Because everyone will likely be restless and itchy about today’s hearing, I’m putting up an open thread.

Feel free to discuss Trump v. Anderson here but bring all your off-topic discussion to this thread, stay on topic in other threads.

Trump v. Anderson (No. 23-719, filed January 3, 2024)

In a nutshell, Colorado’s state supreme court found Donald J. Trump disqualified from the state’s primary ballot under Section 3 of the 14th Amendment which bars candidates who have participated in insurrection or rebellion against the Constitution in spite of swearing an oath to uphold and defend the Constitution.

Trump appealed the ruling; the U.S. Supreme Court will hear oral arguments today.

The hearing is scheduled to begin at 10:00 a.m. ET.

Gaslighting of the Obstructive Kind

It’s pretty damned bad when your uncle feels he must denounce what you’ve said and done as the head of your shared political party.

Ronna McDaniel, niece of Mitt Romney and Republican National Committee chairwoman, deserved her uncle’s rebuttal. She’d tweeted in response to The New York Times’ article, ‘G.O.P. Declares Jan. 6 Attack ‘Legitimate Political Discourse‘ which reported the RNC’s censure of Representatives Liz Cheney (R-WY) and Adam Kinzinger (R-IL) for their participation in the House January 6 Committee:
As the chair of the RNC, it’s “legitimate political discourse” all the way down with McDaniel. She must have approved the wording of the censure which included the description of the U.S. Capitol’s violent storming as “legitimate political discourse,” doubling down when tweeting her objection to the NYT’s straightforward stenography of the censure.

There are so many layers of stupidity to this censure, one of which Marcy has already addressed. But for McDaniel and the RNC to expect the American public to believe their claim is unmoored from reality.

This is not “legitimate political discourse” by ordinary citizens.

Not legitimate as an exercise of free speech.


Violent to the point political perspective has been lost, beyond an effort to obtain agreement.


No reasoned discourse, just rage the entire world could see.

What instead McDaniel and the RNC have offered is gaslighting – an effort to change the public’s perspective of what they saw on television on January 6, 2020; what they’ve seen online across numerous news outlets since then; what the public has been shown by the Federal Bureau of Investigation which is still searching for perpetrators; what the Department of Justice’s prosecutors have shown grand juries and courts as more than 700 individuals have been identified and arrested for their actions on January 6.

Gaslighting — a truly feeble effort which damages the RNC even further because the public can see through the dampened tissue held in front of its eyes.

More specifically, this gaslighting is aimed at GOP voters, who also saw a violent attack on the U.S. Capitol on January 6:

The last year of denialism, trash talking the House J6 Committee, and GOP congressional caucus refusal to cooperate in good faith has moved the disapproval rating 13%, still leaving 61% of GOP voters unhappy with what transpired on January 6.

So McDaniel and the RNC doubled down to try and recover more ground with GOP voters.

But the photos and videos don’t lie, and the other evidence gathered so far by both the House J6 and the DOJ bolster what the visual evidence tells us.

Nor has the court countered what the public saw, having convicted 208 and sentenced 85 out of 734 perpetrators charged to date.

The gaslighting will only become more obvious when hearings begin, and begin they will.

Not even Putin’s saber rattling over Ukraine can stop them.

The RNC had to backpedal on their claim this was “legitimate political discourse” because it even offended some GOP.

But the discussion over what the RNC really meant clouds another concern, which is that the censure itself was a fraud.

On January 6 and into the early hours of January 7, 2020, these states’ election certifications were called into question:

Arizona: 11 electoral votes – Counted following objection presented by Rep. Paul Gosar (R-AZ) and Sen. Ted Cruz (R-TX)
Senate rejected objection by a vote of 6-93
House rejected objection by a vote of 121-303

Georgia: 16 electoral votes – Counted following incomplete objection presented by Rep. Jody Hice (R-GA) without a senator

Michigan: 16 electoral votes – Counted following incomplete objection presented by Rep. Marjorie Taylor Greene (R-GA) without a senator

Nevada: 6 electoral votes – Counted following incomplete objection presented by Rep. Mo Brooks (R-AL) without a senator

Pennsylvania: 20 electoral votes – Counted following objection presented by Rep. Scott Perry (R-PA) and Sen. Josh Hawley (R-MO)
Senate rejected objection by a vote of 7-92
House rejected objection by a vote of 138-282

On December 30, Hawley said he was going to object to certification.

On January 2, 11 other GOP senators said they would object to certification. They were:

Marsha Blackburn (R-TN)
Mike Braun (R-IN)
Ted Cruz (R-TX)
Steve Daines (R-MT)
Bill Hagerty (R-TN)
Ron Johnson (R-WI)
John Kennedy (R-LA)
James Lankford (R-OK)
Cynthia Lummis (R-WY)
Roger Marshall (R-KS)
Tommy Tuberville (R-AL)

Blackburn, Braun, Daines, Hagerty, Johnson, Lankford, Lummis all withdrew their objections after the Senate reconvened and voted on certification.

Senator Kelly Loeffler (R-GA) had not announced her intention to object in advance of January 6, but later withdrew her objection because of the assault on the Capitol Building.

Rick Scott (R-FL), Cindy Hyde Smith (R-MS), Cynthia Lummis (R-WY) threw in with Cruz, Hawley, Kennedy, Marshall, and Tuberville to vote against certification though they did not announce their position ahead of January 6.

We know now that Tuberville had been contacted by phone on the floor of the Senate by both Trump and Rudy Giuliani just as the Senate was being evacuated on January 6.

Represenatives Brooks Gosar, Greene, Hice, Perry objected to the certification of states Arizona, Georgia, Michigan, Nevada, and Pennsylvania with support from senators Cruz and Hawley.

In all, 148 GOP members of Congress – 8 senators, 139 representatives – voted against certification of the election.

What McDaniel and the RNC have tried to hide with their claim that January 6 was “legitimate political discourse” was the autogolpe attempted even after the insurrectionist rioters disbanded and left the Capitol Building.

“Legitimate political discourse” this was not, though it has now been whitewashed by the RNC and protected by the weaponized Speech or Debate Clause.

Which of these GOP members of Congress were in on the conspiracy to obstruct government proceedings?

Which of them knew in advance how the plan to overturn several states’ election certifications would work, and knew their role in the conspiracy?

Which of them performed their role as they understood it?

Which ones remained silent and voted against certification, saying little to nothing afterward?

Which ones vacillated – hello, Kevin McCarthy – or played some other role in the conspiracy – hello, Lindsey Graham?

Which ones refused to participate in the conspiracy, but have simply said nothing at all, implicitly supporting sedition, insurrection, and the peaceful transfer of power with their silence?

The lack of honest, forthcoming answers about the GOP congressional caucus’s role is both instructive and obstructive.

McDaniel and the RNC may think they’re going to pull their party’s butt out of the fire with this gaslighting effort, by attempting to reframe angry hordes summoned to D.C. — who attacked police and threatened members of Congress, insulted the country by defecating on the Capitol Building’s marble floors after smashing its doors and windows, stole podiums, papers, laptops — as ‘ordinary citizens’ engaged in “legitimate political discourse,” while redirecting attention away from the roles that GOP members of Congress played on January 6.

But they’ve only demonstrated once again the Republican Party is incapable of governing, just as it’s been incapable of establishing a platform since 2016 based on coherent values it demonstrates in its actions.

If the GOP can’t engage in “legitimate political discourse,” if it can only exercise bad faith in words and deeds, it’s dead.

Sic transit mundum tuum, Factio Republicana.

But what if this obstructive gaslighting was more than a reframing exercise meant to skew public opinion?

What if McDaniel and the RNC instead meant to greenlight the same kind of violent behavior Trump’s supporters exhibited on January 6, using the censure of Cheney and Kinzinger and subsequent discussion as cover?

What if the walking dead GOP is not only rotting the brains of its followers with its false reality but encouraging them to continue to rebel because they have no other truly legitimate means to stay in power if voter suppression doesn’t succeed?

It should be absolutely crystal clear the language used by Individual-1 in reference to these persons aged 44, 40, and 38 is pure propaganda.

These are graduates of pricey universities who are old enough to have adult children. One of them was an advisor to the former White House occupant.

They may be the progeny, descendants, and heirs of Donald J. Trump but they are not juveniles, youngsters, or children.

His reference to Donald Jr., Ivanka, and Eric as children is subtly racist as well, because in 1989 Trump would never have referred to these persons:

as children.

Yes, racist, though Trump is hardly the first and only to use the white supremacist convention which allows any white adult with a living parent to be called a child while Black persons of any age are labeled in terms which erase any any and all innocence no matter the situation.

Innocence is exactly what Trump wants to convey and it’s fallacious bullshit.

Trump will continue to spew this manipulative crap to skew the public’s sentiment, but every bit of it must be rejected and set straight with the truth.

All three of these adults and their father have been subpoenaed by the New York Attorney General in relation to an investigation into the Trump Organization’s use of fraudulent and misleading asset valuations to obtain economic benefits.

This is hardly the stuff of children who can’t knowingly enter contracts. The NYAG’s brief profiles of Trump’s adult progeny describe people who are quite capable of managing contracts:

Donald Trump, Jr. runs the Trump Organization with Eric Trump. He is also a trustee of the Donald J. Trump Revocable Trust and has certified annual financial statements regarding the assets the Trust holds for Donald J. Trump.

Ivanka Trump was the Executive Vice President for Development and Acquisitions of the Trump Organization through at least 2016. Among other responsibilities, Ms. Trump negotiated and secured financing for Trump Organization properties. Until January 2017, Ms. Trump was a primary contact for the Trump Organization’s largest lender, Deutsche Bank.

These are adults who need to cooperate with law enforcement because their father isn’t going to make this any better. He’s clearly not stepped up to respond to the subpoena and instead thrown “children” in front of the NYAG’s bus.

Laughing in the Face of Denial

Not this again.

From Trump lawyer David Schoen on day one of the second Trump impeachment trial:

[The House impeachment managers] tell us that we have to have this impeachment trial, such as it is, to bring about unity. But they don’t want unity, and they know this so-called trial will tear this country in half, leaving tens of millions of Americans feeling left out of the nation’s agenda as dictated by one political party that now holds the power in the White House and our national legislature. But they are proud Americans, who never quit getting back up when they are down and they don’t take dictates from another party based on partisan force-feeding. This trial will tear this country apart, perhaps like we have seen only once before in our history.

*sigh*

Long ago, as a young pastor, a couple came to me about concerns with their marriage. The husband had slept with someone else, and when his wife threatened to file for divorce, they came to me together for advice. After some pleasantries at the beginning of the conversation, the tone quickly shifted. Filled with righteous indignation, the husband said “She’s going to file for divorce and break up our family! Whatever happened to forgiveness? Tell her she can’t do that!”

I laughed out loud.

Not a chuckle, not a single snort, but a good 15 seconds of laughter. (I said I was young.) They both looked at me in absolute shock. When I quelled my laughter, I said “*She* is going to break up your family? Please. *You* broke up the relationship when you slept around. That relationship is dead. You have to decide if you are willing to take responsibility for that and make the effort to repair it, or if you want to live in denial that breaking your marriage vows wasn’t that big a deal and sleeping around really didn’t hurt anyone.”

This was met with silence, so I plunged on.

Still speaking to the husband (but with the wife listening closely), I said “You don’t get to decide the terms of how she forgives anyone. Forgiveness doesn’t mean everything goes back to the way it was. It means that she quits seeing you as a monster, and quits letting the pain you caused her continue to govern her life. If she forgives you, it doesn’t automatically mean that you two will stay married. It just means she is done with letting what you did continue to hurt her. If you want this relationship to be healed and this marriage to be rebuilt, that starts with honesty, not denial. Honesty about what happened, honesty about how damaging and painful it was, and honesty about what you are or are not willing to do going forward.”

No, that husband was not David Schoen — but in listening to Schoen yesterday, the two of them sure sound a lot alike. The more Schoen and the defenders of Trump talk about unity and moving on without acknowledging anything about Trump’s role in the insurrection, the more they show they have no interest in unity or healing.

But we already knew that.

In one of my former congregations, I had a parishioner who was a psychologist who worked with men who had been convicted of child abuse, and the two of us had a number of long conversations around abuse and denial. When someone is accused of child abuse, my parishioner told me, he would see the same dynamic play out with each one. First, they deny that the abuse happened. “I didn’t do it!” When presented with evidence that they did indeed do it, the denial shifts to avoiding judgment: “OK, but it’s no big deal. No one got hurt. She/he came on to me. He/she had it coming. You have no right to judge me for that.” When that doesn’t work, denial pulls out the big trump card to avoid any consequences: “You have to forgive me!”

Perpetrators of abuse turn to denial because if there are consequences to their actions, something will have to die – their image of themselves, their relationships with others, and more. Denial is how they hope that nothing in their lives will have to change, with no consequences for their damaging actions.

Honesty, on the other hand, is where perpetrators of abuse turn if they are truly interested in healing and moving on. From everything I heard yesterday, the abusers and their enablers have no interest in healing. Power? Absolutely. Healing? Not so much.

This trial will not tear this country apart. Trump has already torn it apart.

The question now is whether the Senate wants to honestly acknowledge that reality and begin to deal with it by holding Trump accountable, or if they want to remain in denial and encourage the tear in our country to continue growing.

 

Crowdsourced Timeline: Tick-Tock to Insurrection and Beyond [UPDATE-3]

You’ll recall Marcy’s January 8 post, “Investigate Tommy Tuberville’s Pre-Speech and Debate Actions” in which she wrote about Rudy Giuliani’s January 6 phone calls intended for Sen. Tommy Tuberville (R-AL).

EDIT: One The first call was received by Sen. Mike Lee (R-UT), which he handed over to Tuberville even as they were preparing to evacuate the Senate chambers. The caller was Trump.

Giuliani’s The second call, from Rudy Giuliani, was left instead on another unnamed senator’s phone.

Giuliani’s voicemail message asked Tuberville to slow down the election certification process on January 6, buying Team Trump time to get more information from states to contest multiple states’ elections with the aim for states to pull their certifications of their elections altogether.

How this would all come together and result in an overturned election wasn’t clear. What was the mechanism by which the states, which had already certified their elections, would reverse those certifications?

Last evening a missing piece dropped, deep in the Friday night news dump zone. The New York Times reported Trump and a little-known Department of Justice attorney, Jeffrey Clark, attempted a takeover of the DOJ, with the intent to use the department’s powers to persuade the state of Georgia to overturn its election results.

Overturning Georgia’s results and fraudulently awarding the state’s electoral votes to Trump wouldn’t have been enough to give Trump the election. But the same powers might have been used to pressure other states or to provide cover for states with GOP elected officials or legislature which favored Trump. We really need to know if Trump made calls to other states like the one he made to Georgia’s secretary of state to lean on him for 11,780 votes.

11/12/2020 — Cybersecurity and Infrastructure Security Agency (CISA) Director Chris Krebs said he expected he would be fired for CISA’s website dedicated to debunking election-related disinformation, much of which was spread by Trump and campaign associates.

11/17/2020 — Krebs was fired by Trump tweet after Krebs tweeted, “59 election security experts all agree, ‘in every case of which we are aware, these claims (of fraud) either have been unsubstantiated or are technically incoherent.’”

11/17/2020 — Michigan election officials certified the state’s election.

11/18/2020 — 8:04 AM – Trump tweets that Michigan can’t certify its election because of voter fraud.

11/18/2020 — GOP Michigan election officials attempt unsuccessfully to rescind their certification of the state’s election.

11/25/20 — Sham “hearing” in Gettysburg, PA (Rudy, Jenna, Trump via phone).

11/25/2020 — Michael Flynn pardoned by Trump.

11/30/2020 — Trump nominated Charles Flynn to be the Army’s “deputy chief of staff for operations, plans and training.”  submitted a nomination for elevation of Lt. Gen. Charles Flynn to full general. Flynn began his current and ongoing role as Deputy Chief of Staff G3/5/7 in June 2019; he is retired Lt. Gen. Michael T. Flynn’s sibling.

12/01/2020 — Attorney General Bill Barr told Associated Press there was no widespread voter fraud during the November 2020 election, disputing Trump’s claims to the contrary.

12/01/2020 — Michigan’s state senate oversight committee held a 7-hour long hearing listening to testimony about the conduct of the November general election.

12/02/2020 — Rudy Giuliani appeared before Michigan’s state house oversight committee in a hearing about the conduct of the November general election; Giuliani maintained Trump won the election. 01/03/2021 — Early afternoon – The Washington Post releases a story along with a roughly one-hour-long audio recording of Trump’s conversation with Raffensperger the previous evening.

01/05/2021 — More than 100 representatives from Wisconsin, Michigan, Pennsylvania, Arizona and Georgia asked for at least 10 more days, so they could investigate and then vote on the election in their state legislatures. Just before 12 PM — Sund was monitoring Trump’s speech to the crowd on the Ellipse when he was called away by reports of two pipe bombs — near the Capitol grounds.

12:40 PM — The first wave of rioters arrived at the Capitol Building roughly 40 minutes after Trump had begun speaking at the Ellipse.

1:00 PM — Sund called Contee, who sent 100 District of Columbia (DCPD) police officers to the scene

1:09 PM — Sund [said he] called Irving and Stenger, telling them it was time to call in the Guard.

More of Contee’s officers had arrived and were helping remove rioters from the grounds. Capitol Police worked with other federal authorities, including the Secret Service, the Park Police and the FBI, to secure lawmakers, eject rioters and sweep the building so lawmakers could return to finish counting the electoral college votes that would allow them to formally recognize Biden’s victory later that night.

Amanda Gorman Made Silvester Beaman Sad, Joe Biden Happy, and John Lewis Dance

The saddest person on the Inaugural stage was not Mike Pence, the outgoing Vice President. Indeed, after what he had to put up with from Trump for the last month, he’s probably relieved if not outright happy. The saddest person was not Amy Klobuchar or other presidential hopefuls who came up short during the primaries, who no doubt imagined themselves as the person taking the oath of office today. The saddest person on the stage today was the Reverend Doctor Silvester Beaman of Bethel AME Church in Wilmington, Delaware.

The happiest person on the stage was President Joe Biden, but it’s not because he was sworn in as the 46th president of the United States of America. It’s not because the inauguration went off without more violence. It’s not because he can finally *do* things to address all the problems he and we are facing, which had to have been incredibly frustrating as the transition floundered and foundered and blundered its way to today. It’s not because he accomplished what Beau wanted him to do.

The reason Beaman was so sad and Biden was so happy is this: Biden finished before Amanda Gorman spoke and Beaman had to follow her. Honestly, I half expected Beaman to step up to the microphone, ask “Can I get an Amen?”, and then drop the folder with his prepared benediction and sit down. Don’t get me wrong: Beaman’s words were good, but he had to know that he was following something epic.

When I saw Gorman come down the Capitol steps wearing her yellow power coat, her bold hoop earrings, her bright red wrap around the powerful tight braids atop her head, I just sat back and smiled. Michelle Obama looked great in her purple, but she was a member of the audience today. Lady Gaga and Jennifer Lopez both made their entrances before they picked up the microphone, and were fine, but Gorman owned those steps in a way that no on else did today. Seeing her enter reminded me of AOC stepping onto the House floor in her power red suit as she prepared to respond to being called a “fucking bitch” by Florida Congressman Ted Yoho. Before Gorman opened her mouth, it was clear that she had Something To Say and it was going to be good.

And make no mistake: she did, and it was.

It was incredibly powerful for three reasons. First, Gorman was unapologetically herself: young, African-American, articulate, and proud of all three. She did not cast herself as Maya Angelou or Robert Frost, two earlier inaugural poets. She spoke with the rhythms of rap that are the language of her generation and her community, embracing the whole heritage of Africans on this continent, and conscious of her power in this moment.

Second, Gorman was unflinchingly honest. She spoke of the ugliness of our history at times, at the tragedies we have been through, and the reality of what is going on right now. There were no pious platitudes to paper over the pain that far too many have had to deal with for far too long.

Most of all, Gorman was unimaginably hopeful. If she owned and possessed the four centuries of pain poured out on the Africans brought to this country in chains and their descendants who lived through slavery, official Jim Crow, and unofficial oppression, she also owned and possessed the strength that carried them through it all, forcing this country to slowly and painfully look at its past, decide to change, and actually make those changes begin to come to be.

But while democracy can be periodically delayed,
it can never be permanently defeated.
In this truth, in this faith we trust
for while we have our eyes on the future, history has its eyes on us.

This is the era of just redemption.
We feared it at its inception.
We did not feel prepared to be the heirs of such a terrifying hour,
but within it, we found the power
to author a new chapter,
to offer hope and laughter
to ourselves so while once we asked,
how could we possibly prevail over catastrophe?
Now we assert:
how could catastrophe possibly prevail over us?

We will not march back to what was,
but move to what shall be
a country that is bruised, but whole,
benevolent, but bold,
fierce, and free.
We will not be turned around or interrupted by intimidation
because we know our inaction and inertia will be the inheritance of the next generation.
Our blunders become their burdens.
But one thing is certain,
if we merge mercy with might and might with right,
then love becomes our legacy and change our children’s birthright.

And with these words, I thought immediately of John Lewis, the happiest person *not* on the stage today.

Gorman was not mindlessly repeating the words of an earlier generation of activists, but building on them. Just as the 23 year old John Lewis spoke on the steps of the Lincoln Memorial in 1963, so the 22 year old Amanda Gorman stood at the other end of the Mall, on the steps of the Capitol in which John Lewis served until he died, and she is taking this nation one more step forward. She isn’t asking permission to do this, or suggesting this be done. She is declaring reality: we will not be turned around or interrupted by intimidation.

I am glad that Joe Biden and Kamala Harris defeated Donald Trump and Mike Pence. I am relieved that we have made it through the transition between the election and today. I am still shaken by the insurrection of January 6th and what may yet lie ahead on that front. But I am dancing in my living room right now, and am convinced that John Lewis is dancing in heaven today, because in Amanda Gorman we see that the good troublemaking goes on.

Where’s The Anger? Where Are The Consequences?

On January 6 a mob attacked the Capitol. Legislators were rushed out of their chambers and into safe rooms barely ahead of thousands of seditionists. Staff people, Senators and Representatives cowered under desks and behind barricaded doors. People died. Dozens of police were injured, many hospitalized.

Then the legislators resumed business as if nothing horrible and terrifying had happened. The newly-created Insurrection Party shouted about the theft of an election and lied about their concerns. Democrats responded with facts and logic. In the middle of the proceedings, Sen. Amy Klobuchar appeared on A Late Show with Stephen Colbert. In response to Colbert’s increasingly agitated questions, she said that the important thing was that they went back to the floor and did their job. Like Colbert, I’m stunned by the normalcy she displayed. There isn’t a hint of anger, hostility, or outrage in her face, even when she claimed to be angry about it.

Colbert asks if it upsets her at all that six Senators only changed their votes after they were physically attacked, even though they knew they were stirring up trouble around the country by repeating Trump’s big lie about election fraud. She says (my transcription):

Of course it does. But I figured my job today was to bring as many people with me and with our side as we could and to do it in a way that would give them that space. And the reason I did it is because, I made this case to our caucus, is that I want Joe and Kamala to come in with bipartisan support. I want to leave the what Joe Biden calls the grim era of demonization behind us and actually get things done. … I think what they did was atrocious, but at the same time we have to move forward as a nation.

[1] Colbert, his voice rising with emotion, asks if there shouldn’t be consequences for people who promulgated the lie that the election was stolen, consequences “… so severe that no one will ever think to foment an insurrection against this government again without shuddering at the prospect of what will happen to them.” She moves straight to “I’m a former prosecutor”, and starts talking about jailing the invaders. Colbert tries to focus her on the Senators, but she won’t answer whether they should face consequences. She launches into what a toad Trump is, and never responds about the co-toads. Colbert surrenders.

Nothing changed among Democratic politicians after that. On January 15, for example, I saw Jason Crow, D CO-6, on CNN discussing the revelation that some Representatives or their staffers might have led invaders on a reconnaissance tour of the Capitol the day before the attack, even though tours were banned. The oily flow from Crow could be used to lubricate a Mack Truck.

Where’s the demand for accountability for those shits who repeated Trump’s lies with their own imprimatur? [2] Are there no consequences for lies that undermine our democracy? Are elites just utterly free from any duties? Cruz, Hawley, Blackburn, Hyde-Smith, Marshall, Tuberville, and Kennedy are not stupid. Well, Tuberville is a couple of hundred million neurons short of a human brain. But the rest are pretty close to average in intelligence and a couple of them might pass for bright normal.

There are two who simply should be expelled immediately: Mo Brooks, R AL-05, [3] and Madison Cawthorn, R NC-11. These bastards spoke at Trump’s incitement rally and encouraged the assembled mob to action. There’s video. We know what they said, we know what they meant, and we know what happened. If Speaker Pelosi can ask the House to impeach Trump for his incitement based solely on what he said, what he meant and what happened, why can’t she summon the anger and grief we all feel and throw those anti-democratic shits out of the House?

St. Louis representative Cori Bush is calling for the investigation and expulsion of any representatives who objected to election certification, saying their actions lead to the Capitol riots that cost five people their lives.

Compare the aggressive action of the Freshman Congresswomen with elderly Senator Ben Carden D-MD. On January 16 on CNN Carden said expelling these seditionists was up to the voters in their states.

Insurrection Be Damned: Congress’s Session Resumed

Let me say up front I’m mentally and emotionally fried. Watching idiotic Trumpist traitors trashing the Capitol Building while depriving a majority of the country of their elected representatives’ honest services just plain sucks.

It’s theft conducted under our noses. Not of an election, because the election is done and the results are known, having been certified by all 50 states and a lack of evidence of voter fraud produced in at least 59 lawsuits contesting the election.

No, the theft was of our time and energy today, our faith in government, and the effort of our elected officials who we are paying to perform specific tasks today as outlined in the Constitution. These poorly-educated, overgrown, mouth-breathing brats stole from us because they are unable to get their way, because they’ve been unwilling to organize and persuade other Americans to join their cause and elect their candidate.

But after their pointless tantrum incited by their equally idiotic leader, they’ve fled the Capitol Building. It’s been swept by the FBI and Congress has resumed their work under Article II, Section 1:

The Electors shall meet in their respective States, and vote by Ballot for two Persons, of whom one at least shall not be an Inhabitant of the same State with themselves. And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List they shall sign and certify, and transmit sealed to the Seat of the Government of the United States, directed to the President of the Senate. The President of the Senate shall, in the Presence of the Senate and House of Representatives, open all the Certificates, and the Votes shall then be counted. The Person having the greatest Number of Votes shall be the President, if such Number be a Majority of the whole Number of Electors appointed; and if there be more than one who have such Majority, and have an equal Number of Votes, then the House of Representatives shall immediately chuse by Ballot one of them for President; and if no Person have a Majority, then from the five highest on the List the said House shall in like Manner chuse the President. But in chusing the President, the Votes shall be taken by States, the Representation from each State having one Vote; A quorum for this Purpose shall consist of a Member or Members from two thirds of the States, and a Majority of all the States shall be necessary to a Choice. In every Case, after the Choice of the President, the Person having the greatest Number of Votes of the Electors shall be the Vice President. But if there should remain two or more who have equal Votes, the Senate shall chuse from them by Ballot the Vice President.

The Senate has now voted to certify the election results for a number of states. Of the original 13 senators who planned to vote against certification, only six refused to certify the election conducted in Arizona.

They are Senators Cruz (R-TX), Hawley (R-MO), Hyde-Smith (R-MS), Kennedy (R-LA), Marshall (R-KS), and Tuberville (R-AL). Many on Twitter are calling them the “Seditious Six.” There may be more joining their ranks as the Senate continues to debate and certify more state election results.

The House is still in debate; there are some doozies offered up from the likes of Matt Gaetz who in his floor speech claimed Antifa had stormed the Capitol Building today.

I do hope Gaetz calls the family of the Trump supporter who was shot and killed today at the Capitol to explain his conspiracy theory. Maybe he can justify her death.

Rumors continue that administration officials are looking into invoking the 25th Amendment to remove Trump due to his inability to do his job. Trump had refused earlier to call up federal resourced to push back the mob and protect Congress; Pence eventually ordered the National Guard to deploy. This may have convinced the unnamed officials more action should be taken but as of an 11:14 p.m. report in The Hill, VP Pence had yet to be approached about the 25th.

The National Association of Manufacturers had already sent a letter encouraging Pence to use the 25th Amendment. The House Judiciary Committee Democrats sent a letter to Pence asking him to pursue the 25th Amendment. It’s doubtful this is enough pressure to persuade Pence and a necessary critical mass of cabinet secretaries or acting heads of cabinet level functions to take action.

Two governors have called for Trump’s removal, and both Twitter and Facebook have placed Trump’s social media accounts on short-term suspension due to his tweeting inciting content violating terms of service. Facebook-owned Instagram, Google’s YouTube, and Snapchat have also removed some of Trump’s inciting content and/or placed his account in suspension.

And of course there are calls for impeachment, many from the Democratic Congressional Caucus. Speaker Pelosi probably won’t budge until she believes a clear majority in the Senate would vote to convict and remove Trump if Pelosi were able to rally the House to impeach.

So the House slogs on into the night toward certification of the election. It’s not clear what time exactly the vote will take place, only that Pelosi is committed to working through the night to make it happen.

We’ll continue to feel frustrated like former Obama administration official Ben Rhodes, who said, “If you don’t impeach and remove a President for staging a coup, what’s the point of impeachment.”

We’ll continue to be annoyed by the minimization of Trump’s sedition by moderate Democrats like Sen. Carper:

But we aren’t going to give up. We are a majority who believe in this democracy, many of us in spite of how badly it has treated us and our forebears under white supremacy.

We’re going to remember while we wait that as angry as this situation makes us — watching white supremacists trash the Capitol while noting how little action law enforcement has taken against them — there are Americans who are completely invested in keeping our democracy for us.

But Congress may by a vote of two-thirds of each House, remove such disability.

Kick his ass out the door. He doesn’t believe in the Constitution and already failed the oath of office.

Sedition in Progress: U.S. Senate in Lockdown [UPDATE-9]

Trump-supporting protesters breached the U.S. Capitol building where the joint session of Congress had been underway.

The Senate has been gaveled out and members of Congress evacuated along with VP Mike Pence.

The protesters have now halted and delayed the execution of Article II Section 1 of the Constitution, during which Congress turns over to the President of the Senate — the Vice President of the United States — the certified results of the elections in each of their states for ceremonial acknowledgment of the presidential election’s results.

In short, Trump supporters are engaged in rebellion, insurrection, and seditious conspiracy inside the U.S. Capitol building.

This coup attempt isn’t over.

Trump incited this and he’s encouraging it with neglect. There’s no sign Trump has done anything to call up additional security personnel like former AG Bill Barr did this summer to protect Trump during his ridiculous photo op.

The joint session was still in debate as the video above shows. The session was gaveled out about 2:15 PM ET.

And then Trump tweeted this:

When Congress reconvenes it should immediately move to impeach and then remove Trump from office.

He has failed to uphold his oath of office by obstructing the Constitutional duties of Congress and its President Pro Tempore, by inciting rebellion, insurrection, and sedition.

At least the FBI SWAT team is now in the building, though specific location details aren’t being shared.

I guess we’re back to watching for the joint session to re-gavel into order though it will only happen after the building has been cleared. There have been claims members of the mob will continue hide out and remain in the building as long as possible.

By the time the president strengthened his calls for cooperation with the police, his protesters, many of whom were armed and had not passed through a metal detector, had already broken through a police barricade and entered the Capitol’s Statuary Hall. An improvised explosive device was found on the Capitol grounds, NBC News reported, and at least two IED’s were discovered on the 300 and 400 block of Canal St., according to a law enforcement document obtained by Yahoo News.

In his statement to the public this afternoon, Joe Biden said today’s events “borders on sedition.”

What Trump did with his continuing incitement, including his most recent statement to his supporters, was sedition. No toeing the border. He incited rebellion and insurrection to delay and obstruct Constitutional duties of Congress.

As a result of this lawlessness, someone has died.

Congress, impeach and remove Trump before he can do any more damage. Again, he’s literally not doing his job.

Why did Pence have to give the order after having been whisked off the Senate floor??
