How Richard Barnett Could Delay Resourcing of the Trump Investigation

In the rush to have something to say about what Special Counsel Jack Smith will do going forward, the chattering class has glommed onto this letter, signed by US Attorney for Southern Florida Juan Gonzalez under Jack Smith’s name, responding to a letter Jim Trusty sent to the 11th Circuit a day earlier. Trusty had claimed that the Special Master appointed to review the contents of Rudy Giuliani’s phones was a precedent for an instance where a judge used equitable jurisdiction to enjoin an investigation pending review by a Special Master.

The question raised was whether a court has previously asserted equitable jurisdiction to enjoin the government from using seized materials in an investigation pending review by a special master. The answer is yes. The United States agreed to this approach – and the existence of jurisdiction – in In the Matter of Search Warrants Executed on April 28, 2021, No. 21-MC-425-JPO (S.D.N.Y.) (involving property seized from Hon. Rudolph W. Giuliani) – and, under mutual agreement of the parties, no materials were utilized in the investigation until the special master process was completed. 1 See, e.g., Exhibit A. The process worked. On November 14, 2022, the United States filed a letter brief notifying the District Court that criminal charges were not forthcoming and requested the termination of the appointment of the special master. See Exhibit B. On November 16, 2022, the matter was closed. See Exhibit C.

As the government noted, none of what Trusty claimed was true: the government itself had sought a Special Master in Rudy’s case and Judge Paul Oetken had long been assigned the criminal case.

That is incorrect. As plaintiff recognizes, the court did not “enjoin the government,” id.; instead, the government itself volunteered that approach. Moreover, the records there were seized from an attorney’s office, the review was conducted on a rolling basis, and the case did not involve a separate civil proceeding invoking a district court’s anomalous jurisdiction. Cf. In the Matter of Search Warrants Executed on April 9, 2018, No. 18-mj-3161 (S.D.N.Y.) (involving similar circumstances). None of those is true here.

The government could have gone further than it did. The big difference between the Special Master appointed for Rudy and this one is that Aileen Cannon interfered in an ongoing investigation even though there was no cause shown even for a Special Master review, and indeed all the things that would normally be covered by such a review (the attorney-client privileged documents) were handled in the way the government was planning to handle them in the first place.

Josh Gerstein had first pointed to the letter to note that both Gonzalez, the US Attorney, and Smith, the Special Counsel, had submitted a document on Thanksgiving. The claim made by others that this letter showed particular toughness — or that that toughness was a sign of Smith’s approach — was pure silliness. DOJ has been debunking false claims made about the Special Master reviews of Trump’s lawyers since August. That they continue to do so is a continuation of what has gone before, not any new direction from Smith. Indeed, the most interesting thing about the letter, in my opinion, is that a US Attorney signed a letter under the authority of a Special Counsel, the equivalent of a US Attorney in seniority. If anything, it’s a testament that DOJ has not yet decided where such a case would be prosecuted, which would leave the decision to Smith.

A more useful place to look for tea leaves for Jack Smith’s approach going forward is in Mary Dohrmann’s workload — and overnight decisions about it.

Thomas Windom is the prosecutor usually cited when tracking the multiple strands of investigation into Trump’s culpability for January 6. But at least since the John Eastman warrant in August, Dohrmann has also been overtly involved. She’s been involved even as she continued to work on a bunch of other cases.

With two other prosecutors, for example, she tried Michael Riley, the Capitol Police cop convicted on one count of obstructing the investigation into January 6. In addition to Jacob Hiles (the January 6 defendant tied to Riley’s case), she has prosecuted a range of other January 6 defendants, ranging in apparent levels of import:

  • Richard Barnett, trial for trespassing with a weapon and obstruction scheduled for December 12
  • Vaughn Gordon, who pled to parading in September (a new prosecutor was added November 23)
  • Jacob Hiles, sentenced for parading in December 2021 (with consideration for cooperation against Michael Riley)
  • James Horning, pled to restricted entry in October, sentencing scheduled for January 5 (Dohrmann remains the only prosecutor on the case)
  • Matthew Martin, acquitted of trespassing in a Trevor McFadden bench trial in April
  • Sean McHugh, awaiting April 2023 trial for multiple counts of assault, civil disorder, obstruction (Dorhmann dropped off the case on November 22)
  • Jeffrey McKellop, in plea discussions that may resolve by December 8 for multiple counts of assault and civil disorder, with potential new charges pertaining to allegedly violating the protective order
  • Russell Peterson, sentenced for parading last December (Dorhmann dropped off the case in May 2021)
  • Alexander Sheppard, awaiting trial for obstruction (two new prosecutors were added on November 4)
  • Lori and Thomas Vinson, sentenced for parading in November 2021
  • Josh Wagner and Israel Tutrow, sentenced for parading in December 2021 (Dorhmann dropped off the case in August 2021)

She has also been involved in several non-January 6 prosecutions:

  • Harold Foreman, weapons possession (Dohrmann dropped off the case in March)
  • Zachary Jackson, sentenced for weapons possession (Dorhmann dropped off the case in March, just before sentencing)
  • Nekko Callum Johnson, sentenced for weapons possession in January 2022 (Dohrmann dropped off the case in April 2021)
  • Winston Kelly, weapons possession (Dohrmann dropped of the case in March)
  • Charity Keys, awaiting sentencing for bribery (a new prosecutor joined the case on November 7)

In other words, on the day Smith was appointed, Dorhman was prosecuting several January 6 defendants for trespassing, several for assault, and a cop convicted of obstructing the investigation, even as she was investigating the former President. Though she hasn’t been involved in any of the conspiracy cases, Dohrmann’s view of January 6 must look dramatically different than what you’ll see reported on cable news.

As laid out above, Dorhmann has been juggling cases since January 6; this is typical of the resource allocation that DOJ has had to do on virtually all January 6 cases. That makes it hard to tell when she started handing off cases to free up time for the Trump investigation. That said, there have been more signs she’s handing off cases — both the Vaughn Gordon and Sean McHugh cases — in the days since Smith was named.

But something that happened in the Richard Barnett case revealed how her reassignments on account of Smith’s appointment have been going day-to-day.

Back on November 21 — three days after Garland appointed Jack Smith — Richard Barnett’s attorneys filed a motion asking to delay his trial, currently scheduled for December 12. Their reasons were largely specious. They want to delay until after the DC Circuit decides whether to reverse Carl Nichols’ outlier decision that threw out obstruction charges in the context of January 6; even Nichols hasn’t allowed defendants awaiting that decision to entirely delay their prosecution. They also want to delay in hopes the conspiracy theories that the incoming Republican House majority will chase provide some basis to challenge Barnett’s prosecution.

On November 4, 2022, a Congressional report from members of the House Judiciary Committee released a one thousand page report based on whistleblowers documenting the politicization and anti-conservative bias in the FBI and the Department of Justice. This historic report will no doubt serve as a road map for probes of the agencies now that the Republicans have gained control of the House of Representatives. Included among the many allegations is the recent revelation that the FBI fabricated schemes to entrap American citizens as false flag operations for political purposes. This devastating report was compounded ten days later on November 14, 2022, by revelations that the FBI was involved in infiltrating other groups of January 6th defendants.

As a third reason, Barrnett’s team noted that one of his lawyers, Joseph McBride (who famously said he didn’t “give a shit about being wrong” when floating conspiracy theories about January 6) had to reschedule a medical procedure for the day of the pretrial conference.

Mr. Barnett’s attorney, Mr. Joseph McBride, was scheduled to have a necessary medical procedure on November 17, 2022, but due to unforeseen complication, the procedure could not be performed and must be rescheduled for December 9, 2022, the day of the pretrial conference and a few days before trial.

Per Barnett’s filing, the government objected to the delay.

Counsel for the Government stated that they will oppose this motion, however, they agreed to stay the deadline for Exhibits, due Monday November 21, 2022, until this motion is resolved. The Government also requested that a status conference be scheduled for that purpose.

According to the government response, Barnett’s attorneys first requested this delay on November 17, the day before Smith was appointed. That’s the day Barnett’s team asked the government whether they objected to a delay.

The government has diligently been preparing for trial. Under the Court’s Amended Pretrial Order, the parties were due to exchange exhibit lists on November 21, 2022. ECF No. 63. On November 17, 2022, however, defense counsel Gross contacted the government to state that the defense again wanted to continue the trial. Defense counsel also indicated that the defense was not prepared to exchange exhibit lists on November 21.

By the time the government filed their response on November 22, four days after Smiths’ appointment, DOJ had changed its mind. DOJ still thinks Barnett’s reasons for delay are bullshit (and they are). But the government cited an imminent change in the prosecution team and suggested a trial a month or so out.

As reflected in the Defendant’s motion, the government initially opposed the Defendant’s request for a continuance. Def.’s Mot. at 1. As discussed below, the government maintains that certain of the Defendant’s proffered reasons do not support a continuance of the trial. Nevertheless, the government has considered all the attendant circumstances and no longer opposes the motion. Accordingly, for the reasons set forth below, the government submits that the Defendant’s motion should be granted without a hearing, the trial date vacated, and a status hearing set to discuss new trial dates.

Finally, the government notes that while it is diligently preparing for trial, an imminent change in government counsel is anticipated. Thus, given the government’s strong interest in ensuring continuity in its trial team, coupled with the defendant’s lack of readiness, the government, in good faith, will not oppose the defendant’s continuance. Under such unique time constraints, the government therefore requests that the Court vacate the trial date, without need for a hearing, and set a new trial date and extend the remaining pretrial deadlines by 30 to 45 days. [my emphasis]

The judge in the case, Christopher Cooper, ruled on Wednesday that he will only delay the trial if both sides can fit in his schedule. In his order, he mostly trashed the defense excuses. But he noted that the government, too, should have planned prosecutorial changes accordingly.

The Court will reserve judgment on the Defendant’s 88 Motion to Continue the December 12, 2022 trial date pending receipt of a joint notice, to be filed by November 28, 2022, indicating specific dates on which the parties would be available for trial following a brief continuance. If the parties cannot offer a date that also conforms with the Court’s schedule, the Court will deny the motion and proceed with the scheduled trial. The Court finds that none of the reasons advanced in the Defendant’s motion are grounds for a continuance. This case was charged nearly two years ago, one trial date has already been vacated at the defense’s request, and the present date was set over four months ago. Defense counsel, which now number at least three, have had more than ample time to prepare for trial. The defense has not identified any material evidence that it is lacking, either from the government’s voluminous production of both case-specific and global discovery, or from other public sources. Nor is the pendency of the appeal in U.S. v. Miller an impediment to trial. This and other courts have proceeded with numerous January 6th trials involving the charge at issue in Miller. If the Circuit decides the issue in the defense’s favor, then Mr. Barnett will receive the benefit of that ruling. There is no good reason to halt the trial in the meantime. As for any anticipated change in government trial counsel, the government has been aware of the current trial date for months and should have planned accordingly. That said, the Court would be willing to exercise its discretion and grant a brief continuance should a mutually agreeable date be available. The Court notes, however, that it has a busy docket of both January 6th cases and other matters and therefore may not be able to accommodate the parties’ request. [my emphasis]

Unless and until Dorhmann spins off all her other cases, it won’t be clear whether a change in Barnett’s case indicated she expected to focus more time on Trump or that DOJ wanted to create single reporting lines through Smith (or even whether the change in prosecutorial team involved one of several other prosecutors assigned to the case).

Lisa Monaco has been micro-managing the approach to January 6 from the moment she was confirmed in April 2021. Sure, it’s certainly possible that DOJ didn’t make the final decision on whether to appoint a Special Counsel, and if so, whom, until after Trump announced he was running or until after the GOP won the House. Maybe they delayed any resource discussions until after finalizing a pick.

But depending on the reasons why DOJ changed its mind on Barnett’s case, it’s possible that his still-scheduled December 12 trial could delay the time until Smith has his team in place, by several weeks. It’s also possible DOJ will just go to trial, a high profile one that poses some evidentiary complexities, with the two other prosecutors.

As I’ve suggested above, managing the workload created by the January 6 attack has been unbelievably complex, with rolling reassignments among virtually all prosecution teams from the start. Dohrmann’s caseload is of interest only because the mix of cases she has carried range from trespassers to the former President.

But at this moment, as Smith decides how he’ll staff the investigation he is now overseeing, that caseload may create some avoidable complexities and potentially even a short delay, one that could have been avoided.

Update: In a filing not signed by Mary Dohrmann, the two sides offered January 9 as a possible trial date.

What that Report Purportedly Authenticating the “Hunter Biden” “Laptop” Really Said

I’ve reported on the WaPo story on the security review of the disk drive commonly referred to as the “Hunter Biden” “laptop” a bunch of times.

But in advance of ripping apart this James Comer fan-fiction about Hunter Biden and before the Twitter thread I did disappears into the Elmo dumpster fire, I wanted to repeat it here. The WaPo asked security experts Matt Green (who worked with his Johns Hopkins students) and Jake Williams to review the drive to see what they could authenticate.

They discovered that people had kept adding content to the “laptop,” making it impossible to say what was on the “laptop” when it was provided to the blind computer repairman.

In their examinations, Green and Williams found evidence that people other than Hunter Biden had accessed the drive and written files to it, both before and after the initial stories in the New York Post and long after the laptop itself had been turned over to the FBI.

Maxey had alerted The Washington Post to this issue in advance, saying that others had accessed the data to examine its contents and make copies of files. But the lack of what experts call a “clean chain of custody” undermined Green’s and Williams’s ability to determine the authenticity of most of the drive’s contents.

“The drive is a mess,” Green said.

He compared the portable drive he received from The Post to a crime scene in which detectives arrive to find Big Mac wrappers carelessly left behind by police officers who were there before them, contaminating the evidence.

That assessment was echoed by Williams.

“From a forensics standpoint, it’s a disaster,” Williams said.

Still more important: some of the forensic data that would be necessary to authenticate the drive itself had been deleted.

Analysis was made significantly more difficult, both experts said, because the data had been handled repeatedly in a manner that deleted logs and other files that forensic experts use to establish a file’s authenticity.

“No evidence of tampering was discovered, but as noted throughout, several key pieces of evidence useful in discovering tampering were not available,” Williams’ reports concluded.

Williams was able to authenticate fewer than 10% of the files on the drive, though that included some emails involving CEFC China Energy.

The portable drive provided to The Post contains 286,000 individual user files, including documents, photos, videos and chat logs. Of those, Green and Williams concluded that nearly 22,000 emails among those files carried cryptographic signatures that could be verified using technology that would be difficult for even the most sophisticated hackers to fake.

In particular, there are verified emails illuminating a deal Hunter Biden developed with a fast-growing Chinese energy conglomerate, CEFC China Energy, for which he was paid nearly $5 million, and other business relationships. Those business dealings are the subject of a separate Washington Post story published at the same time as this one on the forensic examinations of the drive.

The “Big Guy” email could not be authenticated.

Some other emails on the drive that have been the foundation for previous news reports could not be verified because the messages lacked verifiable cryptographic signatures. One such email was widely described as referring to Joe Biden as “the big guy” and suggesting the elder Biden would receive a cut of a business deal.

There were authenticated emails from Burisma, but if Burisma was hacked (as a security company, Area 1 Security, said it was before the laptop was disclosed), hackers could have faked cryptographic signatures, including on those from Burisma advisor Vadym Pozharskyi that have been the focus of a lot of attention.

The drive also includes some verified emails from Hunter Biden’s work with Burisma, the Ukrainian energy company for which he was a board member. President Donald Trump’s efforts to tie Joe Biden to the removal of a Ukrainian prosecutor investigating Burisma led to Trump’s first impeachment trial, which ended in acquittal in February 2020.

The Post’s review of these emails found that most were routine communications that provided little new insight into Hunter Biden’s work for the company.

Both Green and Williams said the Burisma emails they verified cryptographically were likely to be authentic, but they cautioned that if the company was hacked, it would be possible to fake cryptographic signatures — something much less likely to happen with Google.

Note, as I understand the timing, these emails could have been altered only if the laptop reaccessed the Burisma server after the hack.

In any case, the “laptop” is a completely unreliable shitshow precisely because Rudy Giuliani and Steve Bannon were in such a rush to make it a political scandal.

And yet the new Republican majority in Congress is sure it is “real.”

James Comer has kicked off his tenure as Oversight Chair by proclaiming that the forensic mess left behind by frothy conspiracy-mongers is, instead, “REAL.”

SDNY Closes Ukraine Influence Peddling Investigation into Rudy

SDNY just submitted a short note asking Judge Oetken to terminate the appointment of Special Master Barbara Jones because the investigation into Ukrainian influence peddling has been closed.

The Government writes to notify the Court that the grand jury investigation that led to the issuance of the above-referenced warrants has concluded, and that based on information currently available to the Government, criminal charges are not forthcoming. Accordingly, the Government respectfully requests that the Court terminate the appointment of the Special Master, the Hon. Barbara S. Jones.

Robert Costello had sourced stories last spring saying this was the case.

The news came minutes before New York State announced that Jones was being appointed Independent Monitor of the Trump Organization during the state proceedings against it.

The Intercept Helps Protect Rudy Giuliani’s Lies about Ruby Freeman

I had ambitious plans to do four things today: write this post on what I’m calling the Roger Stone convergence, wash my walls in advance of priming them for paint, writing about how we’d all be better off remembering that Elmo (Elon Musk — like most nicknames I adopt, I wasn’t smart enough to make that one up) just entered a forced marriage, and explaining why this Intercept article is a piece of shit.

Lo and behold, as I was sitting around procrastinating and rationalizing that I shouldn’t climb a ladder while Mr. emptywheel was on his tenth ever visit to the office where he has worked at for 18 months, I saw that Mike Masnick wrote the article about the Intercept piece I was contemplating writing, down to multiple observations that the journalists kept including things that have fuck all with what they claim they’re writing about.

In other words, this entire system has literally fuck all to do with the rest of the article, but the Intercept makes it out to be a system for suppressing information.

The article continues to pinball around, basically pulling random examples of questionable government behavior, but never tying it to anything related to the actual subject. I mean, yes, the FBI does bad stuff in spying on people. We know that. But that’s got fuck all to do with CISA, and yet the article spends paragraphs on it.

There are just two things I wanted to add to Masnick’s post (really, go read his), first to add some points about the Intercept’s “Hunter Biden” “laptop” claims, and also to talk about why this matters so much.

Masnick writes at length about how fucking stupid the Intercept’s take on the “Hunter Biden” “laptop” is. I want to add a few key points, interspersed with Masnick’s.

And then, I can’t even believe we need to go here, but it brings up the whole stupid nonsense about Twitter and the Hunter Biden laptop story. As we’ve explained at great length, Twitter blocked links to one article (not others) by the NY Post because they feared that the article included documents that violated its hacked materials policy, a policy that had been in place since 2019 and had been used before (equally questionably, but it gets no attention) on things like leaked documents of police chatter. We had called out that policy at the time, noting how it could potentially limit reporting, and right after there was the outcry about the NY Post story, Twitter changed the policy.

Yet this story remains the bogeyman for nonsense grifters who claim it’s proof that Twitter acted to swing the election. Leaving aside that (1) there’s nothing in that article that would swing the election, since Hunter Biden wasn’t running for president, and (2) the story got a ton of coverage elsewhere, and Twitter’s dumb policy enforcement actually ended up giving it more attention, this story is one about the trickiness in crafting reasonable trust & safety policies, not of any sort of nefariousness.

Yet the Intercept takes up the false narrative and somehow makes it even dumber:

In retrospect, the New York Post reporting on the contents of Hunter Biden’s laptop ahead of the 2020 election provides an elucidating case study of how this works in an increasingly partisan environment.

Much of the public ignored the reporting or assumed it was false, as over 50 former intelligence officials charged that the laptop story was a creation of a “Russian disinformation” campaign.

Interjection: These men likely have spent too much time with Glenn Greenwald, who lies about what the former spooks did as regularly as some people attend church. They didn’t “charge” that the story was a creation of Russian disinformation. They said it had the hallmarks of such a campaign, but emphasized that they didn’t know.

It is for all these reasons that we write to say that the arrival on the US political scene of emails purportedly belonging to Vice President Biden’s son Hunter, much of it related to his time serving on the Board of the Ukrainian gas company Burisma, has all the classic earmarks of a Russian information operation.

We want to emphasize that we do not know if the emails, provided to the New York Post by President Trump’s personal attorney Rudy Giuliani, are genuine or not and that we do not have evidence of Russian involvement — just that our experience makes us deeply suspicious that the Russian government played a significant role in this case.

Then they provided around six reasons why they believed it might be true. All six were and remain true (and there has been reinforcement of several since then). Glenn likes to claim these spooks lied, which is nearly impossible, since they simply expressed a belief. Importantly, their belief was and remains eminently reasonable.

Now back to Masnick:

The mainstream media was primed by allegations of election interference in 2016 — and, to be sure, Trump did attempt to use the laptop to disrupt the Biden campaign. Twitter ended up banning links to the New York Post’s report on the contents of the laptop during the crucial weeks leading up to the election. Facebook also throttled users’ ability to view the story.

In recent months, a clearer picture of the government’s influence has emerged.

In an appearance on Joe Rogan’s podcast in August, Meta CEO Mark Zuckerberg revealed that Facebook had limited sharing of the New York Post’s reporting after a conversation with the FBI. “The background here is that the FBI came to us — some folks on our team — and was like, ‘Hey, just so you know, you should be on high alert that there was a lot of Russian propaganda in the 2016 election,’” Zuckerberg told Rogan. The FBI told them, Zuckerberg said, that “‘We have it on notice that basically there’s about to be some kind of dump.’” When the Post’s story came out in October 2020, Facebook thought it “fit that pattern” the FBI had told them to look out for.

Zuckerberg said he regretted the decision, as did Jack Dorsey, the CEO of Twitter at the time. Despite claims that the laptop’s contents were forged, the Washington Post confirmed that at least some of the emails on the laptop were authentic. The New York Times authenticated emails from the laptop — many of which were cited in the original New York Post reporting from October 2020 — that prosecutors have examined as part of the Justice Department’s probe into whether the president’s son violated the law on a range of issues, including money laundering, tax-related offenses, and foreign lobbying registration.

Interjection: The Intercept’s representation of what the WaPo and NYT wrote is horseshit (again, it leads me to suspect these gents have spent too much time listening to Glenn’s rants).

First, as I wrote about the NYT “authenticat[ion]” at the time, the description of the emails was of particular interest because it cited someone who had familiarity with the investigation.

People familiar with the investigation said prosecutors had examined emails between Mr. Biden, Mr. Archer and others about Burisma and other foreign business activity. Those emails were obtained by The New York Times from a cache of files that appears to have come from a laptop abandoned by Mr. Biden in a Delaware repair shop. The email and others in the cache were authenticated by people familiar with them and with the investigation.

That person could have been an FBI agent leaking about the investigation (as likely has happened more recently, when someone revealed they believe there is sufficient evidence to charge on crimes unrelated to the “laptop,” probably an effort to pressure US Attorney David Weiss to charge Hunter Biden). Or it could be someone like Mac Issac or Robert Costello, both of whom were in the chain of custody of the “laptop,” the testimony from whom might be of interest to the Hunter Biden investigation and/or might be of interest in the investigation into Rudy Giuliani’s negotiations with known Russian agents for Hunter Biden dirt that almost exactly resembles what the laptop is. The story actually doesn’t say the FBI first obtained the emails from the laptop. Indeed, the story reports that the foreign influence aspect of the investigation started in 2018, before the FBI got the laptop, in which case the FBI may have obtained the emails from Apple, which is where at least some of the content on the laptop came from. Almost certainly the FBI would have obtained the iCloud content independently anyway, to ensure the integrity of their chain of evidence. But all the NYT said is that someone — perhaps someone who has been questioned in the investigation — is leaking details to the press. All the NYT has done is get the emails from someone involved in the attack on Hunter Biden and — possibly with their help — authenticate the same headers anyone else has.

That doesn’t say “the laptop” is authentic; it says the investigation into Hunter Biden has been grossly politicized.

Now, before we review what the WaPo said, remember that reporters are citing this article to support a claim that the “laptop” was not disinformation. The goal here is to suggest authenticity. For those purposes, here’s what that WaPo story says:

Among the reasons for the inconclusive findings was sloppy handling of the data, which damaged some records. The experts found the data had been repeatedly accessed and copied by people other than Hunter Biden over nearly three years. The MacBook itself is now in the hands of the FBI, which is investigating whether Hunter Biden properly reported income from business dealings.

Most of the data obtained by The Post lacks cryptographic features that would help experts make a reliable determination of authenticity, especially in a case where the original computer and its hard drive are not available for forensic examination. Other factors, such as emails that were only partially downloaded, also stymied the security experts’ efforts to verify content.

In their examinations, Green and Williams found evidence that people other than Hunter Biden had accessed the drive and written files to it, both before and after the initial stories in the New York Post and long after the laptop itself had been turned over to the FBI.

Maxey had alerted The Washington Post to this issue in advance, saying that others had accessed the data to examine its contents and make copies of files. But the lack of what experts call a “clean chain of custody” undermined Green’s and Williams’s ability to determine the authenticity of most of the drive’s contents.

“The drive is a mess,” Green said.

He compared the portable drive he received from The Post to a crime scene in which detectives arrive to find Big Mac wrappers carelessly left behind by police officers who were there before them, contaminating the evidence.

That assessment was echoed by Williams.

“From a forensics standpoint, it’s a disaster,” Williams said.

Analysis was made significantly more difficult, both experts said, because the data had been handled repeatedly in a manner that deleted logs and other files that forensic experts use to establish a file’s authenticity.

“No evidence of tampering was discovered, but as noted throughout, several key pieces of evidence useful in discovering tampering were not available,” Williams’ reports concluded.

Some other emails on the drive that have been the foundation for previous news reports could not be verified because the messages lacked verifiable cryptographic signatures. One such email was widely described as referring to Joe Biden as “the big guy” and suggesting the elder Biden would receive a cut of a business deal.

I’ve also been told that since the laptop was not airgapped, it’s possible Burisma emails were downloaded after Russia reportedly hacked Burisma, meaning those emails could absolutely be fraudulent.

So the Intercept reporters display their highly attuned nose for disinformation by deeming worthy of reporting a “laptop” that does have emails with valid keys downloaded from iCloud (in partial fashion, which should itself raise questions) but also includes a great deal of shit and obvious alteration. The only thing this “laptop” is useful for reporting on is how unreliable “the laptop” as a package is. It is useful for nothing more than serving as the shiny object it was used for in October 2020. Any reporter citing this report as proof that stuff wasn’t forged — or that the whole “laptop” wasn’t packaged up with the help of the same people who were peddling this information to Rudy in the same time period — discredits themselves. The report specifically said such conclusions were impossible and raised a lot of reasons to be more concerned about “the laptop.” The report shows that this “laptop” was a serial hit job and that for a second straight election, people close to Trump once again tried to win an election by using stolen personal data.

Back to Masnick.

The Zuckerberg/Rogan podcast thing has also been taken out of context by the same people. As he notes, the FBI gave a general warning to be on the lookout for false material, which was a perfectly reasonable thing for them to do. And, in response Facebook did not actually block links to the article. It just limited how widely the algorithm would share it until the article had gone through a fact check process. This is a reasonable way to handle information when there are questions about its authenticity.

But neither Twitter nor Facebook suggest that the government told them to suppress the story, because it didn’t. It told them generally to be on the lookout, and both companies did what they do when faced with similar info.

From there, the Intercept turns to a nonsense frivolous lawsuit filed by Missouri’s Attorney General and takes a laughable claim at face value:

Documents filed in federal court as part of a lawsuit by the attorneys general of Missouri and Louisiana add a layer of new detail to Zuckerberg’s anecdote, revealing that officials leading the push to expand the government’s reach into disinformation also played a quiet role in shaping the decisions of social media giants around the New York Post story.

According to records filed in federal court, two previously unnamed FBI agents — Elvis Chan, an FBI special agent in the San Francisco field office, and Dehmlow, the section chief of the FBI’s Foreign Influence Task Force — were involved in high-level communications that allegedly “led to Facebook’s suppression” of the Post’s reporting.

Interjection: This Intercept story was dated October 31, which last I checked is after October 28. Which means if these reporters were actually reporting from the docket, then they should be accountable for this October 28 filing which says that — according to Meta — the plaintiffs in this nonsense lawsuit made up the bit about Agent Chen.

Meta, however, recently sent Plaintiffs’ counsel a letter—attached as Exhibit A—explaining that Plaintiffs’ understanding of Meta’s statement concerning ASAC Chan is “incorrect.” Meta further stated that that “Mr. Chan at no point in time advised Meta ‘to suppress the Hunter Biden laptop story’ . . . [n]or did any of his colleagues.” Based on this newly received evidence, the Court should amend the Deposition Order, and withdraw its authorization of a deposition of ASAC Chan. ASAC Chan, a management-level FBI official, should not have to divert time away from his official duties to participate in an expedited deposition when the record contains no evidence suggesting that he has engaged in the communications that led the Court to authorize his deposition in the first place.

Plaintiffs also relied on several of their own self-serving allegations concerning ASAC Chan—rather than actual evidence—to justify his deposition. See ECF No. 86 at 19-21 (referring to various allegations in Plaintiffs’ Second Amended Complaint). Those allegations generally embellished certain innocuous, public statements ASAC Chan made concerning routine cyber threat discussions he had with various companies, including social media companies. For example, Plaintiffs rely on their allegation that ASAC Chan “admits to regular, routine coordination about censorship with social-media platforms,” see id. at 19 (quoting 2d Am. Compl. ¶ 389), but that allegation relies on an interview in which ASAC Chan simply stated: the FBI regularly “shar[ed] intelligence with technology companies, with social media companies, so that they could protect their own platforms . . . we have all of these methods for collecting intelligence . . . [w]e share them with you and then you do what you want with them to protect your networks,” https://www.banyansecurity.io/resource/get-it-started-get-it-done/ (cited in 2d Am. Compl. ¶¶ 387-89) (emphasis added). Plaintiffs could not identify a single quotation in that interview where ASAC Chan ever stated that the FBI asked or pressured any social media company to remove any content from its platform. Plaintiffs also relied on an allegation that ASAC Chan had stated that social media platforms have been “trying to take down any misinformation or disinformation” and that they have “portals where [users] can report” election-related misinformation.” ECF No. 86 at 20. Again, Plaintiffs could not quote any portion of ASAC Chan’s statement where he stated that he, or anyone else at the FBI, asked or pressured any social media company to remove any content from its platform.

Meta emphasized that “Mr. Chan at no point in time advised Meta ‘to suppress the Hunter Biden laptop story’ . . . [n]or did any of his colleagues.”

The letter from Facebook to the plaintiffs also notes there are no communications that support their Facebook claims.

We identified Mr. Chan to you during a phone call on September 15, 2022. On that call, we identified Mr. Chan as Meta’s primary individual point of contact on the FBI’s Foreign Influence Task Force. And we informed you that we had not identified any emails between Mr. Chan and Meta about Hunter Biden’s laptop. You confirmed in writing after that call that “as referenced in today’s call, we continue to request communications between Meta and FBI’s Foreign Influence Task Force, especially as it relates to the Hunder [sic] Biden laptop story. Reg represented today that he did not believe there are written communications involving” Mr. Chan.

Which is the perfect setup for Masnick’s conclusion about the Hunter Biden story.

Now here, you can note that Dehmlow was the person mentioned way above who talked about platforms and responsibility, but as we noted, in context, she was talking about better education of the public. The section quoted in Missouri’s litigation is laughable. It’s telling a narrative for fan service to Trumpist voters. We already know that the FBI told Facebook to be on the lookout for fake information. The legal complaint just makes up the idea that Dehmlow tells them what to censor. That’s bullshit without evidence, and there’s nothing to back it up beyond a highly fanciful and politicized narrative.

But from there, the Intercept says this:

The Hunter Biden laptop story was only the most high-profile example of law enforcement agencies pressuring technology firms.

Except… it wasn’t. Literally nothing anywhere in this story shows law enforcement “pressuring technology firms” about the Hunter Biden laptop story.

This story proves the opposite of what it claims.

It proves that the reporters who wrote it read a report that cautioned strongly about relying on the “Hunter Biden” “laptop” because of all the forensic problems with it — which is one reason among many why responsible reporters shouldn’t have reported on it in October 2020 (and most did not, precisely because there was nothing reliable). And it further shows to substantiate their core claim of coercion, the reporters rely on sources that themselves made up claims of coercion.

And here’s why it matters.

As Masnick lays out, the Intercept reporters “pingpong” from topic to topic, with little evident understanding of the topics they’re talking about. Several of the meeting notes they try to spin as wildly spooky deal with how one runs elections in an era of outright disinformation — shit like Presidential candidates repeatedly making false claims about the reliability of the vote count. This one, for example, focused primarily on the difficulties election workers face as they’re trying to tally election results amid a cloud of rumors and deliberately false claims.

The report makes quite clear that what’s at stake is the “peaceful transition of power.”

As Masnick recalled, Chris Krebs debunked a lot of false claims in 2020 and Trump promptly fired him for correctly stating that the elections were free and fair.

This is the kind of thing that the Intercept reporters — reporters who ignored a filing that debunked their key claim about FBI coercion and who didn’t understand that the WaPo said the opposite of what they claimed — appear to want to get rid of. If they achieved what they claim they want, CISA would no longer be able to tell local election supervisors about the false claims armed men trolling dropboxes are making to justify their actions. If they achieved what they claim to want, CISA would not be able to share information nationally about organized disinformation campaigns targeting mail-in votes.

The logical outcome, if these Intercept reporters succeeded in halting what they portray in the story, is that CISA would not be able to protect your vote.

Nor would it be able to protect election workers like Ruby Freeman from false claims that Rudy Giuliani spread, falsely claiming a ginger mint was a thumb drive used to steal votes.

In an opinion denying Rudy’s motion to dismiss a defamation lawsuit from Freeman and Shaye Moss, Beryl Howell cites the harm that the mother and daughter claim arises from Rudy’s false claims.

The accusations levied against plaintiffs had consequences. Plaintiffs claim they have experienced online, personal, and professional consequences directly resulting from Giuliani’s statements and conduct. See id. ¶¶ 140–57. Strangers camped out near Freeman’s home in Georgia, harassing her and her neighbors. Id. ¶ 141. “Christmas cards were mailed to Ms. Freeman’s address with messages like, ‘Ruby please report to the FBI and tell them you committed voter fraud. If not[,] you will be sorry,’ and ‘You deserve to go to jail, you worthless piece of shit whore.’” Id. ¶ 143. Protesters targeted her home on January 5 and January 6, 2021, though Freeman had fled her home at the recommendation of the Federal Bureau of Investigation. Id. ¶¶ 144–45. Pizza delivery orders were ordered to her home that her family never ordered, which is a common tactic of online harassment called “doxx[ing].” Id. ¶ 142. Local police received more than twenty harassing phone calls while monitoring Freeman’s phone and, eventually, she had to change her email and phone numbers. Id. ¶ 140. Freeman has experienced strangers harassing her in public and has lost friendships, id. ¶¶ 148–49, plus she has had to cease her online business because of prolonged harassment on social media and public events, id. ¶ 147.

She also cites Rudy complaining about how he got banned from social media for making those false claims.

3 Statement 8 was made by Giuliani during an OAN interview on January 18, 2021, as follows:

I mean, they pretty much censored it while it was going on, so they would love to turn the page on it. I mean, I get banned from any of the big tech things when I say that not only was there voter fraud, I have evidence of it, I’ve seen it, I have a motion picture of it. I can show you the voter fraud in living color. It was done in Fulton County, Georgia, it was well over 30,000 ballots were stolen. They were attributed to Biden instead of Trump. Had they been caught and held to account for it, Trump would have won Georgia. Amend. Compl. ¶ 89. A reasonable listener could read this message as referencing the Edited Video and the actions of election workers in Fulton County, which workers include Freeman and Moss.

Finally, she deems sufficiently credible Freeman and Moss’ claims that Rudy made these false claims about the two of them as part of a plan to overturn the democratic election.

7 Giuliani defends the Strategic Plan as a plan to “‘educate the public,’” Def.’s Mem. at 13 (quoting Strategic Plan at 1), rather than to disseminate false information. Regardless of how Giuliani characterizes the goal of the Plan, plaintiffs allege that the Plan’s goal was to overturn the 2020 presidential election, and they allege more than enough evidence in their Amended Complaint to infer that unlawful act was the Plan’s underlying purpose. See, e.g., Amend. Compl. ¶ 9 (noting that the Strategic Plan “relied on the following call to action: ‘YOU CANNOT LET AMERICA ITSELF BE STOLEN BY CRIMINALS – YOU MUST TAKE A STAND AND YOU MUST TAKE IT TODAY’”).

If the Intercept reporters achieved what they claim they want, it would be far harder to combat clear abuse like Rudy’s because it would halt CISA’s efforts to debunk such obvious false claims. It would make it less likely that Rudy would get banned for his false claims about two women who did nothing more than help count the vote. It would be harder to protect your vote, and it would be harder to protect the life and livelihood of election workers.

This article fed the efforts of fascists to delegitimize efforts to protect democracy. Tucker Carlson loved it. For good reason: because he peddles bullshit that poses a risk to your vote and the livelihood of Ruby Freeman.

Not only didn’t it substantiate what it claimed, but it discredited precisely the efforts that will be used next week to protect democracy.

Update: ProPublica reports that, contra Intercept’s claim that disinformation efforts are increasing, DHS under Biden has backed off the kind of support for election workers that was so successful (and important) in 2020.

In May, one Department of Homeland Security office instructed staffers that work on “sensitive” topics including disinformation should be put on “immediate hold,” according to material reviewed by ProPublica. In the months that followed, DHS canceled a series of planned contracts that would have tracked and studied the proliferation of disinformation and its connection with violent attacks. And after issuing six nationwide warnings about domestic terrorism fueled by disinformation in the first 13 months of the Biden administration, DHS has only issued one in the eight months since.

The government’s retreat comes ahead of midterms in which election officials throughout the country are being inundated with false rumors about their work. After talks on a project to help election officials monitor and respond to threats stalled, election officials from Colorado and Florida wrote a private letter in August to DHS Secretary Alejandro Mayorkas pleading for help.

“Threats and harassment of election officials has become an extremely serious concern and terribly frequent experience for election workers,” they warned, adding, “We are ourselves a crucial part of the nation’s critical infrastructure, in need of and deserving of protection.”

“Time is of the essence,” the officials wrote.

Weeks later, DHS scrapped the project.

[E]lection administrators remain deeply concerned.

“States need more support. It is clear that threats to election officials and workers are not dissipating and may only escalate around the 2022 and 2024 elections,” Colorado Secretary of State Jena Griswold, a Democrat, said in an email to ProPublica. “Election offices need immediate meaningful support from federal partners.”

DOJ Has at Least One Card Left to Play: Congress’ Instinct for Self-Preservation

Last night, Trump and DOJ submitted their competing plans for a Special Master to Judge Aileen Cannon. As I laid out, Trump’s plan is a transparent effort to stall the entire investigation for at least three months, and after that to bottle up documents he stole — those with classified markings and those without — at NARA, where he’ll launch new legal fights in DC to prevent further access.

Judge Cannon has ordered Trump to weigh in on the government’s motion for a partial stay of her order, asking her to permit the investigative team access to any documents marked as classified, by 10AM on Monday. Trump will object for the same insane logic he gave in his Special Master proposal: That if he can get a private citizen Special Master to override the government’s classification determination, then he can declare the documents — even Agency documents that would be government, not Presidential Records — part of his own records at NARA.

Because Trump didn’t share his choices until after close of business day on Friday, both sides also have to inform her what they think of the other’s Special Master suggestions — Barbara Jones (who was Special Master for the review of both Rudy Giuliani’s and Michael Cohen’s devices) and retired George W. Bush appellate judge Thomas Griffith for the government, and retired EDNY and FISC judge Raymond Dearie and GOP partisan lawyer Paul Huck Jr for Trump — on Monday.

Then, if Cannon has not relented on the investigative side for documents marked as classified by Thursday, DOJ will ask for a stay of that part of her decision from the 11th Circuit, pending the rest of their appeal (the scope of which remains unknown and may depend on her other decisions this week).

Cannon’s decision on whether to permit investigators to access the documents marked as classified may provide the government leverage over the Special Master choice, which could create new bases for appeal. None of the choices for Special Master are known to be cleared, much less at the TS/SCI levels that would be needed to review the documents Trump stole, though Dearie, who was on FISC as recently as 2019, surely would be easily cleared as such.

That doesn’t matter for the government’s preferred approach. The Special Master won’t get any known classified document under their approach.

They would, however, under Trump’s approach (which more closely matches Cannon’s current order). And so DOJ will have to agree to give clearance to whatever person ends up as Special Master under the Trump plan.

The same Supreme Court precedent that undergirds all these arguments about classification authority, Navy v. Egan, is specifically a ruling about the Executive’s authority to grant or deny clearances. The government could deny any of the proposed Special Masters clearance — and might well do so, to deny Huck access. Likewise, the government might well deny Trump’s lawyers (at least Evan Corcoran, who is likely either a witness or subject of the obstruction side of the investigation) clearance for such a review as well.

So if Cannon doesn’t grant the government’s motion for a stay, then she effectively gives the government several more levers over her control of the Special Master process.

She probably doesn’t give a damn.

There are two other developments we might expect this week, though.

First, last Wednesday, DOJ asked and Chief Judge Beryl Howell granted permission to unseal the parts of the search warrant affidavit mentioning the same two grand jury subpoenas that she unsealed for mention in DOJ’s response to Trump’s Special Master motion. (I’m looking for the person I owe a hat-tip to this for.) Since receiving that permission, DOJ has not yet gone back to Magistrate Judge Bruce Reinhart to request further unsealing of the affidavit; there’s not even the tell-tale sealed filings in the docket that ended up being prior such requests.

If and when DOJ does ask for further unsealing, it might reveal more information about Trump’s actions — and, importantly for the question of who can be cleared for the Special Master review, Evan Corcoran’s. There are several entirely redacted paragraphs that likely tell what happened in response to the May 11 subpoena. There’s also a likely detailed discussion of the probable cause that Trump — and others — obstructed the investigation, some of which could be unsealed with mention of the surveillance video.

The government response before Cannon didn’t address the evidence of obstruction (or the June 24 subpoena) in much detail. Simply unsealing references of that subpoena in the affidavit might provide more damning information about Trump’s efforts to hide classified documents from DOJ.

More importantly, on Tuesday, the House returns from August recess. It’ll be the first time since the search that both houses of Congress are in town. And in their Motion for a Stay, the government noted (and Judge Cannon did not object) that it did not understand Cannon’s order to prohibit a briefing to “Congressional leaders with intelligence oversight responsibilities.”

5 The government also does not understand the Court’s Order to bar DOJ, FBI, and ODNI from briefing Congressional leaders with intelligence oversight responsibilities regarding the classified records that were recovered. The government similarly does not understand the Order to restrict senior DOJ and FBI officials, who have supervisory responsibilities regarding the criminal investigation, from reviewing those records in preparation for such a briefing.

This seems to telegraph that DOJ plans to brief the Gang of Eight — which includes Nancy Pelosi, Adam Schiff, Kevin McCarthy, Mike Turner, Chuck Schumer, Mark Warner, Mitch McConnell, and Marco Rubio — about what documents Trump stole, possibly this week. Turner and to a lesser degree Rubio have been demanding such a briefing.

And at a minimum, after such a briefing you’d see everyone run to the press and express their opinions about the gravity of Trump’s actions. Because neither DOJ nor Aileen Cannon can prevent these members of Congress from sharing details about these briefings (especially if they’re not classified), you should be unsurprised everyone to provide details of what Trump stole.

That might devolve into a matter of partisan bickering. But two things might moderate such bickering. First, Marco Rubio is on the ballot in November, and Val Demings has already criticized his knee-jerk defense of Trump.

Just as importantly, Mitch McConnell, who badly would like to prevent Democrats from expanding their majority in the Senate and just as badly would like the MAGA Republicans to go away, really doesn’t want to spend the next two months dodging questions about Trump’s crimes.

If not for Trump’s demand for a Special Master, DOJ likely would have put its head down and mentioned nothing of this investigation until after the election. But by demanding one — and by making such unreasonable requests — Trump has ensured that the investigation into his suspected violations of the Espionage Act and obstruction will dominate the news for at least a few more weeks.

Even if DOJ doesn’t brief the Gang of Eight, even if that doesn’t lead to damning new details and recriminations from being made public, the public nature of the Special Master fight will suck all the oxygen out of the next few weeks of campaign season, at least, just as it contributed to Joe Biden enjoying one of the most positive mid-term Augusts for any President in the last half-century.

But if new specifics about Trump’s negligence and efforts to obstruct the investigation are made public, then November’s election will be precisely what Republicans are trying to avoid it being: not just a response to the Dobbs ruling overturning protection for abortion access, but a referendum on the way Republicans have sacrificed American security in their fealty to Donald Trump.

Aileen Cannon Calls an Investigation into “What’s Literally a Stolen Diary” … “Politicized”

This is a minor point, but one that deserves more attention. Plus, I plan to use it in future posts about the unlawful assault on property rights that Judge Aileen Cannon has mounted in her opinion appointing a Special Master to stall the investigation into Donald Trump’s suspected theft of classified documents.

In a footnote of her opinion, Judge Cannon pointed to the Special Master appointed in the Project Veritas case as a precedent of a judge (Analisa Torres, in this case), appointing a Special Master “in politicized circumstances.”

Moreover, at least one other court has authorized additional independent review for attorney-client privilege outside of the law firm context, in politicized circumstances. See In re Search Warrant dated November 5, 2021, No. 21-Misc-813, 2021 WL 5845146, at *1 (S.D.N.Y. Dec. 8, 2021) (appointing a special master to conduct review of materials seized from the homes of employees of Project Veritas for potentially attorney-client privileged materials).

To be fair, I kept waiting for Trump’s lawyers to raise this precedent (though not for the principle Cannon did).

But they didn’t.

Not in the original complaint (in which they relied heavily on the Lynne Stewart and Michael Cohen precedent). Not in their supplement (in which they added the Rudy precedent to those they relied on). Similarly, it didn’t come up in the hearing (in which Rudy featured prominently).

This was Judge Cannon going out of her way to find what she believed was a precedent on her own, one that she said supported an, “independent review for attorney-client privilege outside of the law firm context, in politicized circumstances.” But the opinion isn’t about attorney-client privilege. It was, explicitly, about press privileges.

In light of the potential First Amendment concerns that may be implicated by the review of the materials seized from Petitioners, the Court finds that the appointment of a special master will “help[] to protect the public’s confidence in the administration of justice.”

The opinion further holds there is no basis of law to do what Cannon did–intervene because of leaks (more on the leaks Cannon made up later).

Project Veritas and O’Keefe request that the Court order the Government to conduct a search for alleged leaks related to the Government’s investigation. O’Keefe Mot. II at 1. Petitioners do not provide a legal basis for their request or allege that the Government violated any specific rule, law, or policy

Crazier still, there’s no mention in the opinion, at all, about politics.

Nor should there be. This is a case about theft. We know it’s about theft because the two people who’ve already pled guilty in the case acknowledged it in real time (and pled guilty to transporting stolen goods across state lines).

They are in a sketchy business and here they are taking what’s literally a stolen diary and info . . . and trying to make a story that will ruin [the Victim’s] life and try and effect the election. [The Victim] can easily be thinking all her stuff is there and not concerned about it. .  . we have to tread even more carefully and that stuff needs to be gone through by us and if anything worthwhile it needs to be turned over and MUST be out of that house.

We know, too, that it’s not just about a stolen diary. In addition to the diary (which by the way included Ms. Biden’s extensive accounts of her own addiction treatment, the most personal kind of medical record), the thieves stole,

tax records, a digital camera, a digital storage card containing private family photographs, a cellphone, books, clothing, and luggage.

Aileen Cannon believes that the investigation of this theft — the culprits have admitted it!! — is politicized.

Presumably Aileen Cannon believes an investigation into stolen property must be about politics because she believes James O’Keefe’s claim that this was an investigation started under Joe Biden. Had she done as much work to fact-check O’Keefe as she did to find precedents for Trump, though, she would know that this investigation was not started under Joe Biden.

It was started under Donald Trump.

The first call records in this investigation were obtained in November 2020, while Bill Barr was Attorney General (under Merrick Garland, such a step might have required the AG’s approval, but Barr was less interested in such protections). The first warrant targeting people purporting to play the role of journalists was obtained on January 14, 2021. That one, I imagine, did require Main DOJ approval, hopefully even from then-Acting Attorney General Jeffrey Rosen.

Aileen Cannon argues that the investigation started under Bill Barr and Jeffrey Rosen into the theft — this is not contested! — of things including medical and tax records is politicized, mostly because the victim is the current President’s daughter.

Effectively, then, Judge Cannon is arguing that private citizen Ashley Biden can have no recourse for when someone literally steals her medical and tax records, but Trump must have special judicial interference to prevent the FBI taking medical and tax records in the process of investigating 11,000 stolen records.

One Big Potentially Pending Question: What Happens to Trump’s Impeachment 1.0 Papers?

There’s a comment in DOJ’s response to Judge Aileen Cannon’s order to file an update by tomorrow that caught my attention. DOJ suggests there may be no dispute about whether the stuff it has been pursuing a review of is really privileged.

Although the government will provide the Court more detail in its forthcoming supplemental filing, the government notes that, before the Court issued its Preliminary Order, and in accordance with the judicially authorized search warrant’s provisions, the Privilege Review Team (as described in paragraphs 81-84 of the search warrant affidavit) identified a limited set of materials that potentially contain attorney-client privileged information, completed its review of those materials, and is in the process of following the procedures set forth in paragraph 84 of the search warrant affidavit to address potential privilege disputes, if any.

As I laid out here (and as virtually all journalists are still getting wrong), DOJ used a privilege team for the search on August 8. At least according to Fox News, all the potentially privileged material was inventoried on what I call the SSA receipt (because it was signed by the Supervisory Special Agent, rather than the Special Agent).

I surmised and DOJ has now confirmed that DOJ has been “in the process of following the procedures set forth in paragraph 84 of the search warrant affidavit to address potential privilege disputes, if any.” That means DOJ is using one of these methods:

84. If the Privilege Review Team determines that documents are potentially attorney-client privileged or merit further consideration in that regard, a Privilege Review Team attorney may do any of the following: (a) apply ex parte to the court for a determination whether or not the documents contain attorney-client privileged material; (b) defer seeking court intervention and continue to keep the documents inaccessible to law-enforcement personnel assigned to the investigation; or (c) disclose the documents to the potential privilege holder, request the privilege holder to state whether the potential privilege holder asserts attorney-client privilege as to any documents, including requesting a particularized privilege log, and seek a ruling from the court regarding any attorney-client privilege claims as to which the Privilege Review Team and the privilege-holder cannot reach agreement.

Option c is effectively to invite Trump to provide feedback on the privilege issues, an option that Evan Corcoran has told us DOJ specifically rejected  back on august 11.

Option b is to simply not access the materials; since FBI seized it, it’s likely they saw something on August 8 that made them want to access the materials.

So we can be fairly sure that DOJ is pursuing Option a to get this material, an ex parte review by a judge — the implication is Bruce Reinhart, but it’s possible they’ve involved someone who’s more senior, such as DC Chief Judge Beryl Howell (who is presiding over the grand jury conducting this investigation) or SDFL Chief Judge Cecilia Altonaga — to see whether it is attorney-client privileged.

I want to talk about three categories of documents that might appear to be covered by attorney-client privilege that a judge might otherwise decide are not. DOJ’s suggestion that there may not be a dispute reminds me of how, during the privilege review of Michael Cohen’s phones in 2018, as soon as Judge Kimba Woods ruled that any fight over privilege would have to be public, Trump slithered away and stopped fighting to keep the recordings about hush payments that Cohen kept on his phone away from prosecutors.

In other words, particularly since DOJ completely bypassed any involvement from Trump, I suspect DOJ believes that the materials currently under ex parte review by Reinhart or some other judge may be crime-fraud excepted.

Consider the kinds of materials that, under the warrant, could be seized:

  • Any Presidential or government record created during Trump’s term, which would include most if not all of the subcategory of documents bearing classification marks
  • Documents stored along with (that is, perhaps in the same storage closet) documents bearing classification marks
  • Evidence of the knowing alteration, destruction, or concealment of government and/or Presidential records — basically, of obstruction

If it remains true that all documents with potentially privileged materials are on the SSA receipt, it is likely that there were a chunk of documents — labeled just “documents” seized from his office (where the privilege team did all the initial search) — as well as five boxes that by description were stored with documents bearing classified markings, probably found in the storage room and handed off to the filter team for some reason.

The most obvious set of materials that would appear privileged but might be deemed by a judge to be crime-fraud excepted would pertain to obstruction: Materials that post-date Trump’s Presidency involving lawyers (either the former White House counsels who attempted to get him to return the documents) or his current attorneys, especially including the effort to refuse NARA and DOJ’s requests and/or to provide bullshit information in response to one or more subpoenas. That’s what those documents seized from Trump’s office might consist of.

Another category of documents might include materials involving non-governmental lawyers — Rudy Giuliani or John Eastman are likely possibilities — that appeared on official government records. These materials might pertain to January 6. Particularly given that SCOTUS approved the waived privilege claims over Trump’s governmental files, those seem like an easy decision.

A third category of information pertains to advice White House counsel lawyers gave Trump while still in office outside the context of a legal proceeding (different from the advice the same former White House counsels gave during the extended fight with NARA) that he wants to keep from DOJ. The Bill Clinton precedent would say that NARA at least gets this information, and if there is a legal basis for the FBI to obtain it (such as that it includes classified information, as the White House counsel response to the Zelenskyy-Trump call would be), then it would seem FBI would be able to obtain it. Given Trump’s bid to claim Executive Privilege over certain information, I wouldn’t be surprised if this were a heated issue.

The one set of documents that I think does raise real concerns, though, is Trump’s defense during Impeachment 1.0. At least three members of the White House Counsel staff were part of Trump’s defense team: Pat Cipollone, Patrick Philbin, and Michael Purpua. Taxpayers paid their salaries during the period when they were defending Trump, and so under the Clinton precedent, any files involving them would seem to be government documents covered by the Presidential Records Act. But Trump also had some talking heads — like Alan Dershowitz and Pam Bondi — and one of the real private attorneys who represented him in the Russian investigation, Jane Raskin. Trump’s communications with the later two groups should be privileged.

I’ve asked experts on Richard Nixon and Bill Clinton what happened with their impeachment records. Best as I can tell, many of those records are in the Archives. But I’m still not sure how the special case of Trump’s impeachment defense would be treated.

Trump’s Timid (Non-Legal) Complaints about Attorney-Client Privilege

Yesterday, I observed that the FBI gave the former President two different receipts for the search on his golf resort.

There’s the one consisting of five boxes and a separate category, “Documents,” not associated with any boxes, signed by the Supervisory Special Agent. There are no classified documents described. I’ll refer to that as the SSA Receipt in this post.

Then there’s the one that consists of 27 items, mostly boxes, many with sub-items, which are often descriptions of the kinds of classified documents contained in the box or the leather case they were seized in. It was signed by a Special Agent. I’ll refer to that as the CLASS Receipt in this post.

I suggested that one explanation for providing Trump two separate receipts might be if the SSA receipt covered evidence showing Trump violated 18 USC 1519, destruction, alteration, or falsification of records in Federal investigations, and the CLASS receipt covered evidence showing Trump violated 18 USC 793, retaining national defense information under the Espionage Act. I argued the two receipts would cover evidence responsive to crimes that might be charged in different venues, DC for the obstruction charge and SDFL for the Espionage charge.

The third statute on Trump’s warrant, 18 USC 2071, removal of official records would cover everything covered by the Presidential Records Act and would generally backstop everything seized under the other two statutes. It covers both. Consider it an umbrella charge.

Today Trump, in the form of a post on Truth Social and related stories shared to Trump-friendly media, has confirmed I’m right that there’s significance to the two separate receipts.

Trump-friendly outlets have explained that “the former president’s team was informed” that the materials seized via what I’ve called the SSA receipt “contain information covered by attorney-client privilege” but that DOJ “opposed Trump lawyers’ request for the appointment of an independent, special master to review the records.”

The FBI seized boxes containing records covered by attorney-client privilege and potentially executive privilege during its raid of former President Trump’s Mar-a-Lago home, sources familiar with the investigation told Fox News, adding that the Justice Department opposed Trump lawyers’ request for the appointment of an independent, special master to review the records.

Sources familiar with the investigation told Fox News Saturday that the former president’s team was informed that boxes labeled A-14, A-26, A-43, A-13, A-33, and a set of documents—all seen on the final page of the FBI’s property receipt —contained information covered by attorney-client privilege.

Sources told Fox News that some records could be covered by executive privilege, which gives the president of the United States and other officials within the executive branch the authority to withhold certain sensitive forms of advice and consultation between the president and senior advisers.

I believe there must be some truth to this because if Trump were making completely unsubstantiated claims, he would have made it more generally, claiming that all the boxes must include attorney-client privileged material. Furthermore, Trump’s claims to have watched the search via CCTV notwithstanding, it is highly unlikely Trump has CCTV coverage of his own office, bedroom, and a random storage closet such that he would know what’s in box A-14 (and so on the SSA receipt) versus what’s in box A-15 (which was on the CLASS receipt). Someone who knows the outcome of the search told Trump that one set, but not the other, has materials that are attorney-client privileged. That has to come from the government.

That doesn’t mean my larger hypothesis — that one receipt covered violations of the Espionage Act and the other covered obstruction — has been vindicated. On the contrary, DOJ may simply have chosen to put all records that include an attorney-client claim on a separate receipt so that, if Trump obtains a competent lawyer and demands the Special Master review he’s making a half-hearted request for now, DOJ can move forward with all the other evidence without a 9-month delay like the Special Master review of Rudy Giuliani’s phones necessitated. It would be a clever way of dealing with a very sensitive legal issue.

But I don’t think it’s as simple as that either. Bizarrely, Trump knows something about those boxes such that he’s trying to claim Executive Privilege, in addition to attorney-client privilege.

It’s a nonsense claim, legally. Probably every single box seized last Monday has materials covered by Executive Privilege in them, because every single box would include communications directly with Trump. But there is absolutely no basis for any EP claim for a single thing seized from Mar-a-Lago because the Presidential Records Act underlying the seizure is designed, specifically and especially, to make sure all the EP materials are preserved for history. It’s one of the reasons his refusal to turn over the materials that the Archives were asking for specifically is so insanely stupid, because it gave FBI no choice but to come seize this stuff. Trump’s not making an EP claim to try to delay DOJ’s access to the 27 items, which are mostly boxes, on the CLASS receipt. So he must have learned something about the materials itemized in the SSA receipt to which, in a frantic and transparently silly effort, he’s trying to delay DOJ’s access.

Trump’s announcement that the material on the SSA receipt seems to rule out another possible explanation for the SSA receipt I had been pondering, that it covered the materials that were particularly sensitive from a national security perspective, such as the information on nuclear weapons.

And it doesn’t rule out my hypothesis that that material was seized in the obstruction investigation. Indeed, in two ways, it might corroborate my hypothesis.

There are two theories of the 1519 charge. One, which NYU’s Ryan Goodman is championing, suspects it is about the investigation into Mar-a-Lago, criminalizing the effort in June to withhold materials. If that were the significance of the 1519 charge, separating out the communications between lawyers and NARA and DOJ might make sense, since those would be communications into this investigation. That said, there’d be no basis for an EP claim for any of that, since it all post-dated Trump’s ouster. And as soon as DOJ confirmed that some classified material had been knowingly withheld in June when his lawyers told DOJ that it was all turned over, there’d be a crime-fraud exception for those materials.

My theory of the 1519 charge — that it arose out of NARA’s discovery that Trump had attempted to destroy materials subpoenaed in past and present investigations — would similarly be likely to have attorney-client privileged documents. Take a few examples:

  • One thing Trump is likely to have withheld is the Perfect Transcript between him and Volodymyr Zelenskyy, which is something Congress was entitled to get during impeachment. That transcript was hidden from Congress by White House lawyer John Eisenberg, among other lawyers, thereby according the transcript a weak privilege claim, but one easily overcome by the obstructive nature of the choice to withhold it.
  • Another set of things we know were withheld from several investigations were documents showing sustained communications with Russia that should have been turned over by the Trump Organization. The most provable of those were the communications between Michael Cohen and Dmitri Peskov’s office in January 2016 (Mueller got his own copy via Microsoft). There’s probably correspondence regarding an invite Russian Deputy Prime Minister Sergei Prikhodko extended to Trump to attend Putin’s St. Petersburg Economic Forum in June 2016. The Trump Organization did not produce to SSCI the copy of Paul Manafort’s Securing the Victory email he sent to Rhona Graff. The subpoena response on all these issues was handled by Trump’s corporate lawyers, Alan Futerfas and Alan Garten, and so would be privileged — but also crime-fraud excepted — evidence that Trump obstructed various Russian investigations.
  • While one draft of Trump’s termination letter to Jim Comey was ultimately turned over to Mueller (after reports that the only extant copy was one preserved by DOJ lawyers), the Mueller Report narrative surrounding it makes it clear that Trump and Stephen Miller worked over several drafts before the one shared with others. Those earlier drafts were likely not turned over, in part because White House Counsel lawyers advised Trump that these drafts should “[n]ot [see the] light of day.” Again, that’s legal advice, but also proof of documents that were illegally withheld from the Mueller investigation.
  • I don’t want to even imagine what advice from Rudy Giuliani that Trump has withheld from various investigations, particularly pertaining to January 6. Most of that would be (shitty) legal advice. If it was also withheld from proper investigations, though, it’d also be proof of obstruction under 18 USC 1519.

In other words, aside from the documents Trump tried to rip up or eat or flush, many of Trump’s known violations of 18 USC 1519 would involve lawyers directly. Virtually every investigation into Trump was stymied by improper decisions by lawyers. And those withheld documents would once have been privileged, but they’d also be solid proof of obstruction.

And if Trump had reason to believe that DOJ, after predicating an investigation on all the evidence Trump had tried to rip up or eat or flush evidence, had sought and seized all the attorney-client protected materials that had insulated Trump from consequences for his past actions, it might explain one of the biggest puzzles from the last week. For some reason, Trump has worked far harder to obscure that this obstruction investigation exists than that he’s under investigation for a crime with the word “Espionage” in the title. For some reason, Trump is more afraid of the obstruction investigation than the Espionage Act investigation.

One possible explanation for that is that he fears the other secrets he’s been keeping more than proof that he stole a bunch of otherwise innocuous Top Secret documents.

Perhaps the most interesting thing about this latest complaint — first voiced on the 7th day after the search — is it shows that DOJ is in contact with someone presenting themself as Trump’s lawyer.

That’s not surprising. DOJ informed Trump of the search. Even for a simple criminal case into attempting to steal the election (assuming Trump could find someone who would confess to be his lawyer), DOJ would want to have discussions about how to proceed.

In this case, however, the crimes under investigation include, at a minimum, violations of the Espionage Act. DOJ always tries to find a way to resolve those from the get-go, because prosecutions about stolen classified information are always damaging to the equities you’re trying to protect. That’s all the more true in the unprecedented case where the suspect is the former President. At a minimum, DOJ likely has or will float Trump the offer of an offramp like an 18 USC 2701 guilty plea if he cooperates to tell the government about the whereabouts of all the classified documents he stole.

And if what Trump is trying to hide in the obstruction investigation is even more damning, as his behavior suggests it might be, DOJ might actually have enough leverage to make Donny to consider such an offer.

Still, the legal quiet has been making me nervous. I have been waiting all week for a docket to spring up with a Trump motion for a Temporary Restraining Order stalling any access to these files.

For comparison, the docket on a similar challenge from Michael Cohen in 2018 was created just 4 days after the search of his residences, and the discussions about the search began that same day.

On the same day as the seizures (April 9, 2018), the undersigned counsel requested in writing that the U.S. Attorney’s Office for the SDNY return all of the seized property and allow Mr. Cohen and his attorneys the opportunity to screen the materials for privilege, produce any relevant, non-privileged documents to the government, and provide a log of any documents withheld on privilege grounds. Id., ¶ 32, Ex. A. On Wednesday, April 11, 2018, the government responded by letter, rejecting defense counsel’s proposal and informing defense counsel that the government would begin to review the materials at noon on Friday, April 13, 2018. Id. ¶ 33, Ex. B. Accordingly, Mr. Cohen hereby moves for immediate injunctive and equitable relief seeking the opportunity to have his counsel review the seized documents in the first instance, before any review by any law enforcement personnel, for privilege and responsiveness, and, if the Court believes it necessary, for the appointment of a Special Master to supervise that review process.

Trump moved to intervene that same day, April 13, just four days after the seizures.

In the case of the search on Rudy’s phones, SDNY itself asked for a Special Master the next day (though Trump never intervened).

There have to be similar discussions going on now. There just have to be. Trump’s paucity of lawyers — and the conflict posed by the possibility that Evan Corcoran, his most competent current defense attorney, may be conflicted out by dint of having signed an affirmation that Trump turned over all his classified documents in June — cannot explain a full week delay.

But thus far, in spite of every media outlet and their mother filing motions to unseal the search affidavit itself, no one has started pushing to unseal an inevitable fight over access to the seized material. (Again, by comparison, the NYT filed to intervene the day the Cohen warrant docket was made public.)

So for whatever reasons, a full week has elapsed since a lawful search executed on the golf resort of the former President and the first we’re learning about legal discussions — aside from NYT’s revelation that Trump made a veiled threat against Merrick Garland on Thursday — is Trump’s complaint covering just the documents that don’t seem to implicate the Espionage Act.

Something has caused that discussion to remain sealed. And that, by itself, is remarkable.

Update: As klynn reminds in comments, another document that the Trump White House altered was the MemCon of the meeting between Trump and Sergey Lavrov in which he gave the Russians highly sensitive intelligence. I laid out what we know of that alteration, the fall-out, and Mueller’s investigation into it here. If my theory about the SSA receipt is right, that any remaining unaltered record of the meeting found at MAL would be on the SSA receipt. Except the alterations, in this case, are not yet known to involve an attorney, so would not be attorney-client privileged.

Some Likely Exacerbating Factors that Would Contribute to a Trump Search

From the start of the reporting on Trump’s theft of classified documents, commentators have suggested that Trump was only under investigation for violations of the Presidential Records Act or 18 USC 2071.

Reports that in June, one of the four people who met with Trump’s lawyers on this issue was Jay Bratt, head of Counterintelligence & Export Control Section at DOJ, which investigates Espionage, makes it highly unlikely that those are the only things under investigation.

In early June, a handful of investigators made a rare visit to the property seeking more information about potentially classified material from Trump’s time in the White House that had been taken to Florida. The four investigators, including Jay Bratt, the chief of the counterintelligence and export control section at the Justice Department, sat down with two of Trump’s attorneys, Bobb and Evan Corcoran, according to a source present for the meeting.

At the beginning of the meeting, Trump stopped by and greeted the investigators near a dining room. After he left, without answering any questions, the investigators asked the attorneys if they could see where Trump was storing the documents. The attorneys took the investigators to the basement room where the boxes of materials were being stored, and the investigators looked around the room before eventually leaving, according to the source.

Even 18 USC 1924, which prohibits unlawfully taking classified information, would involve complications if the person who stole the materials were the former President. Admittedly, the fact that DOJ had an in-person meeting with Trump before conducting a search might mitigate those complications; Trump may be refusing to return documents rather than just not turning them over.

Still, it’s possible — likely even — that there are exacerbating factors that led DOJ to search Mar-a-Lago rather than just (as they did with Peter Navarro) suing to get the documents back.

Remember, this process started when the Archives came looking for things they knew must exist. Since then, they’ve had cause to look for known or expected Trump records in (at least) the January 6 investigation, the Tom Barrack prosecution, and the Peter Strzok lawsuit. The investigation into Rudy Giuliani’s influence peddling is another that might obviously lead to a search of Trump’s presidential records, not least because the Archives would know to look for things pertaining to Trump’s impeachments.

With that as background, Trump would be apt to take classified documents pertaining to the following topics:

  • The transcript of the “perfect phone call” with Volodymyr Zelenskyy and other documents pertaining to his first impeachment
  • Notes on his meetings with other foreign leaders, especially Vladimir Putin and Saudi royals, including Trump’s July 16, 2018 meeting with Putin in Helsinki
  • Information surrounding the Jamal Khashoggi execution (and other materials that make Jared Kushner’s current ties to Mohammed bin Salman suspect)
  • Policy discussions surrounding Qatar, which tie to other influence peddling investigations (for which Barrack asked specifically)
  • Intelligence reports on Russian influence operations
  • Details pertaining to security efforts in the lead-up to and during January 6
  • Intelligence reports adjacent to Trump’s false claims of election fraud (for example, pertaining to Venezuelan spying)
  • Highly sensitive NSA documents pertaining to a specific foreign country that Mike Ellis was trying to hoard as boxes were being packed in January 2021

For many if not most of these documents, if Trump were refusing to turn them over, it might amount to obstruction of known investigations or prosecutions — Barrack’s, Rudy’s, or Trump’s own, among others. Thus, refusing to turn them over, by itself, might constitute an additional crime, particularly if the stolen documents were particularly damning.

One more point about timing: An early CNN report on these stolen documents describes that a Deputy White House Counsel who had represented Trump in his first impeachment was liaising with the Archives on this point.

Longtime Archives lawyer Gary Stern first reached out to a person from the White House counsel’s office who had been designated as the President Records Act point of contact about the record-keeping issue, hoping to locate the missing items and initiate their swift transfer back to NARA, said multiple sources familiar with the matter. The person had served as one of Trump’s impeachment defense attorneys months earlier and, as deputy counsel, was among the White House officials typically involved in ensuring records were properly preserved during the transfer of power and Trump’s departure from office.

By description, this is likely either John Eisenberg (who hid the full transcript of the perfect phone call but who was not obviously involved in Trump’s first impeachment defense) or Pat Philbin (who was the titular Deputy White House Counsel and was overtly involved in that defense). If it’s the latter, then Philbin recently got a DOJ subpoena, albeit reportedly in conjunction with January 6. If so, DOJ might have recent testimony about documents that Trump was knowingly withholding from the Archives.

The “Subject” of Robert Costello’s Declination

Since April, the SDNY investigation into whether Rudy Giuliani worked as an unregistered foreign agent for Yuri Lutsenko has gone dark. I thought it possible that it had reached a dead end, but figured we’d learn if that were true when Rudy’s lawyer, Robert Costello, noisily announced that prosecutors told Rudy he was no longer a subject of the investigation.

Costello gave a version of that announcement yesterday to the NYT and at least one other outlet.

Only, he didn’t announce that prosecutors had told him Rudy was no longer a subject. On the contrary, Costello appears to confirm that Rudy remains a subject of investigation at SDNY. Costello used a different event — the return of Rudy’s seized devices — as his basis for saying he probably won’t be charged in the Lutsenko inquiry.

Because a broad swath of people routinely misrepresent what I have or am saying about Rudy, let me be very clear: I have no reason to doubt the NYT reporting or Costello’s claim that the investigation that Jeffrey Rosen intentionally circumscribed in 2020 into whether Rudy failed to register for his work for Ukrainian official Yuri Lutsenko will likely not result in charges.

But the specifics of what Costello said and did not say are of interest.

Before I look at what Costello said, a reminder that SDNY seized Rudy’s devices in April 2021. In September, they got Judge Paul Oetken to approve their preferred scope for a Special Master review of Rudy’s phones to include for review everything, regardless of subject, after January 1, 2018. In November and January, Special Master Barbara Jones turned over materials to the government. Half of the devices she reviewed covered just a focused period specific to the Ukraine investigation December 1, 2018 through May 31, 2019; the rest covered the entire period of review, January 1, 2018 through the April 2021 seizure. After Jones finished her privilege review, the material she turned over would be scoped (meaning, sorted for the material that matched the warrant(s) against Rudy) by the FBI. Jones’ last publicly posted report actually showed that the review of the single phone seized from Victoria Toensing’s phone was ongoing, with the involvement of Dmitry Firtash. Firtash had been represented by Toensing when the phone was seized but is now represented (again) by Lanny Davis. The last we heard from Jones in this case on January 21, she said, “I will confer with the Government and counsel for Mr. Giuliani and Ms. Toensing regarding additional review assignments.”

In March, in the related SDNY counts, Lev Parnas filed to change his plea on the remaining charge against him and pled guilty on March 29. At a sentencing hearing on June 29 where the government scoffed at Parnas’ claims of cooperation and associated media blitzes, Judge Oetken sentenced Rudy’s former associate to 20 months in prison. That’s relevant because one identifiable source for yesterday’s NYT story was Parnas, who in fact telegraphed something was coming the day before. Parnas, it seems, has reason to believe Rudy and he won’t be charged for his Lutsenko work (this work was actually included in Parnas’ original 2019 indictment, but was removed in 2020).

The day before Parnas telegraphed such a story was coming, DOJ asked to unseal a July 29, 2021 Oetken opinion finding that a communication describing efforts that Alexander Mikhalev was making to hide his role in influence-peddling relating to some cannabis businesses in the US was crime-fraud excepted.

I believe what’s left was for Igor and Lev to establish who is going to be shareholder(s) of the NewCo and could we all use LLC’s as our proxy’s in it. I am just trying to establish core structure and how transparent should Andrey be exposed for the benefits of NewCo Transparency, his Russian roots and current political paranoia about it.

My wildarse guess is DOJ wants this unsealed so a different Federal entity can use the email to sanction Mikhalev for foreign influence peddling, but that’s just a WAG. SDNY’s letter asking for the unsealing reflects having obtained permission from Parnas’ attorney before the unsealing, so even though SDNY believes Parnas unreliable for the way he blabs to the press, there was recent communication with him on this point.

Back to Rudy. When last we heard, in April, CNN reported that SDNY might soon reach a charging decision on Rudy’s case because he provided investigators some possible passwords for several (the numbers here are inconsistent with the Special Master’s numbers) of the phones FBI couldn’t unlock.

Federal prosecutors may soon reach a charging decision regarding Rudy Giuliani’s foreign lobbying efforts involving Ukraine, after he helped investigators unlock several electronic devices that were seized by the FBI, according to multiple sources familiar with the probe.

Giuliani has also offered to appear for a separate interview to prove he has nothing to hide, his lawyer told CNN, renewing a proposal that federal prosecutors have previously rebuffed.

That, CNN’s sources claimed three months ago, could lead to a quick decision.

In recent weeks, Giuliani met with prosecutors and during the meeting he assisted them in unlocking three devices that investigators had been unable to open, according to people familiar with the investigation. It is unclear if Giuliani also answered questions from investigators during this meeting.

Giuliani provided a list of possible passwords to two other locked devices, the people said. Is it unknown if those passwords successfully unlocked those devices and how much relevant material is on the recently unlocked devices.

Now that several more devices are unlocked, that could speed up the review and ultimately lead to a quick decision over whether the former mayor of New York will face criminal charges. Unless new information comes to light that leads to new routes for authorities to pursue, federal prosecutors at the US Attorney’s Office in the Southern District of New York — which Giuliani led in the 1980s — are likely to decide whether to bring charges soon after the review, people familiar with the matter told CNN.

Even then, the anonymous sources talking about Rudy’s case suggested he would only be charged if new information came to light.

That claim showed up in yesterday’s NYT story, as well: DOJ had enough to seize Rudy’s devices, but found no smoking gun. Yesterday’s piece even linked the CNN story from April, which had suggested Rudy had met with prosecutors “in recent weeks,” but this time dating the meeting to February, so months before CNN reported that a recent event meant a decision was imminent and at least five months ago from today, and clarifying that Rudy had answered prosecutors’ questions.

One key new piece of news, however, was that DOJ had recently returned Rudy’s devices.

While prosecutors had enough evidence last year to persuade a judge to order the seizure of Mr. Giuliani’s electronic devices, they did not uncover a smoking gun in the records, said the people, who spoke on the condition of anonymity to discuss a federal investigation.

The prosecutors have not closed the investigation, and if new evidence were to emerge, they could still pursue Mr. Giuliani. But in a telling sign that the inquiry is close to wrapping up without an indictment, investigators recently returned the electronic devices to Mr. Giuliani, the people said. Mr. Giuliani also met with prosecutors and agents in February and answered their questions, a signal that his lawyers were confident he would not be charged.

We can assume that detail — that DOJ returned Rudy’s devices — likely came from Robert Costello because (as happens increasingly these days), another outlet — Reuters — quoted Costello on the record saying what NYT had granted someone anonymity to share.

FBI agents recently returned the cell phones and other electronic devices they had seized from Donald Trump’s former attorney Rudy Giuliani, in a possible sign the investigation into whether he failed to register as a foreign agent of Ukraine could be winding down, his attorney said on Wednesday.

Robert Costello, Giuliani’s lawyer, told Reuters he has not been officially notified yet whether federal prosecutors in Manhattan are closing the investigation.

But he said the return of the devices is a positive sign for his client.

“I have not been officially told that its [sic] over,” Costello said. “It is possible they could make some startling new discovery…but we have always been confident that he didn’t do anything wrong.”

The primary other new piece of news in the NYT story describes documents and texts — the likes of which have recently been returned to Robert Costello — detailing a purported review of Rudy’s contacts with Dmitry Firtash that started in June 2019.

Mr. Giuliani began contacting Mr. Firtash’s lawyers in June 2019 seeking information about corruption in Ukraine, around the time Mr. Trump was pressing Ukraine’s president, Volodymyr Zelensky, to investigate the Bidens. Mr. Firtash’s lawyers told Mr. Giuliani they did not know of anything relevant.

There is no indication Mr. Firtash assisted Mr. Giuliani in his attacks on the Bidens, and Mr. Davis said the oligarch “categorically denies ever helping Giuliani or anyone else in any effort to dig up dirt.”

Even so, in the summer of 2019, an associate of Mr. Giuliani, Lev Parnas, met with the oligarch and recommended he add new lawyers to his team, the husband and wife, who were helping Mr. Giuliani dig into the Bidens. Mr. Parnas was paid to serve as their interpreter, and Mr. Firtash agreed to pay for some of Mr. Parnas’s travel expenses.

The offer seemed ideal. Around this time, Mr. Giuliani was preparing to go to London, and wanted to determine who would cover his travel. “Running into money difficulties on trip to London,” Mr. Giuliani wrote to Mr. Parnas in a text message.

During the trip in late June, Mr. Giuliani met in a hotel conference room with some Firtash associates, including a banker whose cousin was a Burisma executive.

Mr. Davis said the purpose of the meeting was to discuss Mr. Firtash’s contention that his extradition was politically motivated, and his associates did not talk about Burisma. The oligarch’s associates did not seek Mr. Giuliani’s help, Mr. Davis added.

That day, Mr. Giuliani upgraded hotels to the Ritz London. Mr. Firtash’s company, Group DF, later covered the roughly $8,000 stay, interviews and records show. The next month, the company paid $36,000 for a private flight Mr. Giuliani took from the Dominican Republic to Washington. And that August, Mr. Giuliani traveled with a friend and a bodyguard to Spain at a cost of more than $30,000, an expense that was listed on an invoice to a Group DF assistant and a longtime adviser to Mr. Firtash.

Mr. Costello said that Mr. Giuliani “doesn’t know how it came about.”

Note: Much if not all of this activity pertaining to Firtash post-dates the temporal scope, which ended on May 31, 2019, of Jones’ prioritized reviews. For eight of Rudy’s phones, the privilege review would not (based on public records, anyway) have been complete on materials after that period when Rudy met with prosecutors in February. The material would be in the temporal scope of the known warrants, which extend through December 2019, but not the Special Master review of eight devices.

Firtash’s name also didn’t appear in Parnas’ description of the scope of the inquiry that he released via redaction fail last year.

In a chart, the Government identified that it had sought and seized a variety of undisclosed materials from multiple individuals, including: the iCloud and e-mail accounts of Rudolph Giuliani (11/04/19); the iCloud account of Victoria Toensing (11/04/19); an email account believed to belong to former Prosecutor General of Ukraine, Yuriy Lutsenko (11/6/19); an e-mail account believed to belong to the former head of the Ukrainian Fiscal Service, Roman Nasirov (12/10/19); the e-mail account of Victoria Toensing (12/13/19); the iPhone and iPad of pro-Trump Ukrainian businessman Alexander Levin (02/28/2020 and 3/02/2020); an iCloud account believed to belong to Roman Nasirov (03/03/2020); historical and prospective cell site information related to Rudolph Giuliani and Victoria Toensing (04/13/2021); electronic devices of Rudolph Giuliani and Giuliani Partners LLC (04/21/2021); and the iPhone of Victoria Toensing.

If there were any SDNY investigation into Firtash, you would expect to see warrants targeting his cloud content as well. It wasn’t in the warrants that Parnas had seen at the time of seizure.

So one thing this story (which also relies on Firtash lawyer Lanny Davis as a source) does is compare notes between suspects about the scope of SDNY’s interest in Rudy’s contact with Firtash. As NYT notes, it actually reveals that the investigation into Rudy was  broader than previously known, and broader than the scope of the known warrants as described by Parnas.

In any case, what Costello told Reuters and presumably told NYT is that 1) he recently got these phones (content from which likely contributed to this story) back and 2) SDNY has not told him that Rudy is no longer a subject.

Generally, if DOJ seizes items as part of a grand jury investigation, they can keep them:

  • So long as the grand jury investigation in which the property was seized is ongoing
  • Until such time as FBI fully exploits the devices (that is, until they crack passwords and identify deleted content)
  • During the pendency of a Special Master review
  • For use in a charged prosecution if the validity of an extraction might otherwise be challenged

This response to Project Veritas’ efforts to get their phones back in a different SDNY investigation lays out the precedents in the District.  If the grand jury investigation is closed, the subject of the investigation gets their property back, and Rudy has gotten his property back. So Costello fairly concludes that the known grand jury investigation into Rudy has been closed.

The thing is, if those materials are used for any other investigation — particularly now that they’ve been reviewed for privilege with kind of involvement from Costello that would amount to stipulation about the accuracy of the exploitation — would not be shared around DOJ as actual devices, some imaginary bag of Rudy Giuliani’s many phones passed from FBI agent to FBI agent. They’d be shared, via separate warrant from separate grand jury investigations, on hard drives of the post-privilege review content.

Costello can say with some confidence the grand jury investigation opened in 2019 won’t result in charges. But he doesn’t have a good explanation for why even SDNY has not told him Rudy is no longer a subject.

A more interesting part of the timing, to me, is that before Rudy got his devices back, a different part of DOJ obtained two rounds of subpoena returns from at least a dozen people asking (among other things) for all their post-October 1, 2020 communications to, from, or involving Rudy Giuliani or Victoria Toensing. Some of the people receiving those subpoenas would be hostile witnesses, themselves possible suspects of a crime. DOJ started, though, with people who had refused to take part of the fake elector scheme, who presumably could be expected to fully comply with the subpoena, including providing any Signal, WhatsApp, ProtonMail, or Telegram communications that might otherwise be unavailable.

The FBI likely has enough sets of subpoena returns including Rudy’s comms to know what content should be on his phones from when he was helping to plot a coup.

That’s the kind of thing FBI might have wanted to check before they released Rudy’s phones, to know how aggressively they had to look for potentially deleted content on the devices.
