GAO Analysis Highlights Lab Samples Excluded in Sloppy FBI Anthrax Investigation

As the last Friday before Christmas, late yesterday afternoon was the most obvious Friday news dump hour of the year, and the government didn’t disappoint. The Government Accountability Office released the results of a twenty-three month long study of the genetic analysis that was used to tie the material found in the anthrax attacks of 2001 to the laboratory of Bruce Ivins, whom the FBI concluded (pdf) was solely responsible for the attacks. The FBI’s conclusion is highly suspect for many reasons. On the science side, it is very unlikely that Ivins could have produced all of the attack material on his own and the detailed chemistry of the attack spores suggests that highly sophisticated materials and techniques unavailable to Ivins likely were used to prepare the attack material. Regarding that second point, note that even William Broad refers indirectly to the chemistry concerns in his New York Times article on the GAO report:

To the regret of independent scientists, the report made no mention of an issue beyond genetics: whether the spores displayed signs of advanced manufacturing. They have pointed to distinctive chemicals found in the dried anthrax spores that they say contradict F.B.I. claims that the germs were unsophisticated.

Evidence of special coatings, they say, suggests that Dr. Ivins had help in obtaining his germ weapons or was innocent.

The GAO study was undertaken, in part, because of questions raised by the National Academies study released in 2011 and with special prompting by Representative Rush Holt, from whose district the letters likely were mailed. The GAO study focused on obtaining a better understanding of the validity of the genetic analysis that was carried out and the statistics underlying the conclusions reached.

For a refresher, a helpful illustration from the GAO report shows the underlying biology of the genetic analysis that was carried out in the Amerithrax investigation. Here we see photos of a typical colony of the Ames strain of Bacilus anthracis on an agar plate and four variant colony types that occurred at low frequency when the attack material was spread out on agar so that colonies arose from single cells of the overall population of bacteria that were present in the attack material:

DNA sequence analysis was employed to identify the changes that led to these variant colony shapes. The FBI then commissioned private laboratories to develop DNA-based tests (relying on polymerase chain reaction, or PCR, methodology) that could be used to screen the large bank of isolates of the Ames strain that the FBI had accumulated through a subpoena submitted to all 20 laboratories known to have isolates of the Ames strain. Developing these assays represented a new frontier in forensic genetics and it did not prove possible to develop tests for all of the mutations identified in the original DNA sequencing. In the end, four tests were developed by the four different contractors.

The Amerithrax report stated that of the 947 samples included in the final analysis, only eight showed all four of the DNA changes the tests were designed to detect. Seven of those samples came from the laboratory where Ivins worked (U.S. Army Medical Research Institute of Infectious Diseases, or USAMRIID) and one came from Batelle Memorial Institute in Columbus, Ohio. The FBI noted that there was a record of material being transferred from USAMRIID to Battelle, accounting for the sample found there.

What Drove Timing of NYTimes Publishing Risen-Apuzzo Disclosure of McHale Jundallah Contacts?

Saturday night, the New York Times published a blockbuster article by James Risen and Matt Apuzzo that was then carried on the front page of Sunday’s print edition. The article described the jaw-dropping revelation that somehow, a lowly Port Authority detective wound up as the primary contact for Jundallah, a Sunni extremist group on the Iran-Pakistan border that attacks Iran (and sometimes Pakistan) with an aim to unify the region that is home to the Baloch people. Further, it appears that through Thomas McHale’s contacts (and McHale’s membership in a Joint Terrorism Task Force), information on Jundallah attacks filtered into the CIA and FBI prior to their being carried out in Iran.

Iran has long accused the US and Israel of having associations with Jundallah, even going so far as to state that the CIA and/or Mossad equip them and help them to plan their attacks. With negotiations between the P5+1 group of countries and Iran now in the home stretch toward a November 24 deadline, Saturday’s disclosure could hardly have come at a worse time. In fact, John Kerry was in Oman, meeting with Iranian Foreign Minister Mohammad Zarif and Catherine Ashton from the EU over the weekend. Despite this disclosure coming out, Sunday’s negotiating session turned into two sessions and a further session was even added on Monday. Upbeat news is still flowing from that meeting, so on first blush the disclosure Saturday didn’t completely disrupt the talks.

My first thought on seeing the article was that it fit perfectly with the previous front page effort by the Times at disrupting the talks. David Sanger “mistakenly” claimed that a new wrinkle in the negotiations would allow Russia to take over enrichment for Iran. This would almost certainly give hardliners the room they need to kill the deal, since maintaining enrichment capacity is a redline issue for Iran.

The reality is that what is under discussion is that Iran would continue its enrichment activities, but ship low enriched uranium to Russia where it would be converted into fuel rods. Evidence that this pathway is making progress can be seen in this morning’s announcement that Iran and Russia have signed an agreement for Russia to build two more nuclear power plants in Iran. It seems that a new wrinkle on the arrangement might allow Russia to prepare the fuel rods inside Iran:

Russia, which is involved in those talks, will also cooperate with Teheran on developing more nuclear power units in Iran, and consider producing nuclear fuel components there, according to a memorandum signed by the heads of the state atomic bodies, Sergey Kirienko of Russia’s Rosatom and Ali Akbar Salehi of Iran’s Atomic Energy Organization (AEOI).

Just as hinting falsely that Iran was negotiating away its enrichment technology was a move by the Times that could have disastrous effects on the ongoing negotiations, I felt that providing this strange story on McHale would give ammunition to those in Iran who see the CIA behind Jundallah. However,there is another possibility. In a Twitter discussion with Arif Rafiq on the disclosure, Rafiq suggested that “the US is coming clean about something that has concerned Iranians for years. Could be a plus”. He later allowed that hardliners could see it as a smoking gun. A further interesting speculation from Laura Rozen on Twitter suggested that perhaps the US played both sides of Jundallah:

So let’s consider these nicer possibilities for a moment. Maybe we did give Rigi to the Iranians. Maybe we are admitting Jundallah contacts now as a way of making sure it ends. But if that is the case, Risen and Apuzzo are a very strange source for how this news came out. An admission of this sort is what I would expect to be routed through David Ignatius, Eli Lake or Josh Rogin. Risen would be especially difficult to see as cooperating with specific timing on a disclosure. Recall that the Times spiked his disclosure of Bush’s illegal wiretaps until after the 2004 elections and then only published when the book was about to drop. To believe that Risen is now somehow cooperating with the government is a huge stretch, but he does still appear to be at risk of being subpoenaed in the ongoing DOJ actions in response to the wiretapping disclosure.

Many issues surrounding US support for Jundallah (and MEK) are still quite unresolved in my view. Recall that we had the whole “false flag” controversy back in January of 2012, where it was “disclosed” that Mossad ran Jundallah while posing as CIA. Not too long after that, Sy Hersh disclosed that the US has trained operatives for the MEK (no mention of Jundallah at all in the article) for covert actions against Iran. What particularly raised my hackles in that report was that the training was held at the same site in Nevada where I suspect that the materials used in the 2001 anthrax attacks was produced.

Over at Moon of Alabama, b seems to feel that the US was indeed behind the running of Jundallah. For that to be the case, we are pretty much forced to believe that Risen and Apuzzo have been either duped or coerced. I find so much of what has come out to be conflicting that I doubt we’ll ever completely sort this out. I have no doubts that JSOC and CIA stand ready to see Iran’s enemies prosper, especially as we saw in the MEK training in Nevada. When it comes to involvement in actual operations, I just don’t know. But the possibility that we helped at some times and then handed over Rigi possibly to make up for it sounds so like what our rudderless intelligence services would do that I’m leaning that direction.

Joby Warrick Is the New Judy Miller

Poor Joby Warrick. With Judy Miller so disgraced that Fox News had to issue a “she has nothing to apologize for” press release when they hired her back in 2008, Joby drew the short straw yesterday and was assigned to transcribe the hyped bullshit concerns arising from Israel Syria’s neighbors that Syria might be contemplating use of biological weapons. The entire Warrick article needs to be read to get a full feel for its credulous recitations of completely unfounded speculation being passed off as actual intelligence, but I will stick with just a few paragraphs. Warrick opens by making a completely baseless claim:

Last month’s alleged chemical attack near Damascus has re­focused attention on Syria’s 30-year-old biological weapons research and raised concerns about whether the government there could activate an effort to make a weapon.

Really, Joby? Aside from those “intelligence officials in two Middle East countries” who fed you this material, has anybody else voiced a concern that Syria is contemplating use of bioweapons, or even could produce bioweapons if they wanted to?

Even Warrick has to admit that any work on bioweapons in Syria is now over 30 years old. But that doesn’t deter Warrick and the spooks whispering in his ear:

Syria’s bioweapons program, which U.S. officials believe has been largely dormant since the 1980s, is likely to possess the key ingredients for a weapon, including a collection of lethal bacteria and viruses as well as the modern equipment needed to covert them into deadly powders and aerosols, according to U.S. and Middle Eastern officials and weapons experts.

Wow. the “US and Middle Eastern officials and weapons experts” guiding Warrick’s hands on the keyboard as he types are saying that despite not working on bioweapons for thirty years or so, they have the deadly organisms and equipment that would be needed to make “deadly powders and aerosols”.

Warrick and the spies who feed him have absolutely nothing on which to base this accusation. Let’s check a neutral source on what the real status of biotechnology capability in Syria is and whether it can be rapidly adapted to bioweapons. The Nuclear Threat Initiative provides a report on Syria’s potential bioweapons capability that was last updated in February of this year. They come to very different conclusions than Warrick (emphasis added):

In the past, unclassified statements by U.S. officials occasionally claimed reason to suspect Syria of maintaining an offensive BW program. [2] However, in contrast to discussions of Syrian chemical warfare (CW) capabilities, such claims have not included any details on the size and scale of Syria’s potential BW program, and are not presented alongside supporting evidence. Instead, discussions on this topic have focused on speculative extrapolations of Syrian dual-capable industry and on Syrian political motivations. Such analysis can be neither detailed nor comprehensive. Although the existence of a biotechnology industrial base would suggest that Syria has some indigenous expertise useful for developing a biological weapons capability, it does not imply and cannot confirm the existence of an offensive biological weapons program. Furthermore, given that Israel, a state that is understood to possess a nuclear arsenal and continues to occupy the Golan Heights, remains Syria’s primary security concern, and given the risk of “blowback” when deploying biological weapons, such weapons would be of questionable tactical desirability from a Syrian perspective. While public sources on the nature of Syria’s chemical and nuclear programs are limited, even less exists about Syria’s biological program, and “there is no hint of its existence from open sources.” [3]

Details of Silicon-Tin Chemistry of Anthrax Attack Spores Published; Willman Tut-tuts

On Saturday, the Journal of Bioterrorism & Biodefense published an article (pdf) by Hugh-Jones, Rosenberg and Jacobsen that provides the details of their theory, first described in a McClatchy article, that the anthrax spores employed in the 2001 anthrax attacks were “weaponized” by a process that involved tin-catalyzed polymerization of silicon monomers.  Wasting no time, David Willman was quickly trotted out in the Los Angeles Times on Sunday to tut-tut this latest information as arising from “critics” of the FBI and to provide an outlet for those who unquestioningly parrot the FBI’s conclusion from its Amerithrax investigation that Bruce Ivins acted alone in carrying out the attacks.

Shortly after the McClatchy article was published, I provided this perspective on the new revelations it contained:

The presence of silicon and how it may have gotten into the anthrax material has been a point of great controversy throughout the entire investigation. This question is important because the chemical nature of the silicon and the level at which it is present is presumed to be an indicator of whether the anthrax spores have been “weaponized” to make them suspend more readily in air so that they are more effective in getting into the small passageways of the lungs of the intended targets of the attack. Early in the investigation, Brian Ross published “leaked” information that the spores had been weaponized through addition of bentonite and that Iraq had a weaponization program that used bentonite. This report turned out to be false, as no evidence for bentonite has been found. A more sophisticated type of weaponizing would rely on mixing the spores with nanoparticles of silica (silica is the common name for the compound silicon dioxide) to make them disperse more easily.

The FBI carried out a special form electron microscopy that could identify the location of the silicon in the spores from the attack material. They found that the silicon was in a structure called the the spore coat, which is inside the most outer covering of the spore called the exosporium. If silica nanoparticles had been used to disperse the spores, these would have been found on the outside of the exosporuim (see this diary for a discussion of this point and quotes from the scientific literature) because they are too large to penetrate it.  No silicon signature was seen on the outside edge of the exosporium.  What is significant about the type of silicon treatment suggested in the McClatchy piece is that both high silicon and high tin measurements were found in several samples and that there is an alternative silicon treatment that would involve a tin-catalyzed polymerization of silicon-containing precursor molecules. McClatchy interviewed scientists who work with this process and they confirmed that the ratio of silicon to tin found by the FBI is in the range one would expect if such a polymerization process had been used.

What McClatchy doesn’t mention in their report is that it would seem for a polymerization process of this sort, the silicon-containing precursor molecules would be small enough to penetrate the exosporium before being polymerized, or linked together into much larger molecules, once they reached the spore coat. This would mimic the location of silicon incorporated “naturally” into spores.

As the photo above shows, the anthrax spores in the attack material had silicon that was found exclusively in the spore coat and not in the exosporium.   Read more
