Oddly-Timed Story: White House Counsel McGahn’s Call to FCC’s Ajit Pai

[NB: Check the byline — it’s Rayne and some of this post is speculative.]

Maybe it’s something; maybe it’s nothing. But with White House Counsel Don McGahn under so much scrutiny this week, the timing of the story about McGahn’s call to the Federal Communications Commission seems odd.

You may recall I wrote recently (item 2) about the proposed merger of Sinclair Broadcast Group and Tribune Media, a deal which would have created a behemoth reaching at least 72% of U.S. households via local broadcast TV stations. FCC chair Ajit Pai revealed in testimony before the Senate Commerce Committee on Thursday this past week that McGahn had called him about the Sinclair Broadcast Group-Tribune Media merger.

Let’s look at the timeline of events related to this deal:

22-JAN-2017 — Ajit Pai named FCC chair on Trump’s second full day in office.
7-MAR-2017 — Trump nominates Ajit Pai to a second five-year term with the FCC as its chair.

Trump and Pai met at the White House on Monday for a meeting that was closed to the press, although an FCC official said that no pending business before the agency was discussed.

17-MAR-2017 — Rumors surfaced about a Sinclair-Tribune merger.
8-MAY-2017 — Sinclair announced it would buy Tribune; assets would include WGN (Chicago) and WMIL (Milwaukee) radio stations. Tribune newspapers were not included in the deal.
2-OCT-2017 — Senate confirms Pai as FCC chair.
24-OCT-2017 — FCC killed a rule requiring broadcasters to have physical offices in their primary local coverage area. The move was seen as beneficial to Sinclair’s merger as they would not have to change office locations.

16-JUL-2018 — Pai expressed concerns about the merger deal, drafting a Hearing Designated Order (HDO) to place the merger before an administrative judge.
17-JUL-2018 — McGahn called Pai for an update on the Sinclair-Tribune merger.
18-JUL-2018 — FCC signs and issues the HDO.
18-JUL-2018 — House Subcommittee on Communications and Technology announced an FCC oversight hearing for 25-JUL-2018.
24-JUL-2018 — Trump tweets about his disappointment with FCC about the Sinclair-Tribune deal:

So sad and unfair that the FCC wouldn’t approve the Sinclair Broadcast merger with Tribune. This would have been a great and much needed Conservative voice for and of the People. Liberal Fake News NBC and Comcast gets approved, much bigger, but not Sinclair. Disgraceful!

25-JUL-2018 — During House Energy and Commerce Committee FCC oversight hearing, Chairman Frank Pallone asked Pai, “If the President or anyone in the White House discusses or has discussed the Sinclair-Tribune merger with you or anyone at the FCC, will you commit to disclosing that in the public docket? Yes or no?” Pai responded, “Yes, except, Congressman, we have ex parte rules, because this is now a restricted proceeding. We are limited in what information we can receive and what we can put on the record. But consistent with our restricted ex parte rules, we would be happy to accommodate to the extent we can.” (video excerpt)
02-AUG-2018 — Pai did not mention the call from McGahn during an FCC press conference.
09-AUG-2018 — Tribune, not Sinclair, terminated the deal.
16-AUG-2018 — Pai appears before the Senate Commerce, Science and Transportation Committee, disclosing McGahn’s call.
18-AUG-2018 — NYT publishes the first of two pieces on McGahn.
19-AUG-2018 — NYT publishes the second of two pieces on McGahn.
20-AUG-2018 — House Energy and Commerce Committee Chairman Pallone Jr. said McGahn’s call to Pai should have been disclosed the previous week during a hearing before the Senate Commerce, Science and Transportation Committee hearing the previous week. Pallone wants answers about that call.

A couple things stand out immediately. First, Pai parsed responses to the House Energy and Commerce Committee and the Senate Commerce Committee. He was already on thin ice because of his claim a DDoS swamped public comments related to net neutrality but the FCC’s inspector general found Pai to be less than honest about the DDoS.

Second, the story about McGahn calling Pai was published on Thursday afternoon, approaching an advanced news dump zone during August. Why did NYT run not one but two stories about McGahn over the weekend? Why didn’t they wait until Monday? It’s as if somebody realized they needed to get a story out in spite of late summer weekend doldrums.

In this past weekend’s hullabaloo about McGahn’s “cooperation” with Special Counsel’s Office, there was a concerted effort to portray McGahn as serving and protecting the presidency, not Trump. As White House Counsel this is McGahn’s job but the obvious effort to distance McGahn from Trump should be noted.

Which makes me wonder: why did McGahn as White House Counsel, responsible for protecting the presidency, need an update from the chair of the independent FCC on a media merger? Why wouldn’t Commerce Department address this if Trump was curious? Or why wouldn’t Trump act like an ass and bumble a demand for information directly over Twitter as he has before with companies like Boeing?

As Marcy has pointed out, McGahn has extensive background in campaign finance; he was the Trump campaign’s counsel during the 2016 election season. Coincidentally he was counsel when David Smith, CEO of Sinclair Broadcasting Group, told Trump, “We are here to deliver your message.

Sounds like an offer of an unreported in-kind campaign donation to me since there are no reports that Smith or anyone at Sinclair made a similar offer to any other GOP primary candidate or to Hillary Clinton. Sinclair vigorously denied they hadn’t offered equal time when Sinclair’s offer to Trump was reported:

. . .there was a flap when Trump advisor Jared Kushner told a private business luncheon in December that Sinclair executives worked with the campaign to spread pro-Trump messages in Sinclair newscasts, which reach 81 markets in key heartland regions that supported Trump. Sinclair vehemently denied the claim, asserting that it offered equal amounts of air time for in-depth interviews to Trump and his Democratic rival, Hillary Clinton, and that Clinton declined the invitation.

Did McGahn know about and approve this offer?

Pai’s squirrelly behavior about Sinclair-Tribune as well as McGahn’s sudden distancing from Trump cast a different light on David Smith’s so-helpful offer and Sinclair’s mandatory group-wide airing of former White House communications aide Boris Epshteyn’s program — the same Epshteyn who has a history of pro-Russian sentiment. Add these couple line items to the timeline:

25-MAR-2017 — Epshteyn left his role as Special Assistant to The President and Assistant Communications Director for Surrogate Operations, having previously served in Trump campaign communications and as director of communications for Trump inauguration committee.
17-APR-2017 — Sinclair announced Epshteyn joined them as a political analyst.

Conveniently after the rumors emerged about the Sinclair-Tribune merger but before it was formally announced — what a coincidence.

It doesn’t appear Epshteyn was replaced in the White House. Was Epshteyn placed with Sinclair at Trump’s request — not because of Epshteyn’s rumored confrontational approach to Fox News — after having been parked with the White House for two months post-inauguration for the purposes of resume padding?

Is Epshteyn really an independent political analyst or is he still shilling for Trump as an under-cover communications aide on Sinclair’s dime — gaslighting America for Trump’s benefit — given David Smith’s eagerness to deliver Trump’s message? Is Epshteyn really doing advance work for Trump 2020 campaign?

Is this the reason why Sinclair issued a diktat to all its 173 stations that they must read on air a statement about other media outlets’ “fake news,” in order to elevate their content, including Epshteyn’s by contrast, engaging in what NPR’s David Folkenflik called “negative campaigning”?

Is this the reason why Ajit Pai didn’t disclose the call from McGahn and attempted to obstruct access to information about the call behind an HDO that McGahn called not on behalf of the president but on behalf of the Trump 2020 campaign?

Did McGahn help push the two back-to-back NYT articles this weekend to wallpaper over what may have been a Hatch Act violation — using his role as White House Counsel to reach Ajit Pai and press for approval of the Sinclair-Tribune merger to benefit Trump 2020?

Reaching at least 72% of American households from now until Election Day 2020, to push anti-Democratic Party content while collecting data on viewers and shaping voter turnout, might have been adequate motivation to do so if one were working for the Trump campaign — not to mention  McGahn’s legal exposure.

It’d be nice if one of the Congressional committees conducting oversight of the FCC asked Pai more pointed questions about that phone call.

It’d be nice, too, if somebody asked any of the 2016 GOP primary candidates or Hillary Clinton’s campaign team if they received the same offer from Sinclair’s Smith extended to Trump or his proxies (hello, Jared).

And there’s more than one David helming a media empire who needs to answer some questions about their friend Trump.

Three Things: Still Active Measures

Whether counter-arguments or conspiracy theories, it’s interesting how certain narratives are pushed when tensions rise. But are they really theories or conditioning? And if conditioning, could other media infrastructure changes create more successful conditioning?

In an interview with Fox News post-Helsinki summit, Vladmir Putin made a point of blaming the Democratic Party for “manipulations of their party.”

…“The idea was about hacking an email account of a Democratic candidate. Was it some rigging of facts? Was it some forgery of facts? That’s the important thing that I am trying to — point that I’m trying to make. Was this — any false information planted? No. It wasn’t.”

The hackers, he said, entered “a certain email account and there was information about manipulations conducted within the Democratic Party to incline the process in favor of one candidate.” …

Have to give Putin props for sticking with a game plan — increase friction within the American left and fragment Democratic Party support to the benefit of Trump and the Republican Party at the polls and ultimately Putin himself if sanctions are lifted. Christopher Steele indicated in the Trump-Russia dossier that the Kremlin was using active measures to this effect in 2016 to widen the divide between Sanders and Clinton supporters; apparently left-splitting active measures continue.

But this is only part of an attack on the Democratic Party; another narrative undermines both the DNC and the FBI by questioning the investigation into the DNC’s hacking. Why didn’t the FBI take possession of the server itself rather than settle for an image of the system? A key technical reason is that any RAM-resident malware used by hackers will disappear into the ether if the machine is turned off; other digital footprints found only in RAM memory would likewise disappear. “The server” isn’t one machine with a single hard drive, either, but 140 devices — some of which were cloud-based. Not exactly something the FBI can power down and take back to a forensic lab with ease, especially during the hottest part of a campaign season.

But these points are never effectively made as a counter narrative, though some have tried with explainers, and certainly not featured in broadcast or cable news programs. The doubt is left to hang in the public’s consciousness, conditioning them to question FBI’s competence and the validity of their investigative work.

If Putin is still using active measures to divide Democratic Party voters, is it possible this narrative about the hacked DNC server is also an ongoing active measure? What if the active measure isn’t meant to undermine the FBI by questioning its actions? What if instead the lingering doubt is intended to shape future investigations into hacked materials which may also rely on server images rather than physical possession of the hardware? What if this active measure is pre-crime, intended to tamper with future evidence collection?

I’d begun drafting this post more than a week ago, but came to a halt when FCC chair Ajit Pai did something surprisingly uncorrupt by putting the brakes on the Sinclair-Tribune merger.

Sinclair Broadcast Group is a propaganda outlet masquerading as a broadcast media company. The mandatory airing of Boris Epsteyn’s program across all Sinclair stations offers evidence of Sinclair’s true raison d’etre; Epsteyn is a Russian-born former GOP political strategist who has been responsible for messaging in both the McCain-Palin campaign and the Trump administration, including the egregious 2017 Holocaust Remembrance Day statement which omitted any mention of Jews. The mandatory statement Sinclair management forced its TV stations to air earlier this year about “fake news” is yet another. The forced ubiquity and uniformity of messaging is a new element at Sinclair, which already had a history of right-wing messaging including the attempt to run a Kerry-bashing political movie to “swiftboat” the candidate just before the 2004 elections.

Sinclair and Tribune Media announced a proposed acquisition deal last May. If approved, the completed acquisition would give Sinclair access to 72% of U.S. homes — an insanely large percentage of the local broadcast TV market effectively creating a monopoly. There was bipartisan Congressional pushback about this deal because of this perceived potential monopoly.

FCC’s Ajit Pai wanted to relax regulations covering UHF stations — they would be counted as less than a full VHF station and therefore appear to reduce ownership of marketshare. Democrats protested this move as it offered Sinclair unfavorable advantage when evaluating stations it would acquire or be forced to sell during its Tribune acquisition.

Fortunately, Pai had “serious concerns” about the Sinclair-Tribune deal:

We have no idea to which administrative judge this deal may be handed, let alone their sentiments on media consolidation. We don’t know if this judge might be Trump-friendly and rule in favor of Sinclair, taking this horror off Ajit Pai’s back — which might be the real reason Pai punted after his egregious handling of net neutrality and the pummeling he’s received for it, including the hacking of the FCC’s comments leading up to his decision to end Obama-era net neutrality regulations and subsequent “misleading” statements to the media about the hack. New York State is currently investigating misuse of NY residents’ identities in the hack; one might wonder if Pai is worried about any personal exposure arising from this investigation.

BUT WAIT…the reason I started this post began not in New York but in the UK, after reading that Remain turnout may have been suppressed by news reports about “travel chaos,” bad weather, and long lines at the polls. Had the traditional media played a role in shaping turnout with its reporting?

I went looking for similar reports in the U.S. — and yes, news reports of long lines may have discouraged hundreds of thousands of voters in Florida in 2012. This wasn’t the only location with such reports in the U.S. during the last three general elections; minority voters are also far more likely to experience these waits than voters in majority white areas.

Probabilistic reports about a candidate’s win/loss may also suppress turnout, according to a Pew Research study.

Think about low-income voters who can’t afford cable TV or broadband internet, or live in a rural location where cable TV and broadband internet isn’t available. What news source are they likely to rely upon for news about candidates and voting, especially local polling places?

Hello, local broadcast network television station.

Imagine how voter turnout could be manipulated with reports of long lines and not-quite-accurate probabilistic reports about candidates and initiatives.

Imagine how a nationwide vote could be manipulated by a mandatory company-wide series of reports across a system of broadcast TV stations accessing 72% of U.S. homes.

How else might a media company with monopolistic access to American households condition the public’s response to issues?

There was all kinds of hullabaloo about the intersection of retiring Justice Anthony Kennedy, his son Justin, and Justin’s employment at Deutsche Bank at the same time DB extended financing to Donald Trump. It looks bad on the face of it.

And of course one prominent defense-cum-fact-check portrays Justin’s relationship to DB’s loans to Trump as merely administrative:

The extent to which Kennedy worked with Trump on this loan, or possibly on other Deutsche Bank matters, is unclear. “In that role, as the trader, he would have no contact with Trump … unless Eric [Schwartz] was trying to get Justin in front of Trump for schmoozing reasons,” Offit said, adding that he had recently spoken with former colleagues at the bank about Kennedy’s work.

Seems odd there has been little note made of Jared Kushner’s relationship with LNR Partners LLC — a company which Manta says has only 17 employees — and its subsidiary LNR Property which financed the Kushner 666 Fifth Avenue property in 2012. There was a report in Medium and another on DailyKos but little note made in mainstream news media.

I’m sure it’s just a coincidence that along with his business partner, Justin Kennedy was named 26th on the 50 Most Important People in Commercial Real Estate Finance in 2013 by the Commercial Observer — a publication of Observer Media, then owned by Jared Kushner.

I wonder what Justin’s rank was on this list while he worked at Deutsche Bank (also with current business partner Toby Cobb).

How odd this deal and the relationship wasn’t defended. I guess it’s just coincidence all the amphibians and reptiles know each other well in the swamp.

McCain’s Favors for Iseman Involved Helping Far Right-Wing Families to Sustain their Shell Companies

When I noted that John McCain’s lobbyist gal had represented the two networks that would, in 2004, show the anti-Kerry propaganda piece, Stolen Honor, I admitted I didn’t know precisely whether or how John McCain had helped the second of these two networks, Sinclair Broadcasting’s shell company, Glencairn Broadcasting. Today, the NYT makes it very clear that McCain used the same kind of inappropriate, pushy tactics for Sinclair as he had with Paxson.

In late 1998, Senator John McCain sent an unusually blunt letter to the head of the Federal Communications Commission, warning that he would try to overhaul the agency if it closed a broadcast ownership loophole.

The letter, and two later ones signed by Mr. McCain, then chairman of the Senate Commerce Committee, urged the commission to abandon plans to close a loophole vitally important to Glencairn Ltd., a client of Vicki Iseman, a lobbyist. The provision enabled one of the nation’s largest broadcasting companies, Sinclair, to use a marketing agreement with Glencairn, a far smaller broadcaster, to get around a restriction barring single ownership of two television stations in the same city.

I gotta say, "unusually blunt," coming from Mr. Straight Talk for Lobbyists Express is saying something. The article goes on to note that McCain was partnering with Conrad Burns on this matter–some real gutter diving for a guy who claims to be above corruption.

The NYT article suggests more about the relationship between Iseman and McCain.

For its part, Glencairn appeared to have been getting little support in Congress until it retained Ms. Iseman in 1998.

Edwin Edwards, who was the president of the company at the time, said in a recent interview that after retaining Ms. Iseman, he was able to get heard by Mr. McCain.

“We were pounding the pavement in Washington,” Mr. Edwards said. “We recruited help from as many people as we could. We knocked on every door just trying to get support.”

Labaton suggests–but doesn’t say it–that companies with business interests before McCain could hire Iseman as the best way to get entre to him. Buy Vicki Iseman and you get McCain. No wonder she was bragging about her access to him. Read more

Did Vicki Iseman “Steal Honor” in THREE Presidential Elections?

John McCain denies any honor was stolen–neither his nor Ms. Iseman’s. Or rather, he denies "the story," though it’s not clear whether he’s denying that his relationship with Iseman was inappropriate or that he did favors for her. So I guess I’ll leave it up to you to decide whether she stole McCain’s honor in both the 2000 and 2008 presidential elections.

For the moment, though, I’m more interested in the 2004 election–the one McCain didn’t run in. You see, I find it a mighty curious coincidence that two of the companies for which Iseman was lobbying John McCain in 1999 and 2000–the time of their potentially inappropriate relationship–also happen to be the two television companies that championed the Kerry smear, "Stolen Honor," in 2004.

Stolen Honor

Stolen Honor, you’ll recall, was a 45-long propaganda piece, repeating the allegations the Swift Boaters made against John Kerry. It came out in September 2004 (as Republicans have promised a smear against Hillary or Obama will come out at precisely the same time this cycle). Shortly thereafter, Sinclair Broadcasting ordered its stations to pre-empt normal broadcasting to play the "documentary." Sinclair also fired one employee who complained about the order.

After a blogswarm in response, Sinclair’s advertisers started pulling their advertising, which eventually led Sinclair to cut back its plans for the "documentary," showing clips of it as part of a program on Vietnam POWs on just 40 of its stations.

Friday night brings to a conclusion the fiercest media battle of the presidential campaign, when 40 of the Sinclair Broadcast Group’s 62 stations nationwide air a special program about the media and Vietnam War POWs. The show is likely to include generous portions of an anti-Kerry attack film, "Stolen Honor," that Sinclair executives had originally intended to air in its entirety just days before the election. In the face of lawsuits by stockholders, loss of advertising, questions about its abuse of the public airwaves and a falling stock price, however, Sinclair quickly cobbled together a revised program.

In the same time frame, Paxson Communications aired the entire "documentary" a number of times in the days leading up to the election, supported by NewsMax.

As FCC Commissioner Jonathan Adelstein described, the two companies were two disturbing examples of politicized broadcast policies.
