The Network Effect: The 3%ers Incitement, Terrorist Enhancements, and California’s Anti-Maskers

At a hearing for Danny Rodriguez on August 31, Judge Amy Berman Jackson asked, as she had in the last hearing, why Rodriguez wasn’t included in the indictment with a bunch of other men who, like him, are accused of assaulting Michael Fanone, a case over which she is also presiding. As also happened in that last hearing, ABJ asked about a plea offer. In July, AUSA Kimberly Paschall said Rodriguez might not be offered a plea deal at all. On Tuesday, Paschall said he would only be offered a plea deal if he were willing to be debriefed first, prosecutor’s jargon meaning that someone will only be permitted to plead guilty if he cooperates against others. Paschall also said that any plea would necessarily include the 18 USC 1361 charge against Rodriguez for breaking a window because it carries a terrorism enhancement. When prompted by Rodriguez’ attorney (who sourced her intelligence to Twitter), Paschall admitted there may be a superseding indictment against Rodriguez, widely assumed to be some kind of conspiracy indictment with other extremists from Southern California.

As HuffPo reported in February (relying heavily on the work of online researchers including Deep State Dogs), before his arrest Rodriguez was a well-known participant in a group of Southern California anti-maskers, one who had been reported for assault even before boarding a plane to DC in January.

Rodriguez, who goes by “Danny” and “DJ,” is well known among Trump supporters in the Los Angeles area as a superfan of the former president. Multiple news outlets have featured him in their coverage of the local pro-Trump movement in recent years, in articles that included his name and photo. He regularly attended the weekly Trump rallies in Beverly Hills last year. He was recognizable there by his dark-rimmed glasses and the many distinctive pins on his hat, which has a big GOP elephant symbol on the brim.

Rodriguez coordinated with other members of this network — including Gina Bisignano — while at the riot.

What Paschall basically admitted in Tuesday’s hearing is that DOJ intends to hold Rodriguez accountable as a terrorist, possibly in conjunction with his network of right wing operatives. But for all the reports (on Twitter) about network members flipping on each other, the network of extremists still manages to sow violence in front of the LAPD with impunity.

There are other public signs, however, that DOJ is going after this network. In June, DOJ rolled out a conspiracy indictment against six Three Percenters, including Alan Hostetter and Russell Taylor. In spite of explicit threats of execution detailed in it, it doesn’t include a crime of terrorism like the one charged against Rodriguez. While the Three Percenter ties, the plans to come to DC armed, and the defendants’ role in a January 5 Stop the Steal rally attracted a lot of attention, the import of a Telegram channel described in it got less focus.

On January 1, 2021, [Russ] TAYLOR created a Telegram chat called “The California Patriots-DC Brigade” (the “DC Brigade”) and invited other individuals to join. TAYLOR, HOSTETTER, WARNER, KINNISON, MARTINEZ, and MELE all joined, along with more than 30 others.

In the “about” section that described the purpose of the DC Brigade group, TAYLOR wrote:

This group will serve as the Comms for able bodied individuals that are going to DC on Jan 6. Many of us have not met before and we are all ready and willing to fight. We will come together for this moment that we are called upon.

In a series of messages on January 1, 2021, TAYLOR further explained the purpose of the group. In one message, he explained: “This thread is exclusive to be utilized to organize a group of fighters to have each other’s backs and ensure that no one will trample on our rights. Also, if there is key intel that we need to be aware of tor [sic] possible threats.” He added: “I am assuming that you have some type of weaponry that you are bringing with you and plates as well.” TAYLOR also asked members to identify if they had previous law enforcement experience, military experience, or “special skills relevant to our endeavors,” as well as the planned date and time of their arrival in D.C.

There were 36 people in this thread and DOJ may have arrested just 4 before this conspiracy charge, leaving at least 26 others who participated in a channel about coming armed to the Capitol still out there.

In recent days (close to three months after the conspiracy indictment), DOJ has started arresting those participants. On August 26, for example, DOJ arrested Jeffrey Scott Brown on charges of assault, civil disorder, and trespassing based in part on him spraying an irritant at the police.

The government cited Brown’s participation in Taylor’s Telegram channel to substantiate pre-meditation for his violence.

During the course of the investigation into the events of January 6, 2021, law enforcement has identified communications that documented planning and coordination amongst individuals in advance of January 6, 2021. As detailed below, the investigation has established that JEFFREY SCOTT BROWN participated in a Telegram group chat on an encrypted messaging app in the days leading up to January 6. In the Telegram chat “about” section was the following description: “This group will serve as the Comms for able bodied individuals that are going to DC on Jan 6. Many of us have not met before and we are all ready and willing to fight. We will come together for this moment that we are called upon.”

One of the members of this chat was Telegram user “JB” (UID XXXXXX1832). On January 5, 2021, at approximately 6:30 a.m. PST, Telegram user “JB” posted a picture of himself with the caption “Boarding LAX.” LAX is the airport code for the Los Angeles International Airport.

Yesterday, another of the participants on Taylor’s Telegram channel, Ben Martin, was arrested for his sustained efforts to get and keep the North doors of the Capitol open.

Among the pictures of Martin included in his arrest affidavit at that North door are some also included in a detention memo for Matthew Klein that depict the Klein brothers, already charged with conspiracy for their efforts to open it.

Martin’s arrest warrant describes Facebook Messenger discussions Martin had with an RT who, like Russell Taylor, publicly called for violence in advance of the riot. That RT invited Martin to a Telegram channel that sounds (except for RT’s boasts about its size) just like The California Patriots-DC Brigade.

A search warrant of the MARTIN Facebook account identified by the tipster revealed that the account was registered as “benjamin.martin.90410.” A review of the account further revealed communications between MARTIN and a Facebook account associated with R.T. Based on a different investigation, R.T. is known to the FBI to have advocated for violence in the lead-up to January 6, organized others to travel to D.C. for January 6 (some of whom participated in the riot at the U.S. Capitol), and to have participated himself in the riot at the U.S. Capitol on January 6. MARTIN’s account contained communications occurring on January 3, 2021, between R.T. and MARTIN through Facebook Messenger in which MARTIN and R.T. discussed traveling to Washington D.C. for January 6, 2021. In the communications, R.T. invited MARTIN to join a Telegram chat for “a group of 200+ California patriots that are going to DC Jan 6,” which MARTIN accepted and joined. On January 6, 2021, MARTIN sent four messages to R.T. that stated, “we need to meet”, “I just spoke to Peggy Hall she said we need to meet”, and “I am in DC as we”, “well” [sic].

Consider what you have in this network:

  • Ties to two militias, the Three Percenters and the Proud Boys
  • Organization based in localized, violent anti-mask activism
  • A direct tie to one of two organized rallies on January 5
  • A Telegram channel tying a group of participants together
  • The use of blowhorns and radios during the riot to maximize impact
  • Taylor’s description of a plan, formulated at least by December 30, to “surround the capital,” followed by Simon’s sustained efforts to open a new front on the North side of it
  • Discussions in advance of executing traitors followed by an assault on Michael Fanone that caused a heart attack
  • By dint of Rodriguez’ damage to a window of the Capitol, a crime of terrorism that can (and Paschall is intent, will) carry a terrorism enhancement

At Tuesday’s hearing, Paschall didn’t seem sure whether they will end up charging Rodriguez in a conspiracy with some of the others (though she said DOJ would likely finalize their decision on that point by October 1). Certainly, it doesn’t seem like local law enforcement in LA is anything but an impediment.

But this network of extremists is a good place to look to understand how the various parts of the riot came together.

There are a lot of people (I’m seeing them all over) who seem to think that DOJ (and Garland, in particular) are moving too slowly/doing too little/asking for very light sentences for 1/6-involved people. They don’t seem to be aware of how much is actually going on. Or that Garland has all of DOJ to manage, not just the parts looking at 1/6. Everything is supposed to get done immediately and all at the same time, in their opinions.

      • joel fisher says:

I think “fine” is a fair word, especially when one considers the very small number of defendants who fail to show up for court. I, for one, have been educated away from my “lock ’em up” view to more of an “innocent until proven guilty and then lock ’em up” attitude. Still, sometimes, the DOJ doesn’t seem very concerned with the Former’s connection with the 1/6 events. Could a jury conclude beyond a reasonable doubt that he wanted to delay the vote and sent a howling mob of droolers over to the capitol to accomplish this end? If regular people are this close to a crime, LE talks to them. Not this time.

      • Chuck M. says:

“Just fine”, if you’re one of us who takes the time to read through this (and if it’s not our “native” tongue, translate).
Right now, on the outside, I believe there’s a growing discontent with the deafening silence. Fine if you think they can wait, and they’re too impatient (or worse, bloodthirsty), but they vote. And they want some reassurance there’s something happening. They want justice. Yesterday. Because in their minds they saw, we all saw, what happened.
I’m not the first to observe that Democrats are their own worst enemy, and I maintain it’s mostly a messaging thing. Why can’t the Dems market themselves the way …say, an auto manufacturer does? Why can’t the DOJ do the same? When there’s silence and apparent inactivity, ideas start to swirl, and loudest in my bubble are the one’s deeply distrustful there will be any justice. The DoJ, as the lawyer For the People isn’t hearing their clients’ discontent.

        • bmaz says:

Screw the uninformed “clients’ discontent”. What you are shilling for is lynch mob justice so that the mob of idiots feel good. No. And it is not DOJ’s job to put on some Dr. Phil like shit show to placate the rubes.

    • BobCon says:

I think a lot of it is rooted in a misunderstanding of what prosecutors do. People want answers to non-criminal aspects of 1/6 that prosecutors will never provide, nor should they.

I think it’s fair to say that other institutions have been hesitant or unfocused in ways that this particular piece of the process has not.

        • BobCon says:

I think they want narratives as well as actions, and I think there are several factors why these narratives aren’t happening.

Part of it is the weakness of traditional generators of narratives, like congressional committees. Part of it is the fracturing and shrinking of traditional channels of information, like TV networks and Time Magazine.

And part of it is the rottenness of the media, which is still able to launch a well coordinated full court press of misinformation on Afghanistan, but stumbles around on the GOP’s campaign against democracy.

There was once a time when you might have expected to FEC to hold public hearings on 1/6 funding, and for the press to go beyond a cursory, jaded, atomic level take on the issue.

There is a breakdown in multiple ways in multiple places, and people are left wishing one of the remaining functional pieces could somehow take it up. It’s not what prosecutors are for, of course.

        • Troutwaxer says:

The problem here is essentially “The media* broke it, the prosecutors get to pick it up.”

          * For “media” you can substitute “Congress,” “the education system,” or whatever piece of reality is, in your view, most broken.

        • FL Resister says:

“And part of it is the rottenness of the media, which is still able to launch a well coordinated full court press of misinformation on Afghanistan, but stumbles around on the GOP’s campaign against democracy.”

Will we have to read about all this as history once perspective is gained? The US public is faced with multiple threats. And the press is not keeping up with the people responsible. I am thinking perhaps executives of major newspapers like The New York Times and Washington Posts are responding to their accountants and being swayed to prefer their own interests rather to those of the people who are supposedly their interest. So there’s that, too.

Still, I resist saying, we are truly effed. I am going to reserve that expression for more pleasurable moments. Instead, I am going to say that the voices I hear and listen to and agree with are going to prevail, because right matters, justice matters, and this is still the United States of America, even though we’ve just been through an ordeal with a serial abuser who has both taken and been taken by the Republicans.

Not going into all that, but I do know that Barr, The Federalist Society, the big donors, Putin, the oligarchs world-wide and China are backing this destabilization of the United States. And Trump is their puppet.

I think the people who are asking what the delay is are concerned about losing the political momentum. This is a valid concern. Without the political momentum, what will be the end of these legal investigations? Pardons?

The contributors to this site are concerned about putting together an enormous number of cases that will hold up at all levels of the courts. This, too, is a valid concern. Without the legal foundation, the cases, to say the obvious, will go nowhere.

These goals are in a conflict with no good, easy resolution that I can see other than the rather weak solution of both of these positions being fully informed by their counterparts. Which is tough judging by what I see in the corporate media.

OT Jacob (“Shaman”) Chansley pled guilty to obstruction today, accepting a recommended 41-51 month sentence. According to his lawyer, Albert Watkins, who sounds like someone you’d want defending you if in trouble, he’s “lost faith” in TFG and recognizes the need to do some “personal work” etc. I know there’ve been 1-2 others who make nice noises like this to try and win gentler sentences, then turn around and start spouting seditious nonsense all over again, but I’m not sure where this chap falls. He always seemed mentally fragile, so maybe he really will be trying to find a new leaf to turn over. Reminds me a bit of the first-person antihero of Philip Dick’s Confessions of a Crap Artist, only more prone to drama. But let me ask the folks here – what does a single guilty plea on obstruction charges do to the case being made (okay, fabricated) by some defense lawyers that there cannot have been obstruction of justice involved in the events of 1/6?

    • MB says:

Jack Isidore lives! Just wonder whether they’ll give Chansley vegetarian food during his 41-51 month sentence, as he made much noise over this after his original arrest.

In the Wikipedia entry for CCA, one line stood out to me as possibly relevant in Chansley’s case:

“When the end of the world doesn’t occur on the predicted date, Jack decides to seek psychiatric assistance”

I’m not as hopeful for the majority of Q’ers and Big Liars out there – someday a massive and difficult de-programming effort will have to take place…

Your background on Joe Biggs and his involvement in the Pizzagate scam and in possibly coordinating with the OnePercenters on 1/6 was informative and enlightening. Per your comment on the show, I hope someone does a deep dive on the ex-military and ex-law enforcement involvement in this attempted coup. Thanks again for your great investigative and intelligence work!

    • KP says:

There also needs to be a real reckoning with the ‘nature’ of ‘law enforcement’ in general (NB: the comment in the above article re the LAPD ‘standing by’ and allowing the radical anti-American, anti-democracy RWNJs to rampage, while themselves rampaging and assaulting generally peaceful groups of pro-American, pro-equal rights demonstrators. (This is endemic, and not only found in the LAPD.) The systemic biases throughout our gestalt of law enforcement requires a very real and thorough reconstruction.
I’m not gonna hold my breath waiting for it.

Vancouver, WA, is across the Columbia River from Portland, OR. More conservative and blue collar, it joins Portland in being at the crossroads of the increasingly violent left-right divide in WA and OR. Most police, it seems, prefer the right and demonstrate that not policing can be just as violent as policing.

This is not an argument over taking reasonable precautions in the face of a global pandemic. This is about a violent pseudo-religious rejection of government and the tribal loyalty needed to sustain it.

Imagine how far gone you have be to plunge into deep prayer, asking “God” to help a student survive wearing a mask in high school – or a self-quarantine, owing to exposure to a virulent contagious virus – and being willing to kidnap and assault a poorly paid school administrator – and neighbor – trying to keep her kids safe.

Interesting read on fascism. Yeah, the problem for modern US reporters is differentiating between what the reason for an event is explicitly vs what the event is about implicitly.

Unfortunately, unless a now journalist themselves have been directly involved in political protests as individuals, not as reporters or tourist protestors, then they likely do not have a good grasp of what may be going on behind the scenes nor how a political movement itself might actually operate to sway public opinion, nor how such a movement might attempt to instill discipline within its ranks, nor how it might be seeking to recruit from the general populace in a directed and specific fashion through a given single issue protest, etc.

Sadly, even if there is a good and knowledgeable reporter covering the scene, the coverage may be wholly or largely dependent on editorial fiat above them when it comes to the coverage and analysis of a protest event or serious of events.

What’s interesting in the past two Presidential elections is seeing the domination of the old ideologies of both parties challenged by outsiders like Sanders and Trump. The relevancy of both of the old party platforms of both seem to have taken some serious hits in recent years—that much is true. Note this exchange w/ Greg Kelly 3 weeks later on 12/17/20.

Kelly mentions “cases on the docket, January 6th, and who knows what can happen?”

        Flynn grins big. /31x
