make the argument that failure to act could lead, one day, to terrorists acquiring chemical weapons from regimes like Assad’s — and turning them on America.

Item One: Assad’s alleged decision to use Chemical Weapons that he originally obtained to deter Israel against rebels presents “a potential threat to staunch ally Israel’s security.”

In recent months, Israel has successfully struck at Syria twice, and Syria didn’t even try to retaliate. Why does the US have to take a stand for the norm against using CW, when the Israelis are perfectly capable of doing so. I get that Israel can never be viewed as a neutral party with Syria, they do have unrivaled ability to stand against the use of gas against civilians.

Item Three: The US ratified the Chemical Weapons Treaty. But Syria did not. In the same way that Israel didn’t sign the nuclear Non-Proliferation Treaty. Why do we expect Syria to abide by the former when we don’t require Israel to abide by the latter?

Item Four: A strike on Assad is likely to strengthen the Syrian rebels. Who are made up, increasingly, of a bunch of extremists with ties to al Qaeda. If we make it easier for the rebels to replace Assad, doesn’t that actually raise the likelihood terrorists will get Assad’s CW?

I’m glad the Administration has decided to go to Congress. But their argument is just as weak as it was.

Operation Ballsack Labor Day Football Trash Talk

I am not sure how well the Trash Talk Machine is greased after such egregious neglect. But, we can only do what we do, and carry on. And those skilz have NOT been forgotten jack. So saddle up cowboys and cowgirls.

You would think being a blogger is an easy, Cheetos filled, lifestyle. Not the case. It is hard work, hard work I tell ya. I have suffered the indignation of Marcy and Jim yammering about wanting “trash this” and “trash that”. Weeeeelllllll that is so much SPAM! So, as I said earlier, it’s not easy, you know. I get no respect!

To make a quick comment on the title of this 2013 football season opening trash, shit is truly fucked up and bullshit. We have Mr. Constitutional Nobel Scholar President agitating to make unilateral bizarrely unnecessary war on Syria….apparently because he screwed up and drew a moronic “red line” in the sand and now has to prove he actually has bolas, in addition to stupidity and hubris. The man who when seeking votes to be elected in 2007-2008 claimed war without Congressional assent was wrong, and whose Vice-Predident called such unsanctioned war bullshittery and an “impeachable offense”, now insists without the UN, without the Brits, and with a coalition of effectively one (one who were previously described as “cheese eating surrender monkeys” not that long ago in American lore). But that is where we are now. Which is why the best name for this clusterfuck is “Operation Ballsack“. Yes, it is all about Obama’s balls, and his desperate need to prove he actually has a primordial pair.

Yikes, better get to that then. Last night was a pretty exciting open to the NCAA 2013 schedule. The ‘Ole Ball Coach Spurrier and the ‘Cocks did not seem all that animated, but still clocked a fairly solid NC Tarheel team. Looked like Vady was gonna take a bite off the ‘Ole Miss Rebels, but Ole Miss tailback Jeff Scott let loose with a 75 yard TD romp with 1:07 left, giving the Rebels a 39-35 last minute win. Good stuff. In other news, Lane Kiffen proves the question of why he has not been fired yet is still very salient by coaching a narrow win for Tommy Trojan over the Rainbows. Mighty Troy barely made it over the Rainbows. Yay. If that is all USC has, even the Sun Devils are going to wax them this year (a game I will be attending by the way). also, from Friday night, let me just say that Sparty has some VERY sticky fingered defenders. Look out B1G.

Well, what else is up I wonder? Hmmmm, appears some fella named “Manziel” was suspended half a game for something. Guess it wasn’t anything bad, cause Dez Bryant got suspended a whole season for eating dinner with Neon Deion Sanders. I sign my name on things a lot too. I get paid to do so. Not sure who would sign thousands of items for zip, nuthin, free. Apparently the crack investigators and accountability specialists at the NCAA found no problem though. And you KNOW how sane they are, cause they banned Penn State from all bowls for four years without having any NCAA violation whatsoever present. Ugh.

Alright. Games. Real ones are being played this weekend. Battle manufactured where it should be. Naturally. By a nerd at ESPN instead of that fake Operation Obama Ballsack baloney.

The game of the weekend looks to be Georgia at Clemson. These are two top ten worthy teams, if not potential national championship contenders. Special players abound everywhere on both teams, including Sammy Watkins the super receiver for the Tigers, and Tajh Boyd his quarterback. For the Bulldogs, Aaron Murray may be the best QB in the conference, and that includes Johnny Football. Awesome game to have so early. Alabama hosting Virginia Tech is another unusual one to start off with. The Tide will roll them, but there could be a struggle. should be a way better game than the Tide expected.

The one other thing I want to address is the noggins of the NFL. As you may have heard, there was a settlement this week, and it heavily favored the NFL. The craven plantation owners admitted nothing, gave up no liability findings, and gave up a ridiculously cheap total sum as hard settlement. By the time lawyer’s fees and mandatory testing etc. is deducted, it is criminal how little was gotten for a class of at risk humans. Down the road, if these class members live, they and their representatives will be screaming bloody murder. This long Labor Day weekend’s music is from the one, the only, Ms. Linda Ronstadt. I have a real affinity for Linda, and haver seen her numerous times including a couple of very special ones. The singing voice may be silenced, but Linda is rocking on and fighting for the causes she believes in. And they are, and always have been, great, and the right, ones. Oh, also, in case you didn’t notice, she had a backup band on the first video. Chuck Berry, Keith Richards, Robert Cray and some other chaps. The second is the band she normally toured with (including Waddy Wachtel – but with Mike Botts on drums instead of Russ Kunkel, who I always saw) and, trust me, they were absolutely killer, and very cool people to boot.

Whatever Happened to the Atrocities Prevention Board?

I should be analyzing the Administration’s case for war to punish Bashar al-Assad because someone in his regime allegedly used chemical weapons against civilians. I will do so soon.

But I keep thinking back to the President’s Atrocities Prevention Board.

Back in August 2011, Obama rolled out an effort to figure out how to prevent attacks like the one that occurred on August 21. It was a then-NSC Senior Director for Multilateral Affairs and Human Rights and now UN Ambassador Samantha Power baby, closely in line with the Responsibility to Protect standards an attack on Assad would ultimately serve.

And while it suffered from some potentially fatal problems (notably, a remarkable selectivity about which atrocities actually counted as such and which should, for expediency, be ignored), it was a thoroughly laudable effort, an attempt to find new tools to prevent the mass killing of civilians.

Here are some things a May update reported have been going on in Syria.

On Syria, the State Department and USAID have deployed experts to support targeted projects that lay the foundation for accountability and a democratic transition that protects the rights of all Syrian people, such as building a cross-sectarian network of civilian activists by training local leaders and activists, including women and minorities.

In Syria, the United States has strongly promoted accountability efforts, supporting organizations that are collecting and reviewing evidence to establish criminal responsibility and that are leading efforts to help the organized opposition begin the process of developing Syrian-led accountability mechanisms.

I raise the APB not to declare its failure, but to point to parts of the framework that seem absent from the discussion of how to respond to the Syrian CW attack.

For example, the APB emphasizes multilateral work, with the UN a key player.

Our diplomats will encourage more robust multilateral efforts to prevent and respond to atrocities.  An effective atrocity prevention and response strategy – in which burdens are appropriately shared by other nations  – will require cultivating deeper and broader support among our bilateral partners, as well as international and regional organizations:

  • UN System Capacity: The United States will work with the United Nations to strengthen UN capacity for conflict prevention and crisis management, including through preventive diplomacy and mediation, especially when UN missions encounter escalating atrocity threats.
  • Regional Capacity:   The United States will also work with our partners to build the capacity of regionally-based organizations to prevent and respond to atrocities.

Now UN Ambassador Power is not so optimistic about UN’s use here.

Recall: In July Russia blocked nonbinding #UNSC resolution condemning any CW use; last week even blocked press statement against CW attack.

Syrian regime must be held accountable, which #UNSC has refused to do for 2+ years. US considering appropriate response.

In 2011, Power’s Board believed one potential response to a crisis was a civilian surge.

Civilian Surge: State and USAID will increase the ability of the United States Government to “surge” specialized expertise in civilian protection on a rapid response basis in crisis situations.

Whereas here we’re going to surge cruise missiles, nothing more.
