More Evidence US Views Drone Strikes as Political Retaliation Tool

On the same day that the US and Pakistan formally signed the agreement reopening the NATO supply routes through Pakistan, a piece profiling the US-Pakistan relationship in the New York Times provides further evidence supporting the idea that the US sometimes uses drone strikes as a tool for political retaliation. The retaliatory strikes previously have been stepped up to almost one per day when a particular point is being emphasized.

The entire Declan Walsh and Eric Schmitt piece in today’s Times is worth reading, but I want to focus on the evidence they provide for drone strikes as retaliation. The piece focuses on the Haqqani network and how the perceived ties between them and Pakistan’s ISI complicate the US-Pakistan relationship. At one point in the article, the discussion moves to contingencies the US has considered about what the US would do if the Haqqani network manages to inflict a significant blow against US forces in Afghanistan:

But a new boldness from the Haqqanis that aims at mass American casualties, combined with simmering political tension, has reduced the room for ambiguity between the two countries. Inside the administration, it is a commonly held view that the United States is “one major attack” away from unilateral action against Pakistan — diplomatically or perhaps even militarily, one senior official said.

American officials recently considered what that could mean. Days after the Salerno attack, the White House held a series of interagency meetings to weigh its options in the event of a major success by the Haqqanis against American troops.

The meetings yielded a list of about 30 possible responses, according to a senior official who was briefed on the deliberations — everything from withdrawing the Islamabad ambassador, to a flurry of intensified drone attacks on Haqqani targets in Pakistan’s tribal belt, to American or Afghan commando raids on Haqqani hide-outs in the same area.

Gosh, “a flurry of intensified drone attacks” sounds very familiar. That is exactly what happened last May when Zardari’s visit to the NATO summit in Chicago did not produce the agreement for reopening the supply routes. Retaliatory strikes started almost immediately, with at least four strikes coming within a span of six days.

With the understanding that the US views drone strikes as a retaliation tool, we can watch this week’s visit to Washington by new ISI chief Lieutenant General Zaheer ul-Islam. Islam will visit with David Petraeus and others Wednesday through Friday of this week. Drones are expected to be on the agenda for the meetings:

Lieutenant General Zaheer ul-Islam, who was appointed in March, “will visit USA from 1st to 3rd August. This will be a service-to-service bilateral visit,” the statement said.

“He will meet his counterpart General David Petraeus, director CIA.”

The short statement gave no other details, but a senior Pakistani security official earlier told AFP that the pair would discuss counter-terror cooperation and intelligence sharing.

Islam would also demand an end to US drone attacks against the Taliban and al Qaeda, and again ask for the means for Pakistan to carry out the attacks instead, the security official said.

The US has made it clear multiple times that it will not give up on carrying out drone strikes and that it does not trust ISI enough to bring them closely into the loop when choosing targets or timing for strikes. It seems very likely to me that the US will carry out a strike within the first day or two after the meeting ends, just to send the message to the ISI that the meeting has changed nothing in how the US will operate. If the strike is as reckless as the one that killed a group of 40 who turned out to be mostly civilians on the day after the release of Raymond Davis, then the US could be accused of letting the need for political retaliation move it all the way to blind rage. Another hint in the Times piece tells us that Haqqani leader “Sirajuddin Haqqani surrounds himself with civilians — often women and children — at his base in the town of Miram Shah”. Will the US decide to allow some “collateral damage” to women and children in an attempt to take out Sirajuddin Haqqani as Islam returns to Pakistan from his meeting with Petraeus?

US Wasting Money on Afghanistan Infrastructure While US Infrastructure Continues Decline

Joshua Foust tweeted a link to a story in today’s Washington Post about the most recent report from the Special Inspector General for Afghanistan Reconstruction. Foust’s tweet succinctly summed up the situation: “#SIGAR body slams the war in Afghanistan… again, and no one will probably ever care.” He followed that up with more: “This will destroy you if you dwell on it too much, but the blithe way DC encourages zero memory and zero accountability really is awful.”

Coming on the heels of the exposure of General William Caldwell’s disgusting 2010 coverup of hellish conditions at Afghanistan’s Dawood National Military Hospital in Kabul, it’s hard to see how Foust can be wrong in his pessimism. Where was the outrage over such horrid coniditions? Why is Caldwell still in the military?

The SIGAR report eviscerates the US counterinsurgency strategy that is based on the assumption that building a Western type of “infrastructure” will produce an Afghan populace that develops such adulation for the purveyors of such cultural “improvement” that they will immediately in fall in line with all other desires of the West.

The Post story opens:

A U.S. initiative to spend hundreds of millions of dollars on construction projects in Afghanistan, originally pitched as a vital tool in the military campaign against the Taliban, is running so far behind schedule that it will not yield benefits until most U.S. combat forces have departed the country, according to a government inspection report to be released Monday.

A few paragraphs later, we get more of the explanation of how the strategy was supposed to work:

Many U.S. military commanders, diplomats and reconstruction experts have long believed that large infrastructure projects were essential to fixing Iraq and Afghanistan.

What Was the Evidence Supporting the First Strike on Anwar al-Awlaki?

According to the William Webster report, the FBI’s understanding about Anwar al-Awlaki’s operational role developed only after the UndieBomb attack.

As of January 7 and June 16, 2009, the FBI knew anwar al-Aulaqi was an anti-American, radical Islamic cleric and the subject of a Tier <redacted> FBI counterterrorism investigation. San Diego believed [<redacted> that Aulaqi was [developing ambitions beyond radicalization] <redacted>. WFO viewed him at that time as merely inspirational. The FBI’s full understanding of Aulaqi’s operational ambitions developed only after the attempted bombing of Northwest Airlines Flight 253 on Christmas Day 2009. [72; emphasis mine]

On December 24, 2009–the day before FBI began to understand Awlaki’s operational ambitions–a JSOC strike in Yemen missed Anwar al-Awlaki.

Dana Priest’s report revealing Awlaki was subsequently added to a JSOC kill list, published three days before Umar Farouk Abdulmutallab started cooperating again with the FBI, claims Awlaki was not the target of that December 24, 2009 strike.

As part of the operations, Obama approved a Dec. 24 strike against a compound where a U.S. citizen, Anwar al-Aulaqi, was thought to be meeting with other regional al-Qaeda leaders. Although he was not the focus of the strike and was not killed, he has since been added to a shortlist of U.S. citizens specifically targeted for killing or capture by the JSOC, military officials said. The officials, like others interviewed for this article, spoke on the condition of anonymity because of the sensitivity of the operations. [my emphasis]

But Ali Abdullah Saleh, speaking with David Petraeus three weeks before Priest’s report, sure seemed to treat Awlaki as one of two targets of the strike.

Saleh praised the December 17 and 24 strikes against AQAP but said that “mistakes were made” in the killing of civilians in Abyan. The General responded that the only civilians killed were the wife and two children of an AQAP operative at the site, prompting Saleh to plunge into a lengthy and confusing aside with Deputy Prime Minister Alimi and Minister of Defense Ali regarding the number of terrorists versus civilians killed in the strike. (Comment: Saleh’s conversation on the civilian casualties suggests he has not been well briefed by his advisors on the strike in Abyan, a site that the ROYG has been unable to access to determine with any certainty the level of collateral damage. End Comment.) AQAP leader Nassr al-Wahishi and extremist cleric Anwar al-Awlaki may still be alive, Saleh said, but the December strikes had already caused al-Qaeda operatives to turn themselves in to authorities and residents in affected areas to deny refuge to al-Qaeda. Given that we blamed Saleh for the strike, you have to assume he knew who the targets were. And he seems to suggest that both Wuhayshi and Awlaki were the intended targets.

Judge Kollar-Kotelly Sees No Evil, Hears No Evil

Yesterday, Colleen Kollar-Kotelly upheld the government’s right to withhold cables already released via WikiLeaks under FOIA (see my earlier posts on this FOIA here and here). Her logic seems to have a fatal flaw: she says the State Department has proven (and the ACLU has not rebutted the claim) that the US Government owns the cables.

The ACLU simply offers no rejoinder to the State Department’s affirmative showing that all the information at issue (1) was classified by an original classification authority, (2) is owned, produced, or controlled by the United States, and (3) falls within one or more of the eight relevant categories. [my emphasis]

But then she says (noting that ACLU made no mention that these cables had also been released via WikiLeaks and therefore pretending that they might be different) that the government has not officially acknowledged these cables are authentic.

No matter how extensive, the WikiLeaks disclosure is no substitute for an official acknowledgement and the ACLU has not shown that the Executive has officially acknowledged that the specific information at issue was a part of the WikiLeaks disclosure.

I guess they should let Bradley Manning go free, then, since the State Department isn’t prepared to say the cables he is accused of leaking were authentic?

But that’s not the most troubling part of this ruling. As I lay out below–and as Kollar-Kotelly presumably knows well–the cables are full of admissions of crime, including murder, torture, and kidnapping. Thus, had she reviewed them to see whether the government’s claims that they were properly classified are valid, she would have seen that–in addition to information properly classified to protect foreign relations–a lot of the original classification and the government’s refusal to officially release them (which would presumably make them admissible in a court) serve to hide confessions of criminal activity.

So Kollar-Kotelly chose not to review these cables in camera, choosing instead to rely on the State Department declaration that makes no mention of the criminal admissions included in the cables.

In this case, because the State Department’s declarations are sufficiently detailed and the Court is satisfied that no factual dispute remains, the Court declines to exercise its discretion to review the embassy cables in camera.

It was a cowardly ruling. But all the more cowardly, given that Kollar-Kotelly prevented herself from officially reviewing a bunch of evidence of criminal wrong-doing.

The famous meeting at which Ali Abdullah Saleh promised to lie about our strikes in Yemen

Kollar-Kotelly agreed to keep what has become perhaps the most famous cable ever, in which David Petraeus and Ali Abdullah Saleh discuss the missile strikes we conducted in Yemen in late 2009.

Mind you, the government likely has a very good legal reason to keep this cable secret. The cable makes it clear we were targeting Anwar al-Awlaki (as well as Nasir al-Wuhayshi) in those strikes. And releasing that would constitute official acknowledgement of the targeting of Awlaki that the government has tried so hard to avoid. Furthermore, as I’ll show in a follow-up post, it also shows that we targeted Awlaki for death before we had evidence implicating him in a crime.

The General Must Have Pineapple

About a month ago, I bought a pineapple from Costa Rica at Meijers. It was over 5 pounds and cost something like $1.50.

The fruit was lovely. But the price got me thinking about how pineapple has become one of those things in globalization that must be too good to be true. If they can grow, ship to Michigan, and market a 5 pound pineapple to me for just $1.50, then someone–probably multiple someones, but especially the people harvesting these heavy, spiny footballs–aren’t getting paid nearly enough to bring me my pineapple (to say nothing of the invisible subsidies shipping must include).

Pineapples used to be a $7 delicacy everywhere but the most expensive hotels but now, with globalization, they’ve become cheap and easy.

Which is why, after having a great laugh at the list of demands David Petraeus makes on CIA stations around the world when he visits, I also got cranky.

Among the items:

  • Fresh pineapple each night before he goes to bed (not canned)
  • Sliced bananas for his cereal in the morning
  • Someone to accompany him on his morning runs, and a route devised that preferably avoids crossing any streets.
  • Also, he noted, the former General doesn’t open doors. “All doors have to be open when he arrives,” the former senior CIA officer said.

It appears the war hero can’t keep up his legendary running pace if he has to cross streets like normal people (though I agree the CIA Director should be accompanied on his runs lest he end up in a gym bag somewhere). But it’s the comment one of Laura’s sources makes, that Petraeus demands that CIA personnel in places like Tblisi and Helsinki–where pineapple isn’t at the Meijers for $1.50–bring him that pineapple every day in any case that brought back my $1.50 pineapple.

It seems appropriate, I guess, that Petraeus demands what to me has become a symbol of too good to be true globalization rather than make do with whatever local fruit is available, like berries in Helsinki. We can’t have our CIA Directors interacting with the unique spots they visit in such a way that they develop an understanding of the place. Better to rely on the underpaid laborers in Costa Rica and the harried office workers at the station to ensure you have a generic, now cheapened pineapple every day.

Obama’s Signature

Obama’s signature national security policy may well be the embrace of signature strikes. First in Pakistan–until they killed 38 civilians in Shiga, Pakistan, and had to rethink the strategy–and now, according to the WSJ, in Yemen.

The Obama administration has given the Central Intelligence Agency and U.S. military greater leeway to target suspected al Qaeda militants in Yemen with drones, responding to worries a new haven is being established from which to mount attacks on the West.

Mind you, the anonymous sources in this story claim this is “signature lite.” Targets need to fit the profile of High Value Targets, sources claim, to be targeted.

But Obama’s (IMO) ill-considered decision is not the most interesting part of this story.

Rather, it’s a detail that directly contradicts with the WaPo’s version of this story (besides the timing, which also suggested the decision had not yet been made, though it may have been made since). The WaPo said JSOC wasn’t all that interested in having these authorities.

The JSOC has broader authority than the CIA to pursue militants in Yemen and is not seeking permission to use signature strikes, U.S. officials said.

WSJ says JSOC did ask.

The CIA and JSOC asked last year for broader targeting powers, however, which would include leeway to conduct what are known as “signature strikes,” in which targets are identified based on patterns of behavior, such as surveillance showing they are transporting weapons.

Recently the CIA and JSOC, citing the fears about an al Qaeda haven, renewed requests to the White House.

Perhaps the most interesting bit, though, is this backwards discussion of how you need to use signature strikes to avoid border incursions against a legitimate defensive issue.

U.S. counterterrorism officials said they are currently tracking several direct threats to the U.S. connected to AQAP. The officials wouldn’t provide further details because that information is classified.

Administration officials said the White House has no plans to allow strikes in Yemen to be as broad as those in Pakistan. CIA strikes against low-level fighters in Pakistan’s Federally Administered Tribal Areas, or FATA, are meant to prevent them from crossing the border into neighboring Afghanistan, where they are waging an insurgency against U.S. and Afghan forces.

“This is distinct from the FATA,” a senior administration official said of Yemen. “We’re using these tools judiciously and carefully to scope this as a counterterrorism effort and not an all-out counter-insurgency campaign.”

Granted, US sources claim that this use of signatures is different than the FATA and Pakistan. But given that I suspect the Saudis may be dictating this change to us, I’m rather interested in the suggestion that border incursions present the need to use signature strikes.

Because these are, after all, happening across the border from the Saudis.

Is It the CIA–or the Saudis–Who Want Signature Strikes in Yemen?

This is, IMO, the most telling line in this entire article on the CIA’s request to use the signature strikes in Yemen that proved so problematic in Pakistan:

The JSOC has broader authority than the CIA to pursue militants in Yemen and is not seeking permission to use signature strikes, U.S. officials said.

After all, in Pakistan, where only the CIA flies drones, David Petraeus has sharply limited the use of signature strikes. But in Yemen, where both JSOC and CIA fly drones (and operate on the ground), JSOC sees no need but Petraeus does.

Consider what that means in conjunction with this:

The CIA, the National Security Agency and other spy services have deployed more officers and resources to Yemen over the past several years to augment counterterrorism operations that were previously handled almost exclusively by the U.S. Joint Special Operations Command.

The CIA began flying armed drones over Yemen last year after opening a secret base on the Arabian Peninsula. The agency also has worked with the Saudi and Yemeni intelligence services to build networks of informants — much the way it did in Pakistan before ramping up drone strikes there.

That is, these signature strikes would be operating from a base in Saudi Arabia (or is it in Oman), with informants developed, in significant part, by the Saudis (ya think)? And this authority, if granted, would permit the killing of people whose identities the CIA did not know.

The Saudis have, in the past, asked for Predator drones specifically so they could use them to attack the Houthi rebels in Yemen. They have blamed the Houthis and other unrest in Yemen on Iran, their rival for hegemony in the Middle East. At least according to what the Yemenis claimed to their Parliament, Saudi intelligence was involved in the disastrous strike on al-Majalah.

Now maybe this crazed plan wasn’t dreamed up by the Saudis.

But it sure sounds like a backdoor way for the Saudis to access control over drones and their targets in Yemen, without the CIA double-checking their work.

Mind you, the article suggests that even former CIA Saudi station chief John Brennan is likely to oppose this idea.

The CIA might be able to replicate that success in Yemen, the former intelligence official said. But he expressed skepticism that White House officials, including counterterrorism adviser John O. Brennan, would approve the CIA’s Yemen request.

So maybe I’m completely wrong that this is a way to give the Saudis more control.

Still. There are a lot of other reasons this is a terrible idea, many of them readily apparent just from the many contradictions in this piece. But the degree to which it outsources more control of our already counterproductive drone program to the Saudis is certainly one big reason, IMO, why it’s a terrible idea.

Update: Since I’m talking about Saudi Arabia’s interests in Yemen, I ought to point out this news.

On March 28, a Saudi diplomat named Abdullah al Khalidi was kidnapped by al Qaeda in the Arabian Peninsula (AQAP) in the port city of Aden, Yemen. AQAP’s gunmen captured al Khalidi, who served as Saudi Arabia’s deputy consul in Aden, as he was getting into his car outside of his residence.

Sometime thereafter the Saudi embassy in Sanaa received a call from an ex-Guantanamo detainee named Mishaal Mohammed Rasheed al Shadoukhi. According to Saudi government sources cited by Asharq Al Awsat, al Shadoukhi assured the Saudi ambassador to Yemen, Ali Al Hamdan, that al Khalidi was “fine and in good health.”

Al Shadoukhi issued several demands, including the “release of all female prisoners” who are in Saudi custody and connected to al Qaeda, the release of various other detainees held by Saudi authorities, and a ransom payment that is to be negotiated.

Al Shadoukhi also told the ambassador that the Saudis could send an emissary to Jaar, a southern Yemeni town controlled by al Qaeda and its allies, if they want to discuss al Khalidi’s “case” with his kidnappers further.

Al Shadoukhi is one of the many Saudis who went through “deradicalization”–a process which seems to have resulted in some double agents and some people aware that the Saudis were recruiting double agents.

Saleh: “I have given you an open door on terrorism, so I am not responsible.”

In a meeting on September 6, 2009–at a time when Umar Farouk Abdulmutallab was already in Yemen, seeking Anwar al-Awlaki–President Ali Abdullah Saleh assured John Brennan that the US Government had unfettered access in Yemen for counterterrorism efforts, but with that bore all responsibility in case of an attack on US targets.

(S/NF) In a September 6 meeting with Deputy National Security Advisor John Brennan, President Saleh insisted that Yemen’s national territory is available for unilateral CT operations by the U.S. Dissatisfied with current levels of USG funding and military training provided to the ROYG’s CT forces, Saleh asserted that the USG has produced “only words, but no solutions” to the terrorism issue in Yemen. Saleh repeatedly requested more funds and equipment to fight al-Qaeda in the Arabian Peninsula (AQAP), while at the same time placing responsibility for any future AQAP attacks on the shoulders of the USG now that it enjoys unfettered access to Yemeni airspace, coastal waters and land. (NOTE. The USG has been actively engaged since 2001 in training elements of Yemen’s CT forces, including the Counter-Terrorism Unit (CTU), the Yemen Special Operations Force (YSOF), the Presidential Guard, the Yemeni Border Troops, Yemen Air Force (YAF), and the Yemen Coast Guard (YCG). The USG has expended over $115 million equipping CT forces since FY02. In 2009 alone, U.S. teams have instructed Yemeni CT forces in training valued at $5 million. END NOTE.)

(S/NF) While Saleh offered assurances that the ROYG is “determined to continue the war against al-Qaeda because they’re targeting U.S. and Yemeni interests,” he continued to link increased U.S. access to AQAP targets with full responsibility for achieving CT goals. Highlighting the potential for a future AQAP attack on the U.S. Embassy or other Western targets, Saleh said, “I have given you an open door on terrorism, so I am not responsible.” [my emphasis]

The public availability of the cable reporting this conversation is just one of the things that makes ACLU’s (with CCR) FOIA of details on the December 17, 2009 missile strike in Yemen so interesting.

Is the “Roger” Profile Yet Another InfoOp in Support of Signature Strikes?

Greg Miller got a lot of buzz this weekend for his profile of the head of CTC, whom he calls “Roger.” The article is in no way unbalanced–Miller makes it clear that Roger is an asshole and suggests he might bear some responsibility for the Khost bombing.

But I couldn’t help but wonder whether the story was another in a series of articles designed to pressure David Petraeus to resume signature strikes–those drone strikes that target a pattern rather than an individual high level target.

After all, the article ends by conflating a description of Roger’s effort to push signature strikes with Osama bin Laden’s killing.

“He came in with a big idea on a cold, rainy Friday afternoon,” said a former high-ranking CIA official involved in drone operations. “It was a new flavor of activity, and had to do with taking senior terrorists off the battlefield.”

The former official declined to describe the activity. But others said the CTC chief proposed launching what came to be known as “signature strikes,” meaning attacks on militants based solely on their patterns of behavior.

Previously, the agency had needed confirmation of the presence of an approved al-Qaeda target before it could shoot. With permission from the White House, it would begin hitting militant gatherings even when it wasn’t clear that a specific operative was in the drone’s crosshairs.

Roger’s relentless approach meshed with the Obama mind-set. Shortly after taking office, Obama met with his first CIA director, Leon E. Panetta, and ordered a redoubled effort in the fight against al-Qaeda and the search for the terrorist group’s elusive leader.

From 53 strikes in 2009, the number soared to 117 in 2010, before tapering off last year.

The cumulative toll helped to crumple al-Qaeda even as CTC analysts finally found a courier trail that led them to bin Laden’s compound in Abbottabad, Pakistan.

Yet it somehow neglects to mention why the signature strikes tailed off: because last March’s Shiga strike–launched over our Ambassador to Pakistan, Cameron Munter’s, objections in the days after the Raymond Davis release, and killing a significant number of civilians set off an extended debate in the Administration over the relative value of the signature strikes. The debate ended by giving newly confirmed CIA Director Petraeus final say over signature strikes, which has resulted, thus far, in a move away from their use.

Drones Killing Fewer Civilians, But Still Killing Diplomacy

In an article describing how our use of drones in Pakistan continues to mobilize public opinion against US involvement, the NYT includes this description of how militants claim to be limiting the efficacy of some drone strikes.

During an interview last month in Shawal, a thickly-forested district of plunging valleys that became a haven for Al Qaeda after 2001, a senior Taliban commander, Wali ur-Rehman, ordered his fighters to scan a newly arrived car with a camcorder. Mr. Rehman explained that the camera could somehow detect otherwise invisible signals from the “patrai” — local slang for small electronic tracking devices that, many tribesmen believe, guide American missiles to their target.

“This is our new weapon,” said Mr. Rehman, who has a $5 million United States government bounty on his head, pointing to the Sony camera. “It has saved a lot of lives.”

Whether that was true is unclear, although a former C.I.A. official confirmed that the agency does use tracking devices to identify targets. Either way, Mr. Rehman’s camcorder served a gruesome secondary purpose: recording the last testimony of tribesmen accused of spying for the United States, dozens of whom have been tortured and executed.

That is, the Taliban have developed some way to scan for locally applied sensors the drones use to assist targeting. And–the NYT suggests but doesn’t say explicitly–those found assisting in targeting with those sensors have, in the past, been treated as spies for the CIA (though the story notes that the Taliban has backed off executing such people after concern about some innocent deaths).

That’s one change in drone warfare, it seems. Though I’m struck by NYT’s thin coverage of another: David Petraeus’ new targeting rules. It notes the increasing precision of the drone strikes.

Accounts of civilian casualties play a major role in Pakistani anger toward the drones. An extraordinary claim by President Obama’s top counterterrorism adviser, John O. Brennan, last June that there had not been “a single collateral death” over the previous year drew an indignant response. The Bureau of Investigative Journalism, which monitors the toll, counted “credible media accounts” of between 63 and 127 nonmilitant deaths in 2011, and a recent Associated Press investigation found evidence that at least 56 villagers and tribal police had been killed in the 10 largest strikes since August 2010. But analysts, American officials and even many tribesmen agree the drones are increasingly precise. Of 10 strikes this year, the local news media have alleged civilian deaths in one case. The remainder of those killed — 58 people, by conservative estimates — were militants.

And notes the Administration debate that resulted in changed drone rules.

The pace has relented, with 64 strikes recorded in 2011, down from 117 in 2010, according to the Long War Journal, a Web site that closely monitors the strikes. A lively debate inside the Obama administration last summer gave the State Department greater say in the strikes. The final say, however, still rests with David H. Petraeus, the C.I.A. director.

But it doesn’t talk about one of the key reasons why the revised targeting has resulted in fewer civilian casualties: the move away from “signature strikes” which target patterns of behavior rather than named targets. Here’s how the WSJ described the change in a seminal article from last year.
