Benghazi: A Poster Child for Covert Ops Blowback

You’ve no doubt heard that, last Friday (a pre-holiday Friday, as some people are already on their way to Thanksgiving), the Benghazi scandal ended with a fizzle.

The House Intelligence Committee released its report on the Benghazi attack, which basically says all the scandal mongering has been wrong, that Susan Rice’s talking points came from the CIA, that no one held up any rescue attempts, and so on and so on. This post will attempt to lay out why that might have happened. The short version, however, is that the report reveals (but does not dwell on) a number of failures on the part of the CIA that should raise real concerns about Syria.

Note that not all Republicans were as polite as the ultimate report. Mike Rogers, Jeff Miller, Jack Conaway, and Peter King released an additional views report, making precisely the points you’d expect them to — though it takes them until the 4th summary bullet to claim that Administration officials “perpetuated an inaccurate story that matched the Administration’s misguided view that the United States was nearing victory over al-Qa’ida.” Democrats released their own report noting that “there was no AQ mastermind” and that “extremists who were already well-armed and well-trained took advantage of regional violence” to launch the attack. Among the Republicans who presumably supported the middle ground were firebrands like Michele Bachmann and Mike Pompeo, as well as rising Chair Devin Nunes (as you’ll see, Nunes was a lot more interested in what the hell CIA was doing in Benghazi than Rogers). The day after the initial release Rogers released a second statement defending — and pointing to the limits of and Additional Views on — his report.

Now consider what this report is and is not.

The report boasts about the 1000s of hours of work and 1000s of pages of intelligence review, as well as 20 committee events, interviews with “senior intelligence officials” and 8 security personnel (whom elsewhere the report calls “the eight surviving U.S. personnel”) who were among the eyewitnesses in Benghazi. But the bulk of the report is sourced to 10 interviews (the 8 security guys, plus the Benghazi and Tripoli CIA Chiefs), and a November 15, 2012 presentation by James Clapper, Mike Morell, Matt Olsen, and Patrick Kennedy. (Here are  the slides from that briefing: part onepart two.) As I’ll show, this means some of the claims in this report are not sourced to the people who directly witnessed the events. And the reports sources almost nothing to David Petraeus, who was CIA Director at the time.

The FBI analyzed the intelligence better than CIA did

One of the best explanations for why this is such a tempered report may be that FBI performed better analysis of the cause of the attack than CIA did. This is somewhat clear from the summary (though buried as the 4th bullet):

There was no protest. The CIA only changed its initial assessment about a protest on September 24, 2012, when closed caption television footage became available on September 18, 2012 (two days after Ambassador Susan Rice spoke), and after the FBI began publishing its interviews with U.S. officials on the ground on September 22, 2012.

That is, one reason Susan Rice’s talking points said what they did is because CIA’s analytical reports still backed the claim there had been a protest outside State’s Temporary Mission Facility.

Moreover, in sustaining its judgment there had been a protest as long as it did, CIA was actually ignoring both a report from Tripoli dated September 14, and the assessment of the Chief of Station in Tripoli, who wrote the following to Mike Morell on September 15.

We lack any ground-truth information that protest actually occurred, specifically in the vicinity of the consulate and leading up to the attack. We therefore judge events unfolded in a much different manner than in Tunis, Cairo, Khartoum, and Sanaa, which appear to the the result of escalating mob violence.

In a statement for the record issued in April 2014, Mike Morell explained that Chiefs of Station “do not/not make analytic calls for the Agency.” But it’s not clear whether Morell explained why CIA appears to have ignored their own officer.

While the report doesn’t dwell on this fact, the implication is that the FBI was more successful at interviewing people on the ground — including CIA officers!! — to rebut a common assumption arising from public reporting. That’s a condemnation of CIA’s analytical process, not to mention a suggestion FBI is better at collecting information from humans than CIA is. But HPSCI doesn’t seem all that worried about these CIA failures in its core missions.

Bengh– Blackwater!

You should definitely read the James Risen story describing how the head of Blackwater’s operations in Iraq threatened to kill an investigator into the company’s practices in the period before the Nisour Square. It definitely confirms every concern that has been raised about mercenaries generally and Blackwater specifically.

But I want to look at the frame Risen gave the story, which I suspect few will read closely.

His memo and other newly disclosed State Department documents make clear that the department was alerted to serious problems involving Blackwater and its government overseers before the Nisour Square shooting, which outraged Iraqis and deepened resentment over the United States’ presence in the country.

Condoleezza Rice, then the secretary of state, named a special panel to examine the Nisour Square episode and recommend reforms, but the panel never interviewed Mr. Richter or Mr. Thomas.

Patrick Kennedy, the State Department official who led the special panel, told reporters on Oct. 23, 2007, that the panel had not found any communications from the embassy in Baghdad before the Nisour Square shooting that raised concerns about contractor conduct.

“We interviewed a large number of individuals,” Mr. Kennedy said. “We did not find any, I think, significant pattern of incidents that had not — that the embassy had suppressed in any way.”

The reason this is coming out — aside from the fact the government is trying to try the Nisour Square killers again — is to show that contrary to what Patrick Kennedy said after having done a review of security practices in 2007, there had been a pattern of incidents, and they had been suppressed by the Embassy.

Now consider how that reflects on the GOP’s second favorite scandal, Benghazi. Not only was Kennedy the key judge about the events leading up to that event (which is normal — he’s been a key player in State for a very long time; I’m beginning to believe he’s State’s institutional defender in the same way David Margolis was at DOJ), but the question of security oversight is important there: Blue Mountain Group appears to have done its job inadequately (and there are some sketchy things about its contract and contractors).

Benghazi is actually not a bigger scandal than that State suppressed knowledge of Blackwater’s problems. But there does seem to be continuity.

Two Years after Missing Abdulmutallab because of a Spelling Variance, Government Missed Tsarnaev because of a Spelling Variance

On the Sunday shows yesterday, House Intelligence Chair Mike Rogers suggested that the government missed Tamerlan Tsarnaev’s trip to Russia in 2012 because he used an alias. This morning, Lindsey Graham explained that the problem was slightly different. Tamerlan’s travel documents misspelled his name.

“He went over to Russia, but apparently, when he got on the Aeroflot plane, they misspelled his name,” Graham, a South Carolina Republican said on Fox television this morning. “So it never went into the system that he actually went to Russia.”

Graham, a member of the Armed Services Committee, said in answer to a follow-up question that he did not know whether Tsarnaev, the 26-year-old terrorist suspect who died early Friday following a shootout with law enforcement, had misspelled his name on purpose.

The FBI “said Aeroflot gave us the information” that Tsarnaev had traveled there, Graham said, though he did not specify when that occurred.

Now, Lindsey doesn’t appear to know whether misspelling was the government’s or Aeroflot’s fault or Tamerlan’s deceit. Assuming Lindsey’s right about the larger point, whatever the source, a misspelling suggests a very different issue than an outright alibi (which would raise questions about the documents Tamerlan used, rather than the tracking of those documents).

Update: At the very end of the Senate Judiciary Committee Immigration hearing, Chuck Schumer said the error arose from Aeroflot typing in Tamerlan’s name incorrectly, so it appears it was not an attempt to deceive by Tamerlan.

Two years before Tsarnaev departed for Russia in January 2012, the government spent a good deal of time reviewing what prevented the government from responding to the several warnings about Umar Farouk Abdulmutallab, the UndieBomber, to prevent him from traveling to the country. One of the problems (though by no means the most serious one), was that the cable conveying warnings from Abdulmutallab’s father spelled his name wrong.

As was widely reported within hours of the failed bombing attempt, Abdulmutallab’s father—a former Nigerian government minister and prominent banker—went to the US embassy in Abuja in November to warn that his son was involved with radical Islamists in Yemen and had broken off contact with his family. The family said they had given US officials extensive information about their son in the expectation that they would “find and return him home.”

In his prepared statement to the House Committee on Homeland Security on January 27, State Department Under-Secretary for Management Patrick Kennedy said: “In the case of Umar Farouk Abdulmutallab, on the day following his father’s November 19 visit to the Embassy, we sent a cable to the Washington intelligence and law enforcement community through proper channels (the Visas Viper system) that ‘Information at post suggests [Farouk] may be involved in Yemeni-based extremists.’”

Kennedy confirmed that all US intelligence agencies received warnings that Abdulmutallab was training with terrorists in Yemen. He noted that the initial diplomatic cable from Abuja misspelled Abdulmutallab’s name.

As I said, that was not the most important problem leading to missed warnings. But it was one identified in the lessons learned period.

Yet it appears likely that one of the potential (if Tamarlan’s trip ends up showing any contact with extremists, which it hasn’t yet) lessons learned here will be one we purportedly learned 3 years ago: that our software needs to be better at using wildcards to identify close but not exact spellings.

We’re already seeing hints that facial recognition may not have served as the miracle solution it often gets sold as. It now appears we might not even have the databases running our watchlist system working as well as it needs to.

Even Dana Milbank Wonders Why Darrell Issa Is Doing Mike Rogers’ Job

After it became clear that the Republicans hoped to use the Benghazi attack to turn Obama into Jimmy Carter, I predicted what would happen as Darrell Issa and Romney surrogate Jason Chaffetz investigated: there would be trouble with classified information.

And while in yesterday’s hearing they made State look like it was withholding information when Under Secretary Patrick Kennedy told Issa that a binder State had provided (presumably put together by the Accountability Review Board) was classified in its totality, even while individual documents in it were unclassified, Issa proceeded to enter a slew of unclassified documents from it into the record.

But it was Chaffetz who complained most loudly, after Deputy Assistant Secretary of State Charlene Lamb put up a satellite image that showed both Benghazi locations (see after 55:00), and, later, after she implied there were other security resources on the ground that were not being discussed in the hearing. (Note, I’m not sure, but I think there may actually be a spook who died at the safe house, too, which would be consistent with this article’s mention of five total dead.) Chaffetz interrupted and complained that the hearing–his own hearing–was exposing sources and methods.

As Dana Milbank describes it:

Rep. Jason Chaffetz (R-Utah) was the first to unmask the spooks. “Point of order! Point of order!” he called out as a State Department security official, seated in front of an aerial photo of the U.S. facilities in Benghazi, described the chaotic night of the attack. “We’re getting into classified issues that deal with sources and methods that would be totally inappropriate in an open forum such as this.”

A State Department official assured him that the material was “entirely unclassified” and that the photo was from a commercial satellite. “I totally object to the use of that photo,” Chaffetz continued. He went on to say that “I was told specifically while I was in Libya I could not and should not ever talk about what you’re showing here today.”

The satellite image was commercial, available to al Qaeda as readily as State. The other security resources belonged to the CIA “safe house” that had been compromised before the attack, which is one thing that led to the deaths of the two former SEALs; Chaffetz was trying to keep hidden a safe house that had already been compromised by poor spycraft or espionage. In addition, Lamb and Kennedy implied that a video showing the attack was being withheld by CIA.

Understand what this means. This hearing focused on the complaints of two security whistleblowers, complaining, credibly, about State trying to shift security responsibilities to State resources, which in this case meant relying on Libyan militia (though the February 17 Brigade appears to have acquitted itself credibly). But that part–the part Romney’s surrogate is trying to make a campaign issue–is only a part of what what went wrong on September 11. Yet Chaffetz went out his way to shield the other failures–the ones made by CIA, which traditionally has close ties to the linguistically skilled Mormon Church.

Though Issa (who kept getting whispers from a guy who apparently used to be a staffer on the House Intelligence Committee) did reveal this bit.

In this hearing room we’re not going to point out details of what may still in fact be a facility of the United States government or more facilities.

FWIW, I’ve implicitly suggested that when DOD used 3 C-130s to ferry a single FBI team to Benghazi to investigate, there may have been a lot more on those planes, some of which presumably didn’t leave with the FBI team.

In any case, this hullabaloo demonstrates what I said weeks ago: if Republicans wanted to conduct their own investigation of this attack (and there’s no reason why they shouldn’t do so), they should have done it in the House Intelligence Committee. Here’s Milbank again.

The Republican lawmakers, in their outbursts, alternated between scolding the State Department officials for hiding behind classified material and blaming them for disclosing information that should have been classified. But the lawmakers created the situation by ordering a public hearing on a matter that belonged behind closed doors.

Republicans were aiming to embarrass the Obama administration over State Department security lapses. But they inadvertently caused a different picture to emerge than the one that has been publicly known: that the victims may have been let down not by the State Department but by the CIA. If the CIA was playing such a major role in these events, which was the unmistakable impression left by Wednesday’s hearing, having a televised probe of the matter was absurd. [my emphasis]

But apparently, Rogers–who as Chair of the Intelligence Committee is of course too close to the intelligence agencies–doesn’t want to get to the bottom of this. And neither, apparently, do Issa and Chaffetz, who are conducting an investigation that by its nature will be incomplete.

There’s one more irony in all this. This very hearing room is the one where, five years ago, Republicans–including Issa–defended the right of the Executive Branch to insta-declassify things like a CIA officer’s identity for political gain. This time around, Republicans went out of their way to hide unclassified information that might reveal how the CIA fucked up.

This country’s treatment of classified information–which feeds partisan selective declassification about as often as it keeps us safer–really makes us fundamentally dysfunctional as a democracy.

Patrick Kennedy to Introduce Bill to Repeal Gramm-Leach … Maybe

One thing that astounds me about this whole financial crisis is that no one–no one–in a position of power has seemingly considered undoing the damage that was done when Gramm-Leach-Bliley started allowed agents to dress up as banksters, banksters to dress up as stock brokers, and stock brokers to dress up as insurance agents. Rather than passing new legislation to set up a super regulator to regulate companies that are too big too fail, wouldn’t it be smarter to go back to the laws that prevented companies from getting too big to fail in the first place? And even if there are good reasons not to go back, don’t you think we ought to at least consider it?

So I was thrilled yesterday when Patrick Kennedy said he was goig to introduce a bill to repeall Gramm-Leach-Bliley.

One thing that I think is maybe one of the many causes of this and that I will hold myself accountable for is voting for the Glass-Steagall reform. And I, for one, am going to introduce legislation to repeal that repeal. Because I don’t believe we ought to be having, as has played itself out, AIG insurance companies doing banking business and banking businesses doing insuring business. And having apples over here and oranges over here and everybody’s getting these financial products all mixed and matched. You’ve got derivatives and debt swaps and what are these things happening, you’ve got people taking loans out and then taking insurance out on the loans because of another part of the company. I mean it just seems we’re rife with conflicts of interest. 

Cool! I thought! We can finally talk about putting oranges and apples back where they belong!

So I called Kennedy’s office to find more details. And it sure sounds like Kennedy is less convinced he’s going to pursue repealing the repeal. Here’s his statement.

"We are in the middle of a crisis that has reached around the globe and hit home in Rhode Island. Now is the time to have an open and honest conversation about every aspect of our nation’s financial system. Through my work on the Oversight committee, I look forward to being part of this conversation and making up for eight years of lost time. While we need to take a good hard look at the legal framework established under the Graham-Leach-Bliley Act, this issue is much bigger than any single law.
