    The ability to respond to posts was useful, any chance you’ll be able to add that? Also, we like to print and read offline. Any chance we’ll be able to do that? Cut and paste to a Word document works, but it’s a pain.

    First time I’ve seen this in print. Usually the discussion is focused on cell phone location tracking, or last week, root kits. The capability to remotely turn a phone into a bug has been part of US “national technical means” since at least the 1950’s. Ironically, the higher the technology, the easier it is to do.

    Moving Bradley Manning to Leavenworth seems to have effectively “disappeared” him.

    Judge Cebull’s mere act of forwarding the racist (And, by the way, misogenous-the President’s mother and a dog?!) email is solid cause to demand and get his resignation. At a minimum he should not be allowed to hear any cases involving people of color or women. (His comments are not a defense and further by them he violates the Hatch Act.) He is a disgrace

    A dear friend is currenlty experiencing DOJ/DEA misconduct. I am so disappointed in our government. I have never seen anything like this. If you would like to see prosecutorial misconduct in progress and review this case… I think we would all learn a lot about prosecutorial misconduct and the importance of a “Win” in court for DOJ. This man is truely innocent, I worked with him daily, my name was on every email sent from the company… can you believe that I was never questioned? There are so many things frightening about this out of control department. Please help

I find new info revealed during the proceedings on what was happening–and said–at Bales’ base that night very revealing (not to mention petrifying) about the environment and attitude for our military in Afghanistan.

    Has anyone tracked down whether or not there were prisoners held at the Benghazi US Consulate compound or not? There’s only the youtube video of Broadwell making statements that there were (CIA held prisoners in Benghazi US Consulate) and some claims by CIA that “she didn’t get that right at all”. All rumor—unverifiable or verifiable?

    I’m going to go through your archives now over the next few hours and see if I can find any discussion of this. Am thinking that if that was true than the whole resignation thing/Congressional harping is not what we we’re being told in US media at all…

    Regarding Zero Dark Thirty, the actress said on the Daily Show that Maya is not a composite character but based on one woman. It seems very likely that “Jen” is Alfreda Frances Bikowsky.

    Both Maya and Frances have red hair and both were close friends with Jennifer Matthews who was killed in the triple cross bombing.

    Case is titled: Noonan, Judd, MacLeran, Taitz v Bowen

    – provided a mountain of evidence of Barack Obama using a last name that is not legally his, a forged Selective Service application, forged long form and short form birth certificates and a Connecticut Social Security number 042-68-4425 which was never assigned to him according to E-Verify and SSNVS.

    On April 15, 2010 Obama posted his 2009 tax returns on line. He forgot to fllatten
    the PDF file and his full unredacted Social Security number xxx-xx-4425 became
    known to the public. This number immediately raised suspicions of Attorney Orly
    Taitz, as it started with 042, a digit combination which was assigned to the
    state of CT and Obama was never a resident of CT. E-verify and SSNVS showed
    that this number used by Barack Obama was never assigned to him. We have an
    individual sitting in the WH as the US president and Commander-in-Chief, in
    control of our nuclear arsenal, while using a stolen/fraudulently obtained

    Mother of teen jailed for Facebook post speaks to WSWS

    Justin Carter’s purportedly “terrorist” post was made in the context of an argument on Facebook related to an online game. Justin was accused of being “crazy.” His response, which his mother contends was just her son’s sarcastic sense of humor, was, “I’m f—ed in the head alright. I think I’ma shoot up a kindergarten and watch the blood of the innocent rain down and eat the beating heart of one of them.” Then Justin wrote, “j/k” (which means “just kidding”).

    The next day, they went in front of the judge to set the bond, and the bond was set at $250,000. It was later increased to $500,000. That’s when I realized it was serious. And it was devastating. I never thought that my son would go to jail, and I certainly never thought he would go to jail for being a terrorist.

    TC: In your son’s case, I understand the prosecutor is offering a sentence of eight years in return for a guilty plea, but is threatening to seek more if the case goes to trial. What is it like to have to make that choice?

    JC: It’s hard to put into words the kind of emotions you have with this kind of thing. Every time we get bad news about the D.A. [District Attorney], and hear what they are trying to push for, whether it is 8 years or 10 years—all I can think of is my son when he was a little boy, and what a good person he is.

    The idea that he would be locked away for 8 years or 10 years—he is not a criminal. He’s not cut out for jail. My first thought when I found out was that someone would kill him in jail.

    It’s hard. He’s almost broken when I talk to him on the phone. He’s lost all hope. He doesn’t think he’s ever going to get out. He told me that if he gets out, “I’ll never take sunshine or grass for granted. I’ll never play video games again. If only I can be free again.”

    The boy’s been in prison since 14 February.

    Truly it’s the cops, the prosecutors, and the judges who should be in jail!

    Buried on page 33 is this : Dzhokhar Tsarnaev indicted on 45 counts in Boston Marathon bombing.

    Apparently it was Dzhokhar who ‘radicalized’ himself using the internet. No mention of CIA honcho Graham Fuller’s deep involvement with ‘radicalizing’ Chechen rebels, including Dzhokhar’s uncle Ruslan, who married Fuller’s daughter and operated the Congress of Chechen International Organization out of Fuller’s house when he was Fuller’s son in law.

    I have seen nothing other than the wsws.org report of the indictment.

    Are they going to get away with this? Fuller was the guy behind Iran-Contra. He wa on the ground floor with Osama bin Laden in Afghanistan … the “Godfather of Al Qaeda”. He ‘retired’ from the CIA after Iran-Contra … the only way you retire from the CIA is feet-first … and then ran the Chechen Mujahideen.

    How can all of that be swept under the rug? The CIA is up to its neck in the Boston Bombing but the corrupt DOJ is going to try to ignore it.

    Are they going to get away with that? MT Wheel?

    It seems they’re looking to build a force of trained monkeys/cyborgs/robots to run their cutely codenamed programs for them because they can’t afford real techies from Silicon Valley who are too expensive.     This is what happens when a member of the military comes forward and reports a sexual assault.
    I have contacted federal agencies and been informed NCIS has jurisdiction over this case, what does any citizen to do when a federal agency does not investigate the allegations. The strong arm tactics of the agent in charge to drop this case, no been able to file a complaint against any of the agents through the NCIS IA department, the agent in charge telling me I am not allowed to talk to a Federal Prosecutor. The U.S Navy investigating their own and not showing any attempt to investigate this case is where I find myself.

    I contacted agent Ryan Heflan (732) 866-2235 gave him the detail of my case in Nov/Dec of 2011, I have spoke via phone about six or seven times with him throughout the year 2012. Beginning of 2013 Agent Dart Kelly (732) 866-2166 took over, he needed everything in writing regarding the case in question, which I did about Jan 2013. I got in contact with Agent Kerry Nelson (571) 305-9787 (Internal Affairs) Oct /Nov of 2012 to file a complaint against Agent Heflan and after Agent Kelly took over I attempted to file a complaint against him to, with no success. Agent Nelson did not allowed me to file a complaint against the agents in question; I spoke to Agent Nelson about ten times 2012 through 2013 every time she informed me I needed to talk to the Agent in charge.

    To resolve this:

    The Justice Dept or the FBI need to get involve.

    I read your erudite letter to the New York Times this morning. I agree with the substance of your letter, namely, that all there is regarding the so-called Russian interference is innuendo from somewhere in the intelligence community. I would add that we are in the 21st century and that statecraft and warfare have never been so dominated by information and information technology. It was surprising to me that no one had criticized the Clintons are the DNC for their inept handling of confidential information. To me this makes them unfit to govern. The fact that the Russians (and other adversaries and even friendlies) are constantly hacking is not news and should not be news. Nor is the insinuation even backed up, namely, why would Putin help Trump, and how did Putin help Trump. It seems fairly evident from a distance that 1) the DNC ran a weak candidate, 2) that huge amounts of money were dedicated to destroying Mr. Trump’s image, 3) Mr. Comley’s allegations 3 weeks ahead of the vote were the most damaging, and 4) there was fire where there was smoke, e.g. the Clintons are suspect on many levels. More over, Obama gave the Russians everything the asked for during his tenure–he did a ‘reset’. In the end, the whole smoke screen is weird, and it is amazing that the American people pay attention to it our that the mainstream media presents conspiracy theories as facts.

    I apologize for my recent comments which led some to believe I was advocating violence. I do recommend threats of violence against those who threaten me. It is a much better deterrence against violence than waiting until you have been injured. My life experience is that no one is going to prevent violence against you except you. My high school graduation gift from my parents was reconstructive surgery so I could breathe through my nose again.
    In college, I had so many death threats because of my actions against corruption that potential girlfriends said they were afraid to be seen with me. And they were right! They went after my friends, and only when I had a credible counter threat did they back off. The deal was to mutually back off. Except that I have to get periodic updates on the love life of the daughter who hates her father. 40 year later.
    I apologize that my recent comments seemed to incite violence. What I was hoping to achieve was a willingness to stand up to those who would injure you or kill you. That is what we are facing.
    I have lived alone in foreign lands. It is me or nobody. All your privileged commenters need to understand that the next few months are going to be more like my life than theirs.

I was so motivated by shock and anger at the attempted coup that I made a 17-minute video and posted it on my YouTube channel yesterday.     I claim to be a Frankfurt School Critical Theorist. At least I would like to think this is a fair description, but the original scholars are long gone to their reward and I wonder what would they would think?
    What has this to do with Critical Race Theory? – well everything.
    I have finally put ‘pen to paper’ (FMD), because of my frustration with listening and watching pundits talk about Critical Race Theory (CRT) and butcher their explanations of what CRT is and why it presents no danger to anyone, especially school students.
    When you write a higher research degree, it is necessary to provide a philosophical framework which forms the base or structure for your specific research. Philosophy asks two fundamental questions: what is it that we can know? we call this ontology and how is it that we can know it? we call this epistemology. Research is generally seeking answers to questions that are ontological (what is it that we can know?) and to justify the research it is necessary to answer the epistemological question, how is it that we can know this?
    There are many acceptable epistemological frameworks or methods that have been academically justified over the years, a “positive” frame such as; science or pure mathematics… but “post-positive” frames are also available, and one is Frankfurt School Critical Theory. I have written extensively about this, see the link above, and the net has much useful information to offer.
    Max Horkheimer, who was an early leader of the Frankfurt School, wrote an essay in 1937 in which he described Critical Theory as an approach which combined rather than separated the poles of philosophy and the social sciences.
    He claimed that to be a Critical Theory it must seek emancipation for the oppressed (is this the post Marxist concept that has sent the American Right into fits of apoplexy?).
    Specifically, any theory can be considered a Critical Theory if it meets Horkheimer’s three criteria:
    “It must explain what is wrong with current social reality
    It must identify the actors to change this
    It must provide both clear norms for criticism and achievable practical goals for social transformation” – theory and practice (praxis).
    What can possibly be wrong with these goals? Any theory that meets these three criteria can be considered a Critical Theory. It provided a framework for me to build my ideas on modern management theory and practice (praxis) for my PhD, an area of management theory called Critical Management Studies (CMS). My PhD “Re-framing Strategic Thinking, Emergence Beyond the Box” is sub-titled “A Critical Management Study”. It utilizes Critical Theory and Complexity. Any theory of race that utilizes the epistemology of Critical Theory can be called a Critical Race Theory (CRT).
    So why does this send the Right apoplectic? Because the scholars of the Frankfurt School in the 1930’s were post-Marxist. Note post – Marxist. They realized that the ideas of Marx had failed and they wanted to understand why. Mention Marx and the Right go apoplectic… But none has read Marx and none has understood that the socialist economics of Marx and the capitalist economics of Adam Smith are based on the same fallacious linear assumptions.
    Can you imagine trying to explain these ideas to your 11-year-old?

    I have been following emptywheel the past couple of months. The information therein has provided me with infinitely better understanding of what’s going on with respect to DOJ and J6. Thanks to all the knowledgeable contributors.

    There have been a few comments alluding to juries, but what seems to be missing for me is any discussion by experts of the impact of a potential jury on cases against top level seditionists (maybe that discussion has already happened and I just missed it). It seems that DC (fed cases), Fulton county, and NYC are good locations for having fewer Trumpnuts in the jury pool, but still it only takes one to hang a jury. Can this be handled by the prosecutor during jury selection or is it all just pot luck?

      You pick the best jury you can within the limits (See Batson v. Kentucky case). But, yes, one juror can sketch the whole thing. That’s just the way it is. So far though, juries have done their job, see Stone and Manafort. So, would not fear this too much.

      Suggest trying using the device in landscape orientaion rather then portrait – less tech jargon version; turn the screen on it’s long edge.
      (I’m currently on a 8″ phone-tablet which can fit 4th replies on the portrait orientated screen. But pretty sure about 7th reply I’ll just have a columnof randomish letters.)

    Second, I’m not sure how this would (or should) fit into any threads on EMPTYWHEEL so I’m posting as a message directly to you – the choir – the link below for an essay by Jonna Ivin….as a sort of response to Marcy’s retweet this morning of BartenderHembry.
    I found this essay at some point back in ’17 or ’18 and, being born and raise in a somewhat upwardly mobile lower middle class family in a small Arkansas town, amongst definitely non-mobile lower class families, found it resonated immediately and immensely. I still find it doing so when I searched for it just yesterday to text the updated link to a couple of friends of mine as we conducted a text chain rant. I’ve turned both of them onto EMPTYWHEEL and while we are definitely not lawyers we all find it challenging yet fulfilling to follow your daily posts. I often need a drink or two at the end of the day after spending it checking frequently for updates.
    Sorry for the poor grammar/construction and run on babble here, but back to the point….this essay. How to dissminate? One of my friends bemoans the fact that when she forwards stuff like this to her folk in Arkansas (she lives in NYC as I did for years – I met her at the University of Arkansas years ago) they seem to immediately pull the ‘god card’ and find a religious reason to blunt the conversation.

    While commenting on a blog–Canadian, a regular asked how I got by Rayne with just using e.a.f. They informed me it was now required we use at least 8 letters. (they recognized my initials from both blogs)
    wasn’t aware up until then that was required. My explaination wasI perhaps bmaz liked my taste in music or Rayne was being nice to me. I was ill for several months and didn’t read a lot of blogs during the time.
    Now that I know of the requirement I will change it to e. a. foster. I think I used [email protected] as my email address. I’ll have to find my pass word for that or change it to aol.com

    Re , just wanted to point out that Rho Khanna represents CA-17 (Biden +47). Encompassing the bottom of the SFBay and thus good chunks of the southern peninsula and East Bay, it is likely home to well over 10% of Twitter employees. Getting 10% of their political donations is not out of line, especially assuming wealthier execs spread large donations outside their home districts.

        Well, I don’t need to contribute, so that isn’t it! ;-)

        What I was hoping for, was to be notified if someone replied to a comment I posted.

        I’ve poked around on notifications, and I see that I can be notified about new posts, but I check almost every day to see if there are any new posts anyway, so that’s not quite right.

        I’ve also seen that if I was a contributor, I can be notified about new comments under my own posts, but I’m not a contributor, so that’s not quite right.

        When I comment (as I did up there ^^^^), asking a question, or for clarification, I know that people might reply to my comment (as you did up there ^^^^), but the only way that I know how to see those replies, is to make a mental note to check back “later”, find “spencer” on the page, to locate my comment, and see if there are any replies (as I did, just now). .

        Does that make sense?

        And am I missing an obvious way to do this? It seems possible (given that I provide an email address when I post), but I know not everything that is possible is doable.

          I’ll add this to the community members’ wish list but I don’t know if this is something doable with a minimum of programmer hours and a minimum of privacy concerns.

          You provide an email address, but you’ll note you’re never forced to provide a valid email address. It’s part of your identity here — if you can’t provide the same one (valid/invalid) each time without telling us you’re changing your email (and we do ask about it), you’re either not committed to commenting in good faith or some entity is attempting to spoof you as a commenter. If we need to get in touch with you, we ask in comments if your address is valid and you have the choice of telling us Y/N.

          We don’t ask much of our commenters except to use a simple 8-letter minimum username and the same one along with email address every time a comment is published. That minimal ask to protect both commenters and the site comes with a higher cost on commenters’ part — like keeping track of their own comments and replies. On our end we do our best to keep spam out, trolls to a minimum, protect users’ privacy and security, and keep the place running. This approach distinguishes us from sites using comment platforms like Disqus, which is difficult to moderate, crams ads down users’ gullets in its freemium model, and has harvested users’ data as part of its business model. Considering the topics we tackle here, security is a considerable concern; your monitoring replies to your own comments has been a tradeoff for not selling out your personal privacy and security.

    Would it make sense to write up a general usage guide for new (and some of the older posters) that explain all of the requirements for establishing and using/re-using a user name?

    I think it took me a couple of years thinking that that WordPress “Login” button at the top would be something that I should do as a mere mortal. I may have tried 3-4 different versions of saved login names but the system would never remember me. I think I also made contributions hoping that that would buy me a pass to be a real user.

    It seems that Rayne and sometimes someone else spends hours each month explaining to people that they should memorize their names and re-use them (or lengthen them to the new requirements.)

    Perhaps a simple statement when someone clicks on “Post Comment”:
    “If you have posted here before, use the ‘Name’ and ‘Email’ that you have used previously. Please remember your ‘Name’ since we do not keep track of it for you.

    Our ‘Name’ requirements are that it be 8 or more characters and be unique from any other names in use.”

    (Altho how would a poster know what’s been in use?)

      Don’t worry about the time the moderation team spends; it’s better that users see us monitoring comments than not.

    I’ve read that people are not thrilled with Mastodon and leaving Twitter isn’t alway practical. Jack Dorsey had begun a project when he was still Twitter’s CEO, to build a “decentralized” social media system, in which no single person or company controls the experience. I read in WaPo that his Bluesky (blue sky, not bluski) is now starting to take applications -or invites.       The widget in the right-hand navigation column which featured latest tweets by emptywheel contributors no longer works because Elon Musk has changed the business model at Twitter, requiring users of Twitter’s API to pay $42,000 to continue to do so.

      That kind of money can buy a lot of original reporting as well as platform updates and hosting.

      The original developers of that widget also stopped servicing it years ago. It will be replaced at some time in the near future.

        I believe some other more liberal outlets have also lost some ability to use twitter with musk’s takeover. Do you know if EW et.al. are looking at other platforms? I’ve blocked all twitter-related hosts from my browsing so it isn’t really vital to me, just hoping there’s another more open/fair place to get these types of texts out there.

      You just posted successfully. To contribute to comment threads successfully, read and apply #commentpolicy, avoid the topics of RICO and treason because whatever the subject it’s almost never either of those, and don’t get into arguments with moderators who include bmaz.

    Low priority question: When someone posts a comment, there doesn’t seem to be a mechanism in which you get notified if someone else responds to it. I posted my very first comment recently and got a couple of responses, but I didn’t know I had received those responses until I went back to the article and scrolled down in the comments and found them only then. This is not a complain. If that’s the way it is, fine. But if people actually do get a notification (like email) alerting them to a response to a comment, I haven’t received any such notifications. I had to go back to the article and check to see if there was any response. I assume, based on my limited interaction here, that I’ll have to check to see if anyone responds to *this* question. It means I must always keep track of where I posted. Does everyone have to do that?

      This site does not and will not have reply notifications. You can come back and check for replies (and it sure sounds like a “complain” about having to do this).

      Think very carefully what is required for notifications of replies: community members must provide a valid email to a site which is regularly scanned by hostile foreign entities and some hostile domestic entities.

      This would also require an additional level of administration and management for a site run on a shoestring with volunteer moderators.

      Reply notifications are not going to happen. Make a note of your comments, follow up on your own. Do not ask us to violate community members’ privacy and security, expose this site to greater risks, while we offer content for free without advertising.

    If you want to enforce some arbitrary character limit on the ‘Name’ field why not make that part of the form’s script? I’m sure WordPress (yech) has thousands of ways to do that.

    There’s a bit of me that appreciate you not moving past the 1990’s technologies but it seems it brings you more headaches that it’s worth.
